Troy Spurlock
I took on a Vietnam vetetan's case back in 2008 fighting the local RO on his claim for a skin condition as a result of Agent Orange exposure (chloracne) that he had been fighting for more than a decade before we met. Just got the decision today...service connection granted under a different title/category of skin condition, but a grant (approval) just the same! Second time I've kicked the VA's rear end at the BVA level! Can't wait to do it again!!!!!!

Berta
Troy, this is Great News!!!!! I would love to read the decision when the BVA posts it at their web site. It looks to me as though 2 issues were raised in the claim - either Chloracne due to AO ( I only know of one vet who received SC for that in the past 30 years-James Cripps) and also the possibility of a different type of skin disorder that had a proven nexus to this vet's service. "Second time I've kicked the VA's rear end at the BVA level!" I know the feeling. I wish the ROs could become sattelite BVAs so we could have BVA lawyers right from the git go to handle our claims. Lawyers love evidence so this if often the best place to be at for a proper resolve. It just takes so long to get there. I try to keep up with new BVA decisions every week. I have learned a lot about the thinking patterns of the BVA.and how they handle claims there. It isnt often I see something that seems to be so wrong that it can possibly be appellable to the CAVC. If a CAVC claimant can get a CAVC remand, that can open the door for more evidence. You did very well here! I admire your tenaciousness!

carlie
Troy, Congrats on winning for your work helping this vet. Did BVA adjudicate an evaluation percentage and effective date or leave that for the VARO to do now ?
