Military Pay In Lieu Of Compensation

Here's the details: I currently have a claim in with the VA. This claim is an appeal to my original rating. I just checked it on ebenefits; its under a pending decision approval. However, a new claim has been opened up, today, stating: "Military pay in lieu of compensation" This is current as of today. I think that is what the VA decided on my current claim which is still in a pending decision approval. Can someone tell me what does this Military Pay in lieu of compensation means? It also states it will take 95 to 138 days to process. Thank You

Don't wait do file the PDBR aplication. The more time you wait, the longer you can expect your claim to be processed and adjudicated. You have nothing to lose. Also, since I still owe and am paying out of my VA comp, according to

DoD 7000.14-R, VOLUME 7B, CHAPTER 4

"RECOUPMENT OF SEPARATION PAYMENTS" (see pdf enclosed)

page 4-6 discusses this issue as it was updated to adjust for newly retired members as a result of the PDBR. I'll keep posting the result of the recoupment swap.

Where do I go to file this PDBR Application? Should I include my VSO on this; I really don't think he will have a clue as to what I am talking about. I'm kind of lost myself. This is all new to me. I have some reading up to do. Perhaps you can point me in the right direction as to the necessary steps to get this process started?

Also, would it be a wise idea to submit the findings to the VSRB that the VA rated me for?

Unemployment is high in Florida now since the state depends on tourism and housing. Wages are low. There are few union jobs unless you can work for the post office as a disabled veteran. Do you already have a job lined up in Florida? If not don't come down here because you will end up stranded. The summers are long and very hot. I grew up here and have some people here. If you have a good job I think you could get a good buy on a house using G.I. Bill. Stay where you have people who can help you until this housing recession is over because Florida's whole economy depends on housing for good paying jobs unless you want to work at Disney World.

Follow instructions and fill out DD-294 (enclosed). Start gathering your documentation. They need your service treatment records (VA should have them), any documentation of your illnesses/conditions for which you were discharged, plus according to the rules they can look at all conditions. I'd file a FOIA to get your VA documents sent to you, then send them to the Intake Unit:

Is there a time limit on these kind of things? I was discharged from the Marines November 29, 2009. Should I inform my VSO of what I am doing or just do it myself? As for the FOIA, how do I request this? I also have an appeal with the VA. Will this FOIA delay the processing of this claim in anyway? Dude this is all new to me. This is the stuff they don't tell you about and you have to learn on your own. I really thank you for your help. I'd buy you a case of beer if I could!!! Thank You

One more question: If I go to C&P and ask for my exams do they have to give them to me then or is there some "other form" I need to fill out in order to recieve? And do I have to go to the exact same C&P that did my exam or is it in the VA's system and I can go to any VA C&P Exam center.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
