Fiduciary Appointed

Question

The DAV sent me a letter saying "The claimant is not competent to handle disbursement of funds" I'm OK with this cause it's true. But a new claim has also been opened in ebenefits in the predetermination phase.

Since I have no open claims I don't understand what this means. I know many people warn against fiduciaries but it will be my mom and I have many financial problems.

The reason for the warning, even with a close relative, has to do with the VA's ideas. One is a stringent reporting system.

It's far better to stay out of the VA's fiduciary scheme, and use a state court approved fiduciary if that is necessary.

The VA Fiduciary scheme also involves loss of the right to own firearms. The state laws may or may not.

They told me today that they might do supervised directcpay instead of a fiduciary. There going to do a Field visit to my house then decide.

The "Field Visit" is a required part of the fiduciary scheme. At this point, it's totally up to the VA to decide what they will do.

You did not identify the area that you are in, so all I can say is that things vary from one VA region to another. Perhaps the

one with the worst reputation? Waco, Texas comes to mind. (Paid Fiduciaries handling multiple veterans, poor VA supervision, etc.)
