What Happens To Your Appeal If You Move To Another State?

Question

My appeal is stuck on the hamster wheel and going nowhere in St Pete. I can't even get a SOC.

If I move to another state does the appeal move to that RO? I'm thinking that would be good.

You haven't specified what type of Appeal your waiting for, that could make a big difference if it all comes down to #'s and your place in line. If you're waiting on a BVA Hearing, how would the transfer affect your future Hearing Date place in line? If it's a DRO Hearing, same question? PR's experience would indicate careful consideration is necessary before just putting in a change of residence. You may want to be proactive and request in advance that your appeal stays at your original VARO. I don't think you can determine with certainty what the effects of a transfer would have on the future Hearing timeline.

I'm waiting on a BVA hearing.......already had DRO hearing with no luck and no SOC......still waiting (14 months now) on SOC and form 9 to go to BVA......I think St Pete has buried it on purpose.....If moving to another state will get it out of St Pete, I would move tomorrow.

Therein lies the problem, you as well as all the rest of us never know when the VA is about to bust a move. For what if anything it's worth, my take is your looking at anywhere from 18 to 24 mos after the NOD Denial before your appeal gets certified for BVA. Some things come to mind based on your recent info. Any N&M Evidence sent in post DRO Hearing has to be looked at and a SSOC be produced if the Triggered VARO Review doesn't grant the award, all very time consuming. Then there's the question of BVA Hearing however you haven't received the Form 9 yet.

Got a VSO-Rep? If not get one at your VARO main office. My limited experience indicates it's not unusual to have a very Seasoned Experienced former VA Rating Dept Rater or actual DRO that has retired and now works part-time for a VSO. That would be my go to guy, to find out WTF is going on. I lucked out at my 06/14 DRO Hearing, the VSO Hearing specialist just happened to be a retired DRO. He was on a 1st name basis with the VA DRO hearing my appeal. Great source of insight into the VA Claims & Appeals workings.

I check with the BVA at my VAMC believe it or not & they gave me this form change of address form....anyway you can request them to leave your claim at the RO that you filed it with but you need to request it other wise it will go to another RO.

but this has been years ago....it may have change ?

I moved from St Pete back to Maine and things moved faster. Because of all the retirees and snowbirds down there

things, don't move at all. I felt like they buried my appeal for more then five years. It has moved more in the last year then

it did in the previous 6 years. But a lot has to do with all of the help I have found on this site. These guys are great.

I guess different RO's are different simply because they have better common sense employees' than some of the Idiots at other RO'S

& That's a shame!
