Back Pay Question

Question

I just received my back pay. My finding was for 2/10/15 and it is now 4/20/15 but I got paid 6 months back pay. Is this correct or did they screw up. Some of my claims are from March last year but most that pushed me to the 100% was from February of this year. Do they pay a minimum of 6 months back pay?

We can not tell if your effective date is correct, based on what you posted.

No, there is no minimum 6 months retro.

Effective dates are one of the most complex areas of VA law.

Generally,

Your effective date is the later of the date you applied or the date the doc says you were disabled. There are exceptions to this.

When you do get an effective date, your pay will begin on the first day of the month following. So, if your effecitive date was 4/20/15, you would not get paid until June 1, 2015.

if your finding is from 2-10-15& now they have it 4-20-15....disagree with there decision. and if you got paid 6 months retro ask them for what dates the base that on? you may have to pay it back so be careful to not spend it just yet!

unless there going back to the date when you first file for claim or increase.

Have you received your award letter (BBE) yet?? If not, it will be explained in the award letter. Based on what you've posted, I couldn't even begin to guess. As bronco stated, there is not minimum 6mo retro. The VA will pay as little as they can get away with! It could be that the doctor stated you were TDIU six months ago, in which case they may have used the C&P exam date. Just guessing, tho.

Your award should explain in detail your award.

I put in an increase on February 10th for my knees and they granted an increase. They also granted connection for my hips that I put in March of last rear and the back pay is 6 months worth.
