Question

HAPPY MEMORIAL DAY BROTHERS, SISTERS, and FAMILY MEMBERS!!!

I see a lot of wording in the 70% and 50% percent areas so I'm not sure what the final results will be. Please chime in with your guesstimation.

1. Diagnosis

------------

a. Does the Veteran now have or has he/she ever been diagnosed with a mental

disorder(s)?

[X] Yes[ ] No

If the Veteran currently has one or more mental disorders that conform to

DSM-5 criteria, provide all diagnoses:

Comments, if any:

At least as likely as not incurred in military service secondary to

service connected xxxx

Mental Disorder Diagnosis #2: Major Depressive Disorder

Comments, if any:

Secondary to service connected xxxx

Mental Disorder Diagnosis #3: Panic Disorder without agoraphobia

Comments, if any:

Secondary to service connected xxxx

3. Symptoms

-----------

For VA rating purposes, check all symptoms that actively apply to the

Veteran's diagnoses:

[X] Depressed mood

[X] Anxiety

[X] Suspiciousness

[X] Panic attacks more than once a week

[X] Near-continuous panic or depression affecting the ability to function

independently, appropriately and effectively

[X] Chronic sleep impairment

[X] Mild memory loss, such as forgetting names, directions or recent

events

[X] Impairment of short- and long-term memory, for example, retention of

only highly learned material, while forgetting to complete tasks

[X] Difficulty in establishing and maintaining effective work and social

relationships

a

worklike setting

[X] Suicidal ideation

3. Occupational and social impairment

-------------------------------------

a. Which of the following best summarizes the Veteran's level of

occupational

and social impairment with regards to all mental diagnoses? (Check only

one)

[X] Occupational and social impairment with deficiencies in most areas,

such as work, school, family relations, judgment, thinking and/or

mood

1) Therefore, it is at least as likely as not that this

veteran's Unspecified Anxiety Disorder is secondary to his service connected

XXXX and was incurred in military service.

2) it is at least as likely as not that this veteran's Panic Disorder was incurred in

military service, secondary to his service connected XXXX.

3) it is at least as likely as not that this veteran's Major

Depressive Disorder is, in part, secondary to his XXXX

Leon,

Review the Schedule of Ratings for Mental Disorders in 38 CFR part 4.130. Whichever percentage block contains the majority of the symptoms more accurately matching your symptoms listed on the C & P report would probably be the percentage level awarded. If you have five symptoms in the 50% block and three in the 70% block, you would more than likely be awarded 50%. Compare your symptoms and see for yourself which percentage block more accurately matches the symptoms on your C & P report. JMO

Thought I was a 30 possible lite 50, got a 70 so don't rely on me. That was 5 yrs ago and in my vastly improved Lay Mental Health rating knowledge, I would say your pretty Fracked up and will end up with a 70% SC and an Inferred IU Claim. You must actually file for the IU, Inferred only means your schedulerly eligible to file. So if you have not earned income above the VA "Substantially Gain Full Income" level of $12,400 per year, get the claim in now as another FDC.

If your current claim is an FDC, filed this year, you should get the "FDC 12 Months Retro" Bonus, all good. Semper Fi

Hang in there, bud. 70% here. It sucks. If you are having a good day you are sleepy from meds, if you are having a bad day you dont care if you are sleepy, or much of anything else.
