Question

I put in a claim for IBS and fibromyalgia 8/15. I had a. DBQ and all my medical and buddy statements and all the the other proper forms sent electronically. In march they asked for 21-4142 to get my medical records from my doctors or get them my self. I called the 1800# and they said that they see all my medical records and don't know why they are requesting this. So I sent them again anyway. A month later I see they reopened a old claim. Then it showed up I was claiming anxiety and depression secondary to IBS. I never did this. Now I get a letter saying my old claim was denied because I need new evidence to open it up and they are giving me 30 days. Also the anxiety and depression secondary to Ibs was denied because the I am not service connected for IBS. Like I said I never asked them to reopen my old claim or tried to get a secondary claim they did that. All I put I'm for was Ibs, and Fibromyalgia. I know 9 months isn't long for a claim but I sent in all the documents and I am still at gathering evidence phase. They have no evidence to gather I did that. I am afraid the 30 days will go by and then they will ask for for the evidence again. It's like they are stalling. Any ideas in what I should do?

That's exactly what I was thinking I figured I start it myself and if it didn't work out I get a lawyer. I have sent everything electonicilly. Crazy thing is I see they have it but they are still asking for it.

I read over their letter but it didnt not even seem to acknowledge this claim for IBS and Fibro.

Did you file this claim electronically? Did you get any email response of proof of filing it?

I assume you mean August 15th, 2014?

I strongly suggest that you file an IRIS complaint. or contact the Sec or UnderSec.

IRIS complaint...go to www.va.gov, Contact Us, then click on Ask a Question and tell them what you told us here as to the claim you filed for IBS and Fibromyalgia.

Ask for an email reply. They make stuff up when they contact us by phone.

Ok thanks. Yes I have proof they received the fibro and ibs claim. I will email iris today. I emailed sec yesterday. Yes I meant 2014. Thanks again. Crazy part is I was told by doctor to reduce stress because it makes fibro worse. Va is making this more stressful than it has to be.

I agree with Berta. For VA "stalling" is winning. If they can "stall" your claim into "next years" budget, then they can spend more money this year on what they want. If they can stall in still another year, that is even better.

There really is truth that VA wants to delay until we die. There is significant financial incentive to stall. Would it not help your finances if you could "stall" your electric bills until 2017 and pay no interest or penalties, and not pay them at all if you die first? I would love to stall all my bills until 2020, and then spend my money on whatever I want. This is exactly what VA does, and why they want to stall in every possible way.

This is what hurts my soul...

Here is a update. Just got a call from someone who said the secretary received my email and wanted him to call. I explained what was going on. He was looking at my file and said he doesn't understand why they are doing this. He said he sees all my medical and proper paper work and doesnt know why they opened the old claim. He then said they are going to get someone on my case right away. When I got off the phone I checked my status and it is went to preparation for decision. Hopefully it goes smoother from here. Thanks again
