Too Broad Mental Hygene Claim?

I found out in 2005 I had issues, and assumed they were just depression. After a lot of group therapy I decided to file a claim for it. The VA denied the claim, but suggested I had been treated and diagnosed with a differently named mental condition (I used the wrong name). Upon receiving my medical records I learned I was diagnosed with “adjustment disorder with signs of stress.” Over the years VA labeled me with a lot of mental issues, so I filed a new claim for non-combat PTSD, Chronic Adjustment Disorder, Anxiety, Acquired Psychiatric Condition, and TDIU. The reason for TDIU is because I was granted a non-service-connected pension, and lived on this meager amount until SSDI benefits were granted. Currently I am 10% service connected and for purpose of pension the VA rated other conditions at a totality od 90% to grant the NSC Pension. NEXT: I selected on eBenefits to “decide claim now” the rationale was I had a Nexus Letter, Military treatment records indicating adjustment disorder with signs of stress, and VA records. QUESTION: eBenefits changed status a few times, after the C & P I feel the examiner rushed me and did not give full consideration of everything; impossible to do in one hour. The claim was filed September 2014 indicating a decision to be made between September 2015 and March 2016. Needed from me 1 with a green dot; needed from others Birmingham VA with a red dot and due date 9/18/2015. Can anyone look into a crystal ball and let me know what to expect? I filed the claim with no help, but later joined the American Legion. The service officer said I made a mess of the claim and to never-never-never communicate with VA without going through him. Am I screwed?

Did you make the VA aware of the SSDI award letter?

What specifically are you on SSDI for?

What is the 10% for?

Make sure they have this evidence:

"I had a Nexus Letter, Military treatment records indicating adjustment disorder with signs of stress, and VA records"

Can you tell us how they broke down the NSC pension rating?

With multiple disagnoses , it isn't your fault an I do not feel you messed up at all.

"The service officer said I made a mess of the claim and to never-never-never communicate with VA without going through him. Am I screwed?"

Not yet. If I had listened to power hungry NSOs in the past ,I would be screwed and tattooed by now.

I am 0% for condition of the skeletal system (fractured 5th metacarpal) and 10% for tinnitus

The NEXUS read my condition was more likely than not related to the Navy diagnosis of adjustment disorder, and

The SSDI Award Letter were submitted reading "...Mood Disorder, and Post-Status malunion fracture so severe..."

Also submitted was a VA Vocational Rehab Specialist progress note which said VR was not an option and this is what actually qualified me for NSC Pension.

The Pension rating breakdown was:

50% Depression, nsc

10%Hepatitis C, nsc

10% Renal Calculus, nsc

10% Fractured Dominate wrist, nsc

10% Tinnitus_SC

So, a total of a 90% mixed rating qualified me for NSC Pension, which I forfieted when SSDI was awarded.

Now I receive my SSDI plus a 10% SC of $133.17

However I feel like something is wrong, becausw of the way the Legions officer described the way I filed the claim...

I had no competent help locally!

Any information is appreciated.

Adjustment disorder is consider a Personality Disorder and for most a denial for VA Service Connection. Most are misdiagnosed with this and you should follow up and appeal your claim if it is not to late 1 year after you were denied and if it is you should file a claim asking VA for 100%.

"A brief generalized accounting of the trauma…"___At 3 1/2 years into enlistment and one deployment my evaluations went from 3.8 & 4.0 to a 3.2 because of the filing of a UCMJ Article 138 complaint (I placed skipper on report). ___Needless to say the last twelve months of my service was not very pleasant! I was later denied a transfer and demanded a court-martial to clear my name. They sent me for psych evaluation= Adjustment disorder with signs of stress. From what I have read I was supposed to be separated on the spot, via medical review board, but I suppose since I demanded a court-martial some brass would have leave the service with me; so I kept my stripe and spent the next twelve months in 1st Lieutenant. RE4 LBK Characterized Honorable! I have also read this diagnosis is compensable and gateway for acquired psychiatric disorders since the acronym DNEPTE is on the documents. No, they refused to give me a court-martial.

I did read that Chronic Adjustment Disorder was now compensable; on this site. Why I ask did they even preform a C&P if what the military said is not recognized?
