Repeat C&P Exam

Question

Hello all, I filed for an increase on several contentions as well as some new contentions in February 2015 and had my C&P exams conducted in August 2015.  I just received a call to schedule C&Ps for the same exams previously conducted in August 2015, with the same doctors as well as with a mental health doctor.  I suspect this is common if there is a question from the rater, my question is has this happened before to anyone else or am I just being paranoid?  Thanks for any input...

Hmm, welcome, gotta say, something interesting this way comes!  I can only surmise that someone dropped the ball and your name got put back into the schedule C&P exams pile. 

Maybe a quick call to "Peggy" might help.  Peggy is the "Nome de Plume" such as it is, for the 1-800 number for the VA.

You can also submit a question via IRIS on the VA.gov website.

I'm sure some of the heavy hitters on here have better ideas to pass along to you.

I agree with andyman. Something doesn't seem right. Particularly, that the newly scheduled exams are with the same doctors. I can not think of a scenario where this would be appropriate. If one of your C&P exams was lacking something, I could see a new one being ordered, however If the Va just wanted additional information from an examiner, it wouldn't normally require you to be re-examined. If these exams are being conducted by one of the contractors (QTC for example) I would call them and inquire. If these exams are through the VA, I would call Peggy.

This is the second time recently that I have read about folks having C&P exams repeated within a short time frame.

Back in the 90's, I had a repeat C&P exam scheduled a few weeks later because the doctor "lost" his original write up. With everything being electronic, I doubt that is the reason why they did this.

Did they schedule the new exams for a Friday? It would not surprise me if they are booking out a Friday with repeat exams, then as it draws closer they send out a cancellation. This is a traditional "I want an easy Friday" approach.

Thanks for the quick responses..I asked the C&P scheduler about the exam and she stated that they were asked to schedule another C&P exam with the General Medicine doctor for my Gulf War Illness contentions as well as Mental Health.  I went to the C&P in August which was scheduled for 3 hours and the doctor said that she reviewed my records and kept me in there for 38 minutes and sent me on my way.  Now I'm scheduled again for a 2 hour exam with the same doctor and the Mental Health doctor a week apart.  The exams are both scheduled on consecutive Tuesdays, October 6th & 13th.

i had one exam rescheduled because of regional's error. in reality, it was the same exam. i was going for an increase for my thoracic spine. regional ordered a lumbar comp and pen. then realized they made a mistake and reordered. all the comp and pen doc did was change the wording and do a thoracic xray.

This happened to me, and it happens more than you might think.  Rememeber, it is not a requirement that a rating specialist be able to read and write English for employment, he needs only to know the hiring manager.  

You have to go to those redundandt exams.  Its an automatic denial if you dont.  The VA has a rubber stamp cut and paste denial for many things like:

1.  You failed to attend a C and P exam so your claim is denied.  

2.  You failed to appeal withing the one year period and your appeal is denied. 

3.  You dont have a diagnosis of the claimed condition so your claim is denied.

4.  You dont have a nexus so your claim is denied.  

5.  You dont have an inservice event or aggravation so its denied.  

6.  You dont have the requistie service so your claim is denied.  

These are all "automatic" denials.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
