0 Jumbo2016$ Posted May 25, 2018 Author Share Posted May 25, 2018 Thnx....They awarded me an effective date for Sep 2002 for my TDIU... but claimed bcuz my conditions were combined i was not given SMC S...At the time ....70 PTSD 30 Hysterectomy 50 Chronic Pelvic Pain 100 TDIU... 0 Moderator broncovet Posted May 26, 2018 Moderator Share Posted May 26, 2018 I get that, but there are 2 types of SMC S: 1. Statutory. That's the 100 plus 60 "seperate and distinct". This is probably what they are trying to say. However, they may not have considered: 2. Housebound in fact. This normally means a C and p exam, and, if you show up to the exam, the VA denies because they say if you were housebound, you could not leave the home to go to the exam. Its wrong. 0 Jumbo2016$ Posted May 26, 2018 Author Share Posted May 26, 2018 Ive attached the reason for decision on the SMC S issue....I filed a CUE for the effective date and won...It was changed to Sept 2002 but I recvd no back pay bcuz my TDIU was based on more than one sevice connected condition... 0 HadIt.com Elder Buck52 Posted May 26, 2018 HadIt.com Elder Share Posted May 26, 2018 When you arrive for your hearing check with the VSO's they should be one there that can help you and go with you to the hearing arrive about an hour early so you can do this, if you have your evidence a VSO is not really needed but for your comfort a VSO would help just arrive early enough you can fill the VSO in on some of the details your there for right before your hearing. Just relax and after you meet your DRO things won't be as bad as you think Remember the DRO is there to help you solve this and has the Authority to make a decision on your claim right then and there. 0 Gastone Posted May 26, 2018 Share Posted May 26, 2018 Regarding your June 5 Hearing and getting a VSO Hearing Rep up to speed. My DRO Hearing 06/14 VSO Hearing Specialist hadn't reviewed my appeal until I showed up at the RO 8:30 am. However, he did show up because the VSO HQ Office was Aware of the DRO Hearing. What to do, what to do? Get on the phone Tuesday 5/29 with the different VSO HQ Offices located at your RO. Whichever VSO has an available DRO Hearing Specialist for 06/05 would probably be a good choice. It might require a pre-06/05 trip to sign a POA, either at the VSO RO HQ or at a VSO Satellite location, possibly at your VMC. What's your New & Material Evidence that you are sitting on, as opposed to already forwarding to the Rating Dept? Are you just relying on your Lay wants and feelings?
