Would anyone be willing to look over my husband’s new report and DBQs concerning separate ratings for TBI/PTSD A&A Headaches? we also posted a lot of his VA claim docs too.

 

Thank you all very much for all your prior advice. you have helped my husband so much and we truly appreciate all your help.

By the way THANK YOU for the help and support you are giving your husband. I live 24 miles from a VAMC and know many vets and their spouses living in this county. Many of their spouses have no interest in their vet spouse's claims at all.

Since a spouse benefits from the highest rating their vet spouse can get, you would think they would be more helpful to the vet. And I also hear from many vet widows in the county, and tell them to come here-to hadit- but many do not know how to use a PC, and in that case, I regret that I have to send them to the two VSO offices in the county, one at the VAMC, hopefully to get the proper help. I never got accurate POA help with the DAV and NYS Division of Vets Affairs at all for my original 2 claims.I did far better handling them and the rest of my claims  myself.

I also am seeking more info that supports the medical fact that PTSD is emotional and mental trauma-DC 9411, whereas any type of TBI is a physical injury to the brain. We had so much discussion here in 2008 over the scandal that brought about these new TBI regulations- but it will take me time to find it all.

Your husband has never gotten a percentage or rating under 9411- as I understand this- and you would think the separation of PTSD from TBI would is logical and would make sense. However we do not deal with sensible VA entities most of the time and the regulations do not require logic, they require medical evidence, and you have plenty of it.

Hopefully others here will actually read the above BVA decision and take note of what the VA stated, and opine here  on it.

I was one of the commenters at the Federal Register site on the October 2008 regulations, before they were finalized.

I think one other member commented as well.maybe

A member here in this thread had his TBI separated from his PTSD, as to the ratings:

Perhaps his email addy is in his profile and someone could contact him and ask him to return and opine on this thread.

Hi Berta,

THank you

the intent to file ends in july.

If you read his first wife and Mother.s letters from his Claims file, They stated that my husband and first wife stated many of my husbands psychological, physical, and emotional issues and a nurse helped by filling out the complaints when he was discharged. when my husband went in to see the doctor, the doctor lost his temper saying he didn't have time for this and wanted to know who the nurse was that helped them with the paperwork. my husband refused to point her out and the doctor yelled at all the nurses. after returning back to his office he through my husbands document into the trash and filled out a new one, minus all the complaints except headaches and a scar on his head (from the pick ax)

Prior to the trauma, did your husband have other PTSD stressors,that could have been confirmed as to happening prior to his boxing trauma? not before joining the Marines

Did the VA know of them?

How much time is left for you to support the IFT claim? we have till July
