If you agree with the Board decison, you dont need to appeal.  If you think that effective date, or any thing else that results in reduced pay is wrong, then you can appeal the bva decision by hiring a lawyer and going to the CAVC.  A lawyer will probably represent you at no cost to the CAVC because eaja pays the fees.  

 

You should get an "implementing" decision from your Regional office, before you will get any money.  This could take 2 months to a year.  If its been over a year since your board decision, let us know.  

Rememeber, you can appeal any decision except the US Supreme Court.

Thanks!   What is a “implementing” decision from RO?   Can my VARO change the decision that the VA judge granted?

After a BVA decision, the VARO issues a decision which is supposed to comply with the BVA ("implement" the decision).  The board issues a  decision, and the VARO has to carry it out.  

You dont get paid until the VARO implements the decision.  

Many times the Board does niot decide "everything", but instead leaves discetion up to the VARO.  Example:  Many times the BVA will grant benefits, but the regional office decides what percent, and what effective date (but not always, the board can specify an effective date or percent) 

Yes, I know.  It sounds like a delay tactic, and it is.  Implementation decisions can take 3months to a year or more.

I agree!  Took a little over a year and a half for the VARO to implement my granted conditions.  BVA only specified the percentage on one of mine, which was an appeal for a rating increase anyway.  Still waiting on one remaining granted condition and two remanded, so still on the clock on those.

Good luck and definitely talk to an attorney as soon as possible if you want to appeal.  Clock moves very slow when you are waiting for your decision, but it is goes like lightning when you have deadlines to file with the VA.
