There is Constitutional support in Section 4 of the 14th Amendment on the costs.

You can throw in a motion at the BVA to join in my BVA Appeal on the appropriate motion(s).  Reference my name and date of the motion you are joining.  You won't have to wait as long because the decision will probably easily be changed on the outcome of Arrellano.

Am correct with stating that equatable tolling was a factor in why I did not file my claim sooner? Because of my mental health condition.

I originally filed in 2009 but I was discharged in 2004. I had many mental health conditions going on that prevented me from filing sooner.
