DBQ added 8 months later?

Question

Morning folks,

 

Eight months ago I had a C&P exam for SC Miniere's disease, and am following it's progress on va.gov.

 

This morning I noticed they added a new DBQ dated July 13th, 2024.

 

I guess under any other circumstances a new DBQ would be good news, but 8 months AFTER my C&P exam?

 

Questions:

Does this late DBQ sound legit?

Does anyone know how to interpret all these numbers, letters..., associated with a DBQ; is there a "cheat sheet"?

I already know there are certain forms for each DBQ, Mental, Organs, Spine.., but here is my new DBQ(first million numbers and letters omitted )   4_1_DBQ_1015_1

 

Also please note that the VA won't give you a copy of a DBQ if the case hasn't been settled.

According to some "credible sounding" stuff I heard online, VA is making some changes especially those involving tinnitus, and mental health ratings.  Right now, they may be "proposed changes" but I dont know if/when they will be implimented.  

The rumor suggests it will be easier to link tinnitus to PTSD/mental disorders, and they are changing stuff on the rating criteria for mental health disorders "allegedly" making it better for Veterans.  We will see.  I will post something more detailed if/when I find out for sure if the VA implements (begins) the proposed changes.

One of the reasons I want the BVA to do a finding of facts on these issues, including the remand to VARO in 2017 of tinnitus because the rating level is insufficient for the percentage of jobs, particularly for those in categories II & III induction, or TBI victims that also have to think of jobs that have beeping signals like forklifts, of which there are many, including tractors of farms and dishwashers whether at home or in a restaurant, timers etc.  If your tinnitus prevents you from hearing these beeps as opposed to the low frequency fire alarm or security alarm which are emergency alarms, then you have a lot of closed job opportunities.

I am then asking for a referral to the Director, Compensation Services.

My motion to remove CCK will be submitted tomorrow because the issues they want to work have not been developed to go before the BVA and will likely go my way whether or not they represent me.  They came in to get a quick piece of my back pay on those claims with no intent of representing my issues at the BVA and no other reason in spite of the issues benefitting their current and future clients.  Succinctly stated by one of the callers from CCK.

Fyi this change has been proposed fit about 4 yrs and still pending. I wouldn't hold your breath. You can follow it in the Federal Register.

(I AM NOT A RATER- I work the claims BEFORE they are rated, annotating medical evidence in your records, VA and Legal documents,  and DA/DD forms- basically a paralegal/vso/etc except that I also evaluate your records based on Caluza and try to justify and schedule the exams that you go to based on whether or not your records have enough in them to warrant those)

CCK, like most everyone else, is looking at the "bottom line" (money).  CCK is not a non profit.  

And, this means they rarely spend a lot of time on issues which are unlikely to produce back pay retro.  

Over the decades, I have discovered that I have very little influence over things like how the VA operates. 

Mr. Carpenter, NVLSP, and, yes CCK law have done things very good for Vets.  But its slow.

As long as congress continues to buy into VA's alleged "claimant friendly" rhetoric, the VA gets its own in house police force (VAOIG)

to ensure the continuation of VA being a "honey pot" for well connected contractors.  And, helping Veterans has a much lower priority than enriching friends and family of high ups.

Rep for Vets was my pain in the a$s some years ago, and I wound up removing them as they were riding the clock as well.

They were a sponsor here early on, but gladly they faded away; they were a 20k mistake on my part

@brokensoldier244th,

Luckily for me I already had a diagnosis given by my ENT doctor, and I'm wondering if the C&P examiner can change that diagnosis?

I know examiners can expand or add to the diagnosis, and can determine a SC date, but not sure what "powers" they have beyond that.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
