DBQ added 8 months later?

Question

Morning folks,

 

Eight months ago I had a C&P exam for SC Miniere's disease, and am following it's progress on va.gov.

 

This morning I noticed they added a new DBQ dated July 13th, 2024.

 

I guess under any other circumstances a new DBQ would be good news, but 8 months AFTER my C&P exam?

 

Questions:

Does this late DBQ sound legit?

Does anyone know how to interpret all these numbers, letters..., associated with a DBQ; is there a "cheat sheet"?

I already know there are certain forms for each DBQ, Mental, Organs, Spine.., but here is my new DBQ(first million numbers and letters omitted )   4_1_DBQ_1015_1

 

Also please note that the VA won't give you a copy of a DBQ if the case hasn't been settled.

Lemuel,

Actually Meniere's disease used to be grouped with other conditions of the ear including Otis Media, perforated eardrum, chronic ear infections...

 

However, over the last year or so Meniere's has been designated as a separate condition mainly because it's a condition of the inner ear, and it's cause is not well understood.

I take meds for it that are specific to it, and no other ear conditions.

Exactly.  Menier's syndrome was treated by the VA as a symptom of the other or other condition's that cause the room to spin or dizziness including eye conditions, not a separate condition of it's own with a specific cause that has become treatable because the specific cause has been identified.  Menier's syndrome from that cause is much worse than the symptom of dizziness from other causes.  It can be very severe comparatively.

Yes, and my examiner indicated I probably had it for a long time, and asked if I had the same symptoms after being discharged in 1990?

Have you seen the rating schedule for Manier's syndrome?

 

Diseases of the Ear

  Rating
6200 Chronic suppurative otitis media, mastoiditis, or cholesteatoma (or any combination):  
During suppuration, or with aural polyps 10
Note: Evaluate hearing impairment, and complications such as labyrinthitis, tinnitus, facial nerve paralysis, or bone loss of skull, separately.  
6201 Chronic nonsuppurative otitis media with effusion (serous otitis media):  
Rate hearing impairment  
6202 Otosclerosis:  
Rate hearing impairment  
6204 Peripheral vestibular disorders:  
Dizziness and occasional staggering 30
Occasional dizziness 10
Note: Objective findings supporting the diagnosis of vestibular disequilibrium are required before a compensable evaluation can be assigned under this code. Hearing impairment or suppuration shall be separately rated and combined.  
6205 Meniere's syndrome (endolymphatic hydrops):  
Hearing impairment with attacks of vertigo and cerebellar gait occurring more than once weekly, with or without tinnitus 100
Hearing impairment with attacks of vertigo and cerebellar gait occurring from one to four times a month, with or without tinnitus 60
Hearing impairment with vertigo less than once a month, with or without tinnitus 30

Note: Evaluate Meniere's syndrome either under these criteria or by separately evaluating vertigo (as a peripheral vestibular disorder), hearing impairment, and tinnitus, whichever method results in a higher overall evaluation. But do not combine an evaluation for hearing impairment, tinnitus, or vertigo with an evaluation under diagnostic code 6205."

There may be a difference in opinion of the frequency between QTC and your private physician.  May be like epilepsy now.  If controlled by medication, the rating goes down.

How are you doing?  My deceased wife's was cured with about a 6 month medication treatment.  Without medication she was unemployable before finding a neurologist that was aware of the new treatment in the early part of the 21rst century.

The medication has varying degrees of effectiveness.

just because you had a C&P eight months ago, doesn’t mean that they didn't just recently get the results and that there wasn’t something incorrect, not detailed enough,  or not answered correctly on them, meaning they have to go back for a different opinion either from a different examiner or to be corrected by the same examiner.

(I AM NOT A RATER- I work the claims BEFORE they are rated, annotating medical evidence in your records, VA and Legal documents,  and DA/DD forms- basically a paralegal/vso/etc except that I also evaluate your records based on Caluza and try to justify and schedule the exams that you go to based on whether or not your records have enough in them to warrant those)

Yes, and the subjective questions the examiner asked concerning the frequency of the vertigo, and cerebellar gait, as well as tinnitus, were all answered with "everyday", as that's how often they affect me; tinnitus is already SC.

 

brokensoldier24, correct.

We already know that if there are any differences of opinion as to the severity of the condition, the opinion that benefits the veteran the most, stands.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
