Medical Records Destroyed After 7 Years, But Rating Specialist Wants Them

Question

Chronological background

Injured back three times in military, twice in 1971 and once in 1972. Could not find it in SMR's but have other proof; letter from CO, prescriptions, medical opinion from private Orthopedist 3 days after the last injury etc.

Medically discharged for back condition 12/72

Filed claim 1973: denied because not in SMR's

Reopened claim 11/01

Rating decision: No new evidence 3/02

New evidence received 7/02

Denied claim 10/02

NOD filed 10/02

BVA Appeal 9/03

Board hearing 3/04

Board remanded 6/05

AMC letter 6/05

C&P exam 10/06

Ratings Specialist 4/07

The board remanded my case on 6/05. In the remand it asks for medical records from several private doctors over the years, one was not mentioned, maybe because I sent a letter to the Board in 2003 stating that this Doctor was deceased and that, according to the executor of the estate, his medical records were kept for 7 years and then destroyed. Unfortunately, I did not keep these records.

I had a favorable C&P exam on 10/ 06, service connected.

Since Aug 2006, I have been assisted by my local Congressman's office. They recently did an inquiry and found out that the Rating specialist wants the medical records from this decease doctor. I have called the executor of the doctor's estate and asked her to put it in writing that the records were destroyed. I should received this letter soon.

The time period that I seen this doctor was 1973 to 1986. After 1986, I have my medical records.

The Congressman's aide also said that AMC may want me to go to another exam.

Any comments?

Larry:

I am glad that Dallas is treating you well. I have noticed some big changes there and most are positive. For one thing the VA employees seem much happier and most are more friendly than it used to be. I also notice that they are listening more and not telling so much.

Maybe one day we will bump into each other.

Veterans deserve real choice for their health care.

Josephine (BTW, love that name. My middle name is Joe, hence the "LarryJ", my son's name is Joe, my wife's name is Joan, my father-out-law's name is Joe, his son's name was Joe, and my brother's wife's name is Josephine........love that name!).

Anyhow, I do not know what this "overflow" thing is.

I do know that if you have a really good Senator/Senatorette or Congressperson, this might not be such a bad time to call and talk to their "VA case work" person. What with all this publicity centering around the VA/Military healthcare fiasco......well, you might be surprised how fast things can start moving.......I just lubbs my little Senatorette, Ms Kay BaileyH.......just sayin.

Sam Johnson ain't no slouch, either (Sam spent longer in VC prison than what's-his-face from Arizona)....Sam was a darn good USN jet jockey, etc. I laks dat Sam.....just sayin

Heck, this morning my coffee tastes good....my dogs love me....the sun is shinin...my wife just patted me on the butt.....and the meds from the VA....well, life is good...

Strarbucks at the VA isn't that something. We will have to do it another time although they owe me some new shoes.

Your meds must be working you hvae been a beakon of light the last week.

It sounds like you are having a super fine morning. Praise the Lord, as the sun is shining here also Actually I made it to some yeard sells. I love to buy antique quilts, but they are becoming more difficut to locate.

I love the name "Josephine". I used to stay on weekends with an elderly lady, when I was about 8 or 9 years of age and that was her name.

My name is actually" Betty". One of those good old names of the late 1940's. You don't hear it too much any more.

Larry, I think that the " Over Flow" is a place to put claims that are going around the "Mulberry Bush". I did that a lot as a child.

Senator Warner doesn't have much to do with the Veterans, but I have been told that since my claim is a "Sensitive 6" and is in West Virginia that Senator Rockafellow has to help me.

I have heard that he doesn't put up with this nonsense. I tried Senator Byrd of West Virginia and he referred it back to Warner as a courtesy.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
