Cue
Regarding my CUE claim for a much earlier effective date for my IU the VA has requested my SSA records. Is this good or are they just trying to find evidence to deny my claim? I cannot believe they will give me a fair shake. When I was rated the VA never considered IU even though they had information I was unable to work.

Veterans Claims Assistance Act (vcaa)
The VCAA Letter wasn't around when I did my claim & now have vet with questions. I searched & found many posts, but this might be a little different. This Vet served on the ground in the Air Force in Vietnam. He has one of the Presumptive Cancers on the AO list. I wrote his claim exactly like my Cancer Claim (which was approved in 22 days). Included a DD214, doctors report & later he sent them 100 pages of lab reports. All this supporting his Cancer Claim. I know these letter are automatic, but what in the hell would they need now? Don

tdiu This Can't Be Right Can It?
I am so angry I could spit nails. My claim for TDIU from July 2005 and their error on skull loss rating of 30% that is undebatably 50% as the size exceed the 50% criteria by almost thrice. I had also claimed EED back to Nov 1976 for unajudicated claim for skull loss back then. Anyway it was given to the rater finally on 9 July 2007, then the rater rendered a decision to her boss on 19 July, 2007. The boss then sent the claim to a more experience rater on 24 August, 2007. I was told last week that the boss then sent the claim from that rater to a senior rater for review on 24 September, 2007. Last week I was told that the senior rater still had it but there are a…

Extraction Of All 7 Back Molar Teeth
Hey all, Tomorrow afternoon I will have all of my back teeth, 7 in all, extracted because the radiologist and dentist warned that if not extracted the radiation treatments could cause infection and then severe complications while undergoing radiation treatments for the larynx cancer. They said that once infected which is a very good probability due to the radiation, they would never heal and also the jaw bone could come out with the teeth when trying to remove them. So question is. Are my molar teeth considered secondary condition to the AO larynx cancer? And are the loss of the teeth due to a service connected condition compensable? If so where in the CFR?

Writ Of Mandamus
B) Is anyone interested in a Writ of Mandamus that I wrote? If I get enough people interested, I am considering posting it even tho I do not know if it is "successful" or not because I just filed it last week. I am not a lawyer, but this is my take on the writ: It is for "extrordinary measures", not just your plain garden variety claims. I filed a writ, in part, because the VARO in Cleveland took absolutely NO action on my NOD filed in March, 2004. No Statement of Case, no nothing. Berta and All, I spoke with Arthur, at Medopinion, this morning and the $3900.00 was his quote. We talked for about 30 minutes as to the records that I had. When I mentioned the "personality not other wise specified." He said, Oh, No! He wanted to know when the two psychaitrist stated my anxiety began. I told him they did not put this in the C&P. I sent a request through the Iris system to find out the status of an appeal and receved the following response: Is this a normal response for this type of inquiry? Every time I call the 800 # I get different answers.

Was "reasonable Doubt" Specifically Addressed In Your Decision?
I have been reading through the great book that Betrayed suggested we get (The Veteran's Survival Guide: How to File and Collect on VA Claims, Second Edition (Paperback) by John D. Roche) and it states that there should be a statement that the VA looked the claim over under the doctrine of reasonable doubt. I just checked my Decision and nowhere in there is anything about Reasonable Doubt. For those of you who have a Decision (or multiple Decisions), please check them and tell me if there is a sentence in them that addresses Reasonable Doubt in any way and if so, please post the exact wording used in your Decision regarding Reasonable Doubt. Dro Info Needed
According to An IRIS response my case is with the DRO being reviewed because I elected that route. Several days later I received the election form asking me to choose between the DRO process or the traditional appeal process? I promptly selected DRO again and mailed it back via certified return receipt. They received it the next morning. I waited several days and called the 1-800 #..the woman on the line was better than most..and she said that my file is not with the DRO it is in a filing cabinet?
