ptsd Spinal Cord Injury Combined Rating 90% But Denied Iu
I have 90% rating: arachnoiditis, PTSD, migraines, and a couple 10%ers. But they denied IU. They state current functional limitations involve no prolong standing, walking, sitting or running but there is no evidence your disabilities preclude all types of empoyment. You are considered capable of gainful empoyment. Can you believe that crap? Help! Thanks, Rbhracing

Mental C&p Exam
I went in for my C&P for my mental exam and I was given a test to read and remember 10 words and I received 8/10 which I was told by my neighbor I may have did to well for the VA. I did not want the doctor to think I am some type of imbecile so I really did try. I did mention that I have almost daily panic attacks and that I had one the morning of the exam. Did I do to well?

I was told by a friend here to be Proactive about my claim, and I took it in the sense make calls see what's up request this n that. After my visit today with the VA to check on my c-file I see now what it means not just making calls but getting involved completely.Yes, having a paper pushing Rep helps but its just a small part of a wheel and other parts is getting in and out there to make sure things are not held up and why and you your self can take care of it. If you have private Dr,'s records the more you have to help make the wheel. Appeals Management Center Backlog
I can't move forward, so I am creating a backlog.If the AMC would not loose all the records, there probably would not be a back log. How can the Claims Adjustor and the Development Team check a file for completeness and when it arrives at the " Rating Specialist", papers be missing, causing you to start all over again. I sent this letter to the Inspector General's Office, and Senator Warner's. I spoke with Senator Warner's office yesterday. I am assuming they will have to remove my file from the filing cabinet to answer his question. I was remanded to the AMC April 2006. I immediately responded to the request per the remand. Question About New Evidence To Send With A Nod
Hello i am about ready to send in the letter of NOD and the form VA9. I have copies printed from the original Xrays of my son's back after surgery that shows the placement of the plates and screws in his back that prevent him bending or twisting. Will the VA accept these as evidence?? Also i have a picture of his back right after the surgery [ 2-3 days] that shows the 20inch incision with they accept this as evidence?? or should i just forget about sending these?? Thanks Jessie

When the CAVC called some former judges out od retirement it did make a dent in the CAVC backlog- this bill (From Senator Akaka) could help some more. http://www.vawatchdog.org/07/nf07/nfOCT07/nf102407-3.htm It is very difficult to have the CAVC reverse a prior BVA decision but it has been done. If a vet has to file a NOA (Notice of Appeal)at the CAVC they must keep in mind the time limits for that, and then follow the courts criteria that is available at the CAVC web page exactly to the letter unless they get an attorney right away who will do that. Quality Assurance Of Claims
The big problem I see from reading everyone's stories and my own is that there is no QA at the Rating Officer level or anywhere in the claims process. The GAO does not inspect any of the R O work and all I can find is a program called STAR unit which is based out of Nashville, TN and has a total of 15 people assigned to monitor the 57 regional offices. The annual requirement is to sample 120 claims from each office which equal only 6,840 case files being checked for the entire nation. C&p Examinations
Based upon all of the complaints and my own personal experiences I feel the VA is simply wasting millons upon millions per year on unnecessary examinations. I feel that the only time a C&P examination is needed is in the case of original service connection determinations. When a veteran wishes to file for an increase in his/her rating level the only requirement should be medical evidence by a qualified MD along with his request. When a veteran is being followed by a medical expert for a medical condition and his doctor states that the condition has worsened based upon xyz (his opinion or test results) why in the hell should the VA pay a non-expert (NP or …

Hey, did I miss something? I thought we used to have a Social Chat Forum. I was going to post the below thread to it since it really is more of general interest than claims research specific but I can't find the Social Chat Forum. Alternate Source For Va Regs
Greetings all: Earlier this year I was looking for a copy of the Clinicians Guide for C&P physicals that was in effect during 1988. Update, In 1988 it was called the "Physician's Guide for Disability Examinations" printed in 1985 superseding the September 15, 1976 edition and supplement 1, dated March 29th 1983. I have also discovered/rediscovered in this on and off again search a closer location to view government regulations and guides. It seems the local state university has a government documents section. For some this might be a shorter trip than the SO's/VARO's offices. Best regards, Tyler
