ptsd Prepare For Video Bva Hearing
I need information on how to best prepare for a video hearing at our VARO. Also any information on what to expect, chances of success, so forth would be helpful. I will be making a statement for a young OIF veteran. He was granted 30% for PTSD on the first claim, however, he has had considerable difficulty since then. A suicide attempt, alcohol treatment, and a job termination have all occurred since the initial rating. Will the Board consider this new evidence? Or...will they remand back to the VARO for reconsideration?

ptsd Imo Ie (ptsd,depression)
When actively seeking an IMO for use with unemployability issues, I found that using a psychologist or psychiatrist that works for the court system benefit greatly. Most of them are well known and have done hundreds of court cases usually involving legal unemployability and competency. I think many of them do this for people who are to stand trial, so they have to be thorough, and many of them are on the federal level. This could turn the tables or put your claim over the top in your favor. The only problem is affording one. I think that they usually charge a bit for their services but, it might be worth it. just a thought. I am currently using one for my claim and so…

Is It To Late To File For Reconsideration
Hello Everyone. My son filed a claim in Feb 2006 for DDD/ Lumbar Spine condition and received a rating of 10% and at the time he still had 2 issues on deferrment. His rating decision on the back was dated November 27th 2006. I wanted to file a reconsideration on the rate at that time because they didn't even consideration the fact that he had a multi level fusion in his low back and they didn't do a ROM at the C&P. But i took his SO advice to let these other issues that were on deferrment get settled first and then ask for a reconsideration of the rate on his back with new evidence. I totally lost tract of time!!! And got wrapped up in the Reconsideration Clai…

Needless Overpayments From Va
a good read from Larry Scott: http://www.vawatchdog.org/07/nf07/nfOCT07/nf101407-1.htm If a vet can prove they did not deliberately accept an overpayment that they knew was erroneous they MUST fight the letter from VA immediately by filing a NOD- once a vet takes the steps to fight a proposed bill from VA for overpayment that usually stops the VA from taking the money out of their comp etc- they MUST act swiftly and get a good POA to help them- immediately.

Definition: Moderately Severe Versus Markedly Severe
Got my latest rating a few months ago with a combined 90% rating (50% right hip replacement; 50% left hip replacement; and 20% right ankle fusion). The question that I have been wrestling with is whether or not to file a NOD on the Hip Replacement ratings (Diag Code 5054) and request an increase to the next higher increment (70% for each hip). The 50 rating is for Moderately Severe limitation of motion and pain and the 70 rating is for Markedly Severe limitation of motion and pain. I can find no where in any of the VA regs where Moderately severe or Markedly severe are defined or compared and would like to know if anyone is aware whether this is an arbitrary decision o…

ptsd Received Rating Decision
My husband is a Vietnam Vet with 3 purple hearts & 2 bronze stars, 1 with valor. I haven't posted very much, but I have been reading here for 2 1/2 years. I have learned so much from all of you to help my husband put together the paperwork for his claim. He also has help from a veteran's advocate who is working through a service representative for the VVA. First for the good news, he just received his rating decision and has been increased to 70% for PTSD and received 10% for tinnitus which adds up to 70% according to VA Math. I have questions on the effective date the VA has used for the PTSD increase and for the denial of service connection for wounds he receiv…

Ssoc
I have recieved and answered 3 SSOC's to my ongoing claim that has been awaiting a travel board hearing since sept.2003.On friday I recived another SSOC and I'm wondering if this is just another delaying tactic since they all are repeats of the first one.Is there a requirement to answer the SSOC or is it even wise to just ignore it and wait. What are the regs regarding this?

Sleep Apnia
I have submitted a claim for sleep apnea. I had the following service connected disabilities when I was discharged hypertensive vascular disease and bilateral plantarfacitis. While on active duty I strated having problems with my uvala swelling causing an airway obstuction. I had an episode of this swelling within the year of my discharge and had an emergency consult with the VA which fell 6 months of my 1 year of discharge. At the ENT apointment they said I had obstructive sleep apnia and scheduled me for an UP3 which consisted of having my uvala, tonsils, adnoids and soft pallet reduced. This cleared my problems for about 2 years. I had a sleep study conducted at the VA…

diabetes Claim Denied For Private Medical Bills
The spouse of a (100% P&T since 1992) s/c veteran received the denial letter for the claim I filed for the VA to pay for Private ER and 4 day hospital ICU stay. He was carried from the Nursing Home to a small local ER with uncontrolled seizures either from his Liver s/c or Diabetes s/c conditions in critical condition. The local ER could not stabilize him and called the VAMC where he was enrolled....they said "DO NOT BRING HIM HERE, WE HAVE NO ROOM", all this is documented in his medical records. The VAMC paid for this ER visit, but the only choice left at that point in time was to send him by ambulance to a larger Hospital where he was admitted again in "critical con…
