I Need Opinions!
Hello, I'm new here so please forgive me if I'm posting this in the wrong place. I am trying to find out if I can be rated "permanent and totally disabled" in order to qualify for County property tax exemptions. I currently receive 100% compensation from the VA for a 1151 claim and an added amount for being homebound. I'm also receiving SS disability. Before the 1151 claim, I was 30% service-connected for an unrelated illness. I've been told that the 1151 isn't considered service-connected, so I can't be rated P&T, as required for the exemption. Lessons Learned Initial Disability Claim Exit Physical
My first claim to the VA had several disability issues listed but not well defined or supported. I didn't specify very well what I wanted in medical terms or " I have this problem that occured during miltary service..... For example, I simply listed "fractured fingers" or "lower back, lumbar problems". IN hindsight, I should clearly stated a very complete request for claimed issue. I should have been proactive in supporting my claimed conditions that I needed service connection (SC) for. Help! Need Answer Fast
Help!! Son just got off the phone with the folks on the 1-800 line. They are telling him that because he summited new material with his letter of reconsideration it is now a re-opened claim. When we sent the Letter of Reconsideration on the rating decision i sent copies of material that was already in the file and highlighted the areas i wanted them to pay attention too along with a article of the Blood Journal that gives the guidelines for the treatment of his diease to get them to understand that when his Blood HCT levels are above 45 he is to have a phlebotomy. Raising All Issues For Entitlement

They are never locked into just one reason-if they have any way to support additional avenues of entitlement-they should make claim as to each reason. If Your Poa Revokes
This might help someone out there. If you have a claim that has been Certified to the BVA, your POA cannot revoke Power of Attorney with you unless they fully comply with 38 CFR 20.608. Meaning they must file a Motion at the BVA, with a copy to you, stating why they are taking this action. The BVA can grant or deny the Motion. Why this is important to know is that- if you are at the BVA or you are on a remand that could also mean your claim is again sent back to the BVA_ whether the BVA grants your claim ot not-if your POA as revoked POA with you after the appeal had been certified (in my case that was in Jan 2006) the POA Rule 608 issue has to be resolved fir…

Va Meds Caue Severe Gi Problems
I went to my Family Doc yesterday outside of the VA. ( Could not get in to the VA) with severe GI problems. He asked me to give him a med list and he examined me. He got really upset. A lot of my meds are taken together have no business of being taken together. He ordered blood work and gave me some powerful gi meds. Can a person file an 1151 claim for this. I may have ruined my stomach lining. J

Opinions Needed From
As you know my POA revoked my POA with NYSDVA on OCt 2nd, right after receiving my response to the first legal VCAA letter I ever received from the VARO. Following the instructions from General Counsel-I prepared a seventeen page complaint against 3 NYSDVA reps and the Director of NYSDVA and have counsiderable documentation to copy yet and attach as Exhibits and evidence. I read something odd- 38 CFR 20,608 controls withdrawal of services by a veterans organization.I dont think they did that right. My Va Experience
I have had back problems for many years.(non service)and had back surgery a few years ago(non Va. hospital.) I started using Va. medical treatment 21/2 years ago with my bad back being the main subject. Over a two year period I finally got to the MRI stage and was seen by a neurologist . He told me there was nothing he could do. I asked my primary doc. for a second opinion and was told I could'nt get one at the Va. and I was sent to pain management. I went to an outside neurologist and was in surgery within three weeks. That was just two months ago and now the pain is gone other than the soreness from surgery. Opinions Needed To
The VA just told me all of my main issues -AO death, and 2 SMC CUEs went to the DRO this AM. I thought this was odd. I sent in a DRO election form on the 2 CUE claims on Sept 17th,2007 reminding VA that the reconsideration request I had filed a year ago was still in process and the NOD had been filed in June.
