Sleep Apnea Nexus Question
Here's my story: Began having symptoms of sleep apnea towards the end of my time on AD. My wife began to complain about snoring, etc. About 1 month before I separated I went to my military primay care physician about this. We talked about it--he said that he was certain I was experiencing obstructive sleep apnea and that I needed to have a study done. He tried to get me an appoint but the soonest was about three months after I was already going to be separated. So that was that. A Question About Sleep Apnea.....?
Let me run this by y'all, and you tell me if I'm barking up the wrong tree. Service Connected badly screwed-up left ankle. It's bad enough that I have a great amount of pain while attempting to walk. The VAMC has me in a orthosis (brace). I just found out today that I suffer from Sleep Apnea. The main reason that I suffer from this Sleep Apnea is that I am overweight. I'm overweight due to the fact that I can barely stand, because of the pain in the leg/ankle, to walk or to bear weight on my left leg. So I don't get any exercise, thereby leading to my overweight situation. Doc says that my Sleep Apnea is connected to my weight which is connected to my SC'd left leg…

diabetes Question For Alex
I have been working for the spouse of a 100% P&T (for 15 years) veteran who died on Memorial Day 07. Everything has been filed, but the Death Certificate wasn't really plain on cause of death, it said number 1 cause was Uncontrolled Seizures and one secondary cause was Diabetes mellitus for which he was S/C. I got the letter below from the attending Physician and today submitted it as additional evidence for a service-related death claim for burial benefits. Do you think this should nail the claim?? I think we all know that if a vet goes to the CAVC, the court's decision is solely based on the record at hand. The chance to obtain buddy statements and IMOs is long gone- There is no way , after the NOA is filed with the court ,to expand the record with evidence. EXcept for one thing- The Court can be requested to take "judicial notice of fact". The fact" must be one of "universal notoriety" which needs not to be proven. (Page 1148 VBM NVLSP 2006) What this means is- I use treatise and medical printouts for claims -but only as icing on the cake. They are only in support of what the medical evidence reveals. Claim Status What Do You Think
Morning all, Called the 1 800 yesterday and told my claim was back at Rating Board and had been there since 7/3. But for the last two weeks when calling it has been at the Post Detrmination team since 7/9. Any ideas why it would be back at the Rating board, with a date of 7/3 the claim originaly went to the board on 5/29? There is 13 items on the claim, 3 that was inferred from my C&P. 10 items were already SC Thanks Boats

C & P Exam
Hello all. I recently completed 3 different C and P exams. 2 with a physician assistant and one with a psychiatrist. The mental health exam went well. The doctor wrote down everything and nothing was fabricated. However, the physician assistant fabricated a good portion of his report including things that I did not say and including false measurements for my shoulders. He did not use a gnoimeter and his visual acuity leaves something to be desired. I am certain that I will be successful with my NOD because I have documentation from the orthopedic doctor I visited earlier this month to refute my claim. Some Advise To All
I wasted hours of my time this weekend and also today in a situation involving-not the FERS neighbor I mentioned- but helping another VA claimant- hours -----only to find out the truth of the whole shibang- this happens every once in a while to many of us-- sorry I am griping about it- I know better ---when you start asking the questions that matter regarding a claim- especially those that involve the basic pre-determinations of entitlement and you dont get any answers and the claimant suddenly changes the 'topic' time to start wondering about the claim itself- I wasted precious hours only to discover this claimant has NO basis whatsoever and that VA did al…

Any Fers Experts
My neighbor- 20 yrs retiree recently filed a VA claim- he would need a higher rating to make it worthwhile due to his military pension-not eligible for CRSC maybe CRDP but his claim needs a lot of work- In the late 1990s he worked PT for the local VAMC. He quit and then asked me how he could get his FERS money back- long story but I had to handle this for him and the VA personnel dept told me that if he withdrew all FERS contributions and did not go into TSP (the savings plan) he would not be able to re-join FERS if he ever worked for the fed gov again. Ha said he didnt care and would never go back to the VA or fed employment and he got his money from FERS. …

"same Old Stuff"
I am still waiting for thier conformation for receiving the new claims/worsening of conditions. Called the local Seattle RO today and they said the cirrhosis claim is at the raters, they cant find the claim for Merniers syndrome. I have heard they are 400,000 claims behind? I think Im gonna get Thumped on the Cirrhosis claim, Ill NOD the hell out of that one. But thier own Doctor rated me as having Merniers, their own specialist,thier own MRI report... And thats the one that I think they Lost?? Go figure it, SNAFU The Va is screwy in thier own favor. If this keeps up Im gonna need more drugs from shrink. ptsd Update On Class Action Vets Suit Against
http://www.armytimes.com/news/2007/07/ap_v...lawsuit_070723/ The suit was filing Monday covering delays in comp awards, health care problems, and also the fact that the gov is using the PD diagnosis as way out of paying PTSD comp. Filed by Iraq vets, this class action could potentially cover and affect thousand and thousands of veterans. This was the suit that Art Bernklau spoke of last night on Firebase network.

Symptomatology Is Required, Not Continuity Of Treatment
Is this stating that he was considered service connected? It is noted that there is no continuity of psychiatric symptomatology shown by medical records, including the service medical records at discharge from service. However, continuity of symptomatology is required, not continuity of treatment, and the veteran had indicated to a clinician that he had been suffering from anxiety for 20 years. See Wilson v. Derwinski, 2 Vet.App. 16 (1991).
