Question On A Request For Bva Reconsideration
BVA has stated in a decision to me,that there are some issues in my Appeal that are not under BVA's jurisdiction. My contentions are that the evidence of record clearly shows this is not true. BVA does not show all of the actions taken on these particular issues. These issues were claimed with my VARO - denied - NOD filed - DRO hearing - DRO denial etc... they were also discussed and in the transcripts of my BVA travel board hearing. If I file a request for BVA Reconsideration in regards to their jurisdiction will it just be a waste of time and effort ? Does anyone have a BVA case dealing with jurisdiction issues? Donnies post under 38 USc 5110 and others here might see what I mean in my reply to him within this recent BVA case: http://www.va.gov/vetapp07/files1/0702913.txt Next to the VCAA the Nehmer decision was the most important decision I have ever seen -after 25 years dealing with the VA- I have spent considerable time studying the legalize of this case and have discussed Nehmer with the lawyers who won it at NVLSP in Washington DC. I found this AM that there were 3 BVA decisions re Nehmer retro that I feel were definitely wrong in their interpretation of Nehmer - in 2007-that surprised me-I will re-read them -maybe I missed something I hope the vets appealed…

hypertension Iris Response And 100% P@t
At 2am, I sent a request asking the VA how to proceed with notes from a VA pulmonary Specialist. I got the notes yeaterday. For 3 years I have claimed Phrenic Nerve Paralysis secondary to cervical spine along with pulmonary Hypertension, Sleep Apnea. Well Just last week, A Pulmonary Specialist looked at the latest MRI and stated in the notes that the diaphragm paralysis is likely secondary to moderate to severe narrowing of the cervical spine c3 to c5. I sent this to the VA this morning with a 21-4138 stating that I have several issues on appeal. Pulmonary Hypertension associated with restrictive lung disease warrants a 100 percent rating. Records
Someone served on the USS Roosevelt,during first Gulf War. Question! How do you,or where do you get a copy of there medical treatment recieved while in Gulf aboard Roosevelt. Tried St.Louis,but they have 0 records,except DD214-Medals. No records found of treatment during 4 years service. Period. Even called,whitout getting info I requested. Where are these records stored? Any Address????

tdiu Is Total And Permanent Needed For Individual Unemployability?
Is it necessary to have a “total and permanent” assessment verified to get Individual Unemployment? The reason I ask is that I have a form from my POA for my doctor to complete. It has the rating schedule for mental disorders at 70% (where my symptoms fall out) and 100% (where, thankfully, they don’t). However, because of my symptoms, I am not able to hold down a job so we are going to go for 100% IU. I haven’t worked for the last several years other than a brief job that I got fired from due to my sc mental disability causing attendance and concentration problems. What's Up With This Iris Reply?
Hello: Just got this reply from IRIS this evening. My son was serviced connected at 0% for Polycythemia Vera [ a Bone Marrow disease] and we sent a Letter for reconsideration in the rate which they recieved on May 9th. For this disease and recieving Phlebotomies he should be rated at 40%. I have since sent 2 recent Phlebotomy records. Last week my sons SO said that someone in the St. Louis RO had his file working on it and he expected a decision fairly soon. Today the IRIS reply said that his claim had been sent for a possible Exam and he would be contacted by the closest VA if an Exam is needed.and gave the 1-800 number. What more could they need?
