Releasing Medical Records
I am signing release forms to release my husband's medical records to the VA. Does anyone know if I should attach the letter that shows I am executor of his Estate to the forms. Or will the hospital release them on the signature of the next of kin? Free

Glad your back Vike. There are only a few on the board that are experts and you are one. If you get a minute will you take a look at some of my questions regarding the older vet I have tried to help that was granted 80/hearing & 10/tinnitus. Question On Compensation And Employment.
Hi All, Is there a cap on the amount of service connected compensation you can legally receive if you are employed by a civilian employer. I am not talking 100% but 50-90%. Basically, I am still holding on to my job and I am pending a rating pf 80% combined for my various SC issues. Also, what happens if I get fired, "laid-off" due to my SC disabilities. I know that it is only a matter of time before I am discharged. My employer is not making adjustment for my disabilities. It is getting harder and harder to deal with my physical and mental health issues. Thanks. Joe

Hello, I am an activated reservist. I injured my back while in the Line of Duty for OIF in 10/04. I was sent back home to receive care. To make a long story short I had to back surgeries first was an L5-S1 bone fusion with no success. That only made the problem worse. The next surgery was an L4-S1 fusion with instrumentation and and hardware. I have had no relief after that surgery either approximately a year later. I finally got my AF PEB results yesterday. They offered me 50% medical retirement. I concurred. My question is what is the next step for me. I don't have a retirement date yet. I am still at my home of record too on convalescent. Any help and or guidance would…

After about 16 months I received a reply from BVA last week, Yes, N&M received to re-open one issue - all other issues remanded back to VARO. Oh well nothing new. carlie

Moving Along
Well, I have received my copy of the new court brief that my attorney filed with the court. The secretary has 60 days to respond. (19 years and counting). The BVA and the RO and a couple of VA examiners all got ripped again. We hope to know something from the court by Christmas. Then we start over at the BVA, back to the RO, more C&P examinations, back to the RO, appeal to the RO, back to the BVA, appeal to the BVA, file with the court again, give the VA another 60 days to answer our new brief, file a counter brief, wait for the VA to let the time run out, wait for the court again, etc. At least this time my lawyer gets paid for his work. sledge

Soft Tissues Sarcomas And Ao
Forgive me me if this posts reflects my frustration- I just got email asking me to tell all vet orgs etc this big news-a dead Nam vet with brain tumor got SC due to AO. It isnt big news- I have failed to make this point I guess to this former member- The VA service connects all soft tissue sarcomas in Vietnam vets (in country) as also the Korean vets on the DMZ unit list- It doesnt matter where the cancer is- as long as it is a STS -soft tissue sarcoma it is presumptive. Guidance On Claim Increase
Here is my situation: Medically Discharged in 1995 with a VA rating of 50% (20% Right knee PCL deficient, 10% Left knee instability and 20% degenerative disc disease L5 S1 in lower back). I complained about my lower back over the years to my VA primary and was given an MRI by the VA in 2004. It showed a herniated disc L4 L5 and a bulged disc L5 S1. This was the first MRI for my back and showed more issues than the X-ray done on my original VA exam in '95 At the end of 2005 my back worsened and in early 2006 I began VA physical therapy. I Am Suprised By The Iris Email Answer To My Question!
Ok, It’s me posting again. Sorry for all of the posts, but I would like the expert advice of the Hadit members. On my initial claim I was awarded 10% left foot hammertoes / bunions 10% right foot (same issues) 10% severed wrist ligament 0% flatfeet and fasciitis, denied lower back spasm’s due to feet, denied depression. Well I NOD the VARO initial decision and then got the SOC and my 0% feet increased to 30%. They did not even mention my depression or lower back!!???? Cues And Widows
I have read quite a few CUE claims filed by widows - where they are alledging an earlier denial was based on a CUE. Usually they are seeking to have the veteran declated totally disabled at an earlier date. The BVA dismisses the cases based on Haines vs. West - that a veteran's claim does not survive his / her death. But in the case of a widow filing a CUE claim that was NOT filed by the veteran -they BVA claims that the widow can not file the CUE because she was not a "party" to the orginal denial. Growing Medical Bills
Hi I'm new here trying to figure out how things work so please try to bear with me . I'm a 56 year old male Army Vietnam vet with stage 4 lung cancer. I've applied for and been granted ssdi but will not receive anything until September. My VA claim is pending and that looks several months away at a minimum the bills for Chemo and Radiation add up fast and while I have health insurance there is alot unpaid does anyone know if there will be any payment of these treatments from the VA once I'm rated???
