Asthma 40 Years Late
I was just awarded 30% for Asthma (COPD) in the decision it states “Service Medical Records from September 1, 1964 through September 6, 1968, note multiple treatment entries for recurrent respiratory infections with scattered inspiratory wheezes of the lungs noted on discharge examination dated September 3, 1968.I had a C&P this time that showed I should be rated at 30% for Asthma I filed a claim in 9/18/1969 for a chest condition and it was denied reason stated ”not shown on last examination”. No C&P exam was ordered for this decision. I never appealed this decision as I felt if it was not shown on my exit exam I could not win I have had problems from the…

tdiu Tdiu?
I was reading on another site that a person can work and collect TDIU as long as they do not work twelve months in a year. I know the basis behind TDIU is that people recieving it are unable to work. Withdrawal Of Claim & Reinstatement Of Same Claim
Greetings to all, I am helping yet another vet. This is his situation. He filed for AA in August 2006 and increase for bi-lateral shoulder condition at the same time. This veteran in Jan of 07 withdrew these claims when he found out vets could have attorneys. It did not understand this issue correctly and withdrew them. He has leters from his doctors stating he qualified for AA. He is currently rated at 100% T&P not IU. He went to 2 C&P exams for his shoulderrs to 2 neurolgists. fwd AO and Benzene Questions and Request for Help Below is a request for help associated to Myelofibrosis and exposures to Benzene mixed with AO or anyone that mixed AO with diesel, kerosene, and gasoline to spray. Actually, Fort Detrick, MD sent out an emergency directive in mid 1969 to MACV on how to decontaminate the used AO barrels in 1969. The reason was that used AO drums were being used to transport PLO also and when mixed with gas AO readily burned. The result was an internal combustion engine Agent Orange Aerosol Dispenser. ptsd Is Making Too Much Money A Pentalty?
While awaiting my claim on an increase in PTSD, MI and Nueropathy I had a triple bypass (the 24th of May). I have a C&P June 13th. I'm a federal employee and a retired E-7. Total I have 40 years of federal service. I am currently 60% disabled. My service officer at VFW thinks when the smokes clears I will be 100%. Will my military retirement, social security, and federal retirement be penalized if I receive 100% disability? I am not applying for TDUI or Disability Retirement from Federal Service. I have tried to lead an honest life and paid my way. All I want is what is due and what I feel that I have earned. Although I don't want to be penalized f…

So Just Told Me Today That Pva, Dav, Etc
My SO just told me today they just got memo's saying that they are to check Soldiers SMRS 45 days before getting out of the military and decide if there is any thing that they can be service connected for. He also said at this rate that my claims probley would not even be looked at for 3 o 4 years. Has anybody heard anything like this. And he was very serious. He also said that this memo went out to all the service orgs. Kris

New And Looking For Information
Hey I'm new here and would like some information. I've filed for service connected disability and am having an audiogram at the va in Waco tomorrow. I served on a Battleship(USS Wisconsin) and was outside when they fired the 16 inch guns on turret 2. They didn't sound salvo alarm and I didn't have hearing protection on. I was a firecontrolman on the 5 inch radar 1 just above the turret. I don't have proof of this but it happened on sea trials at Guatanomo Bay. I do have my old records that show that I had hearing loss during my six years of service(86-92). On my final physical and in one more physical in my record it says I suffer from hearing loss and the audiograms show…

Wrongful Death Claim Vs. Va And Dic Recoupment
We are awaiting a settlement offer from VA Counsel on administrative FTCA claim for wrongful death due to medical negligence. Claim is brought on behalf of Estate of decedent by Administrator who is his widow. Decedent has children who likely be allocated some portion of settlement. Widow receives a monthly DIC benefit, I understand that this amount she recieves is subject to recoupment. but my question is whether the sum to be recouped is the amount only allocated to her or the total amount of the settlement/judgment. My guess is that she is only subject to recoupment for the portion allocated to her? Am I right? Also, is there any reduction in recoupment for a…
