Remand
I called the RO in Montgomery on 5/18/07 on status of claim, was informed that my appeal for an increase for my right knee and hip currently rated at 20 and 10 percent was remanded on March 20, 2007 and denied and closed on March 20, 2007 and my reopen claim for sleep apnea was in for final review. I am currently rated at 80% for left knee fusion(40), back(40), right knee(20), left foot(10), Scar(10), hip(10). I am currently taking oxycodone 4 times a day, and methadone 3 times a day for pain for the last 3 years. The VA doctors are telling me that I need a knee replacement (right knee) but I am to young for the surgery, I am 49 years old. How can they deny the remand on…

diabetes Just Got 21- 8940 Blank...have Questions Though
Hope All had a nice Armed Forces Day- a SS Admin Law Judge found "fully" for me in Feb '06 retro to Jan '03. Stated unemployable and awarded Disability Insurande Benefits. Am 62 yrs and at 20% for Type II Diabetes. Re-opened in Dec of 05 for PTSD, Tininitis, hearing loss due to combat duty plus diabetic hearing loss. My med records upon enlistment said my feet were abnormal and noted Pes Planum, but it took me a year to get my records, so I wasn't able to claim for flat feet when I re-filed in '05. I'm new to this forum and most of the VA's "jargon" (I'm being nice here!). I want to send in the completed 21-8940, but I do not yet savy IU, TDIU, P&T vs 100% or …

Ricky, I can't find your post. I was hoping you would post more detailed information as to what the decision and medical reports actually said. My point about raters was to show that you need to understand that they have specific training and that your doctors reports need to align with their type of training. You could have a valid claim that was wriiten by the doctor in a manner that did not meet the criteria of their training. Thus, all you need to do is get the doctor to change some wording or clarify how a diagnosis was made. I do not expect that the raters would tell you how to advance your claim and advise you to have the doctor address a specif test or…

When Does Dfas And Va
update there computers? I just checked my RAS on MyPay and it is still showing my old disablity rating of 50%. I was granted a increase to 60% on April 27th and being backed dated to June 2006.I thought they updated every Friday night at the end of the work week.No big thing just would like to know.Another question is a SMC inclued in the increase or is it seperate from my increase? ptsd Light At The End Of The Tunnel.
hello everyone,just a few lines to let ya know whats going on, and some feed back from the pros. C&P's all done, C file back at the ratings board. i got an envelope from the V.A. a few days ago with a form to fill ( i think it was a VACC form) it simply asked if i would submit any more evidence for unemployability, they would hold off for 60 days before making a decision, if not, i could waive the 60 days without anymore evidence and elect to have my claim decided upon. i signed the part to go ahead and decide my claim. Sleep Apnea W/ Cpap On Active Duty Usn
I am active USN, was diagnosed with Obstructive Sleep Apnea last September and issued a CPAP machine. Have to say the machine is the best thing that has happened to me and use it every night. Without it have headaches everyday like a hangover. I have done the research and read the forums so know I would rate 50% for the OSA. Doc even mentioned it to me so the VA would provide CPAP for life. Did not really think much more of that until research concurrent receipt and such. I retire in 3 years, but is there anything that I should be doing now or prior to getting out to make sure that I can reduce the number of snags encountered? Weighing Of Medical Evidence
I asked this question on another site and when I headed off all of the standard pro VA zombies and demanded straight forward answers I got beat up for being anti-VA it kinda just went to the wayside so I will try it here for I know I will get some well rounded responses: In weighing medical evidence what gives a VA non-medically trained rater, in other words a LAY PERSON, the right to take a one time 15 min C&P exam for an in-depth medical issue, lets say a neurological condition, and use it to over ride the treatment records and opinions of a neurologist who has treated a veteran for 3 years and deny a claim?
