Set Back.. Of Sorts
Well it has been two years and I have finally hit the proverbial snag. I have been very fortunate to date and only relate this as a status update to those who have followed. I signed the paperwork today to withdraw my appeal for Raynauds Syndrome. Bottom line is while it is believed I have the condition there is no diagnosis in my record. As I am 100% P&T there is little to be gained. I will work on getting a diagnosis and then submit a new claim based on the "new" diagnosis and take it from there. At worst I will claim it as a secondary to an existing condition and see what sticks to the wall:) Oh am a bit currious how I have a scheduled examination but am…

Many years ago- by way if just developing a SC scenario here- I used as example a Gulf War vet who had been bitten by sand fleas and I made up a way this could lead to disabilties- just to have an example of how secondary disabilites can be proven- It was just an example-I had no idea then that sand fleas could really cause so many medical problems.Even death. http://www.cdc.gov/ncidod/dpd/parasites/le...nia/default.htm

ptsd Problems At C & P
Went to my PTSD C & P the other day and was surprised that the doctor only had some of my records. He did not have photo evidence I submitted of stressors and there were no VA medical records. During the interview which took 45 minutes we went over quite a bit. He seemed somewhat pushy to me but then again, I have never been to this type of a medical exam before. He did ask me if I wanted the benefits turned over to my wife. Without thinking I said yes. But in reality the money goes into the same account. Has anyone ever had this happen before? There was a lengthy questionaire he went over and I had sent about 500 pages of medical records to the VA. I contacted VA …

Finally Broke Down And Got A Rep
I finally decided to go ahead and get a service officer. I signed my POA last week and mailed it to him. This morning I emailed him and asked him if he had received it. He told me he had and that he had turned it in and requested to see my file. I told him that was fine as long as it did not slow down the process and that I had C&Ps done in March here is his reply. "It will not slow down adjudicating your claim. The process on 99% of the claims is 11-14 months from the date that it was established. The C&P is electronically requested, printed out and added to your file folder. It then goes back to the file cabinet until the adjudicator starts working the mon…

What Specifically Is A Service Record
Where the rules say that any service records that are not in the claim file are later discovered / submitted -- they will be considered to have been IN the claim file at the date of the decision. So I am basically getting that if the VA was supposed to get records from the military and did not get them - if they get them later -- and you are filing a CUE, or accrued benefits claim -- where it is important to establish that those records WERE in the claim file previously -- the decision must be made AS IF they WERE in the claim file on that date, even if they were not. Aid & Attendance
OK Here's how it goes. I'm 100% P & T for Epilepsy & put in for Aid & Attendance which got turned down at the RO ( Love them RO's.. lol) So I sent it to the BVA & I have my Shrink,Primary Care & Neurologist saying I need Aid & Attendance. Vcaa Election/response Form
Yesterday I was in K Mart-and a vet from the VA Dom came up to me and asked what the heck I mean here by the VCAA election Notice. Here it is. I never got one in over 4 years. I believe it is this Notice that triggers the VA to actually read your claim and consider your evidence. The VCAA letter that comes with it is supposed to state exactly what you need to send them. They are not supposed to deny your claim until you get the VCAA letter and this notice-where you have elected Box 1 or Box 2 , then signed and returned it to the VA. ptsd Suggestions On How To Proceed
Okay, the real world facts are I was injured in a jump accident in '85 and messed up my lower spine. Surgery, rehab, the works. No SC question about all this. The upshot was chronic pain that has gotten worse over the last 20 years resulting in my being unable to get out of a recliner long enough to hold a regular job. Another real world fact is that the VA doesn't consider pain to be a problem for back injuries when it comes to rating for compensation. As a result I'm stuck at 20% compensation with no job and no prospects.
