Cfr (return The Report)
It says in the CFR to "return the report" if a report is not specific enough to use for rating purpose. Who are they suppose to return the report to? Is it only C&P reports? Is it the VA only or does this include the vets IMOs? Has anyone ever been aware of a report being returned while in thier claim process? Berta, you said in your posts that you were told the IMO were not good and of no value. If so, shouldn't they have returned them to you? Also, if an IMO is not used in an evaluation of disability, (DR. BASHs IMO?) shouldn't the verteran have gotton it back from the rater? ptsd Mood Disorder Nos (icd-9-cm 296.90 (296.90)
I am service connected at 60% (30% for PTSD, 20% Hemorrhoids, 10% Intervertebral Disc Syndrome, 10% Tendon Inflammation, 10% Tendon Inflammation, 10 % Irritable Colon, 0% Limited Motion of Ankle, 0% Residuals of Foot Injury). I’ve finely got around to reviewing my VA records and I keep seeing Mood Disorder NOS (ICD-9-cm 296.90 (296.90) listed on my problem list. What exactly is this, and can I file a claim for it? I have also seen notes that I have scored positive for depression screening. Is this related?

Chief Compliant: Intense Ankle Pain and Immobility History of Present Illness: The patient presents today with left ankle pain in relation to a broken ankle when he jumped off the porch when he was 14 years old. He also subsequently had an injury within the service. He brings his service records in with him as well as notes from the doctors during the service. had C&P for peripheral neuropathy a few weeks ago and the doctor asked my wife to go in with me while she was in there she asked the doctor who had already done C&P for chronic fatigue for me a few years back if he thought that the chronic fatigue and neuropathy were caused by my active service and he thought for a minute and said yes so she asked him if he would write that on the C&P he was doing for neuropathy he said yes he would as it was not against the law well I never really believed that he would thought he was just pacifying my wife well much to my surprise he wrote that it was over a 50% probability that the chronic fatigue started from my service h…

tinnitus Questions On Back Strain (5295) & Tinnitus
I have recently went to DAV help putting in for an increase on my disabilities (Meniere's and Migraines). The DAV personnel saw that I was really depressed and told me that I need to check the possibility of having depression add to my claim as Secondary do to all my disabilities. I went to my primary VA doctor and she agreed and put me on the drug Lamictal and made an appointment with Mental Health. The DAV then filled out my paperwork for an increase in all disabilities with Secondary Depression do to these disabilities. My Questions are..... Am I going to have a C&P for all of my disabilities? Opinions Please
As you all know the VA claimed in documentation Dec 2006, that they never received my 2 IMos of Nov 2004 and also the Aug 2006 IMO. I filed FTCA for 4500.00 bucks and will be able to constructively file suit in fed court anyday now-I cannot determine how VA figures out the 6 month filing criteria- which is up today-or within he next few dyas depending on what VA defines as "six months". However-as you all know my POA claimed there had been a "lengthy" discussion with the DRO in 2005 over the IMOs of Nov 2004 with my POA rep at the VARO. I found this on a Veterans Lawyer site. In far fewer cases (about 20 percent), the BVA issues a decision that grants some benefit. Even a “grant” of benefits by the BVA must be closely reviewed by the claimant and the claimant’s attorney or other representative to ensure that the “grant” includes all of the benefits the claimant is seeking. The “20-percent” figure for decisions to grant benefits cannot be taken at face value. This is because the number and frequency of a grant of benefits by the BVA is a statistic that the BVA manipulates, so the actual rate of favorable decision is much less than this. Questions
I am new here. I was injured on while activated as an AF reservist. I have had two back surgeries. The fisrt was a bone fusion of L5-S1 with no success. The next was L4-S1 with hardware and instrumentation. I was sent through the MEB process by the Air Force got the results of the PEB yesterday 50% medical retirement. I was concurred but my PEBLO has left me more cofused than anything now. My questions are where do I stand now. Especially since I have been at my home or record on convalescent leave approx 200 miles from the nearest AF installation throughout this whole process. Any help would be appreciated as I am throughly confused now. Thank you.

As Always You All Amaze Me
Again and again in the time I have been using Hadit I am amazed at the depth and breadth of knowlege available from you folks. Again, and again I learn daily how to better help develop and "perfect" claims from you alls examples. The fact that their is a resource like Hadit, and the people available who are so knowlegable... amazes me. Question On Benifits
All, Can I go to the VA Hospital to get prescriptions for my non-service connected conditions? I am currently getting MEDs for these conditions through my civilian Dr & pharmacy. I am assuming it would be cheaper this way.... Sorry, if this is the wrong thread. Joe
