tinnitus No C & P Ever Ordered
I have been helping a Korean vet out with his claim. I should say I helped him get everything together and send it in. He filed for tinnitus and hearing loss in July of last year. He has received 2 of the standard "we are working on your claim and apologize etc." letters, never called in for a c & p. I filed for tinnitus in September of last year and had my c & p long ago. What does that mean? Cavman

Options Available for a Claimant Receiving a BVA Decision Denying a Claim for Benefits If the goal of the claimant who is affected by an adverse BVA decision is to retain an attorney to represent him or her, the right to do so becomes an option for the claimant at this time. This option is not available forever. The attorney must be retained by the claimant within one year of the date on the face of the adverse BVA decision. If the claimant’s goal also is to challenge the adverse BVA decision (with or without an attorney’s assistance), other than to do nothing a claimant has three (3) options to choose from: (a] submit a Notice of Appeal to the United States Cou…

Finished Claims & Appeals!
I`ve mentioned this before, but it totally amazes me with this many members on Hadit and how few of brown envelopes delivered since the first of the year. Honestly, I think there has only been a couple. Cavman

tinnitus Some Interesting Statistics (not Scientific)
Baltimore Ro for 2006 390 cases adjudicated by the BVA 274 remanded 116 decided of those 116 73 for either increase above 10% / or bilateral tinnitus. All denied. 46 others of the 46 others 25 denied 11 granted 6 withdrew the appeal 1 died Who was it saying that you should skip the denovo review and go straight to the BVA?? 11 of 390 total claims = 2.8% received the benefits claimed. Now that's the kind of math the VA likes.

Can You Receive More Than 100% Disability?
I have heard that you can receive more than 100% disability. Is this possible? It seem to me that is why they bulked all of my residuals into one code and didn't break them out seperately, so I didin't go over 100%. Even though they should be, but that is another fight/appeal. Thanks, Tamara
