Advice
Ron Abrams just called me and told me to go to the Buffalo VARO and check my file myself- This is a long trip for me- but the file did go to another claim's examiner last week- He agreed that there is really something very odd that the VARO claimed they have never received the IMOs -as they were attached to the remand. Maybe I should fax them to the Director- I had their fax number since my last ordeal- and it is still the same one.

ptsd Claim Is In Ratings
I called the 800 and the person I spoke with informed me that my claim for PTSD has been forwarded to ratings on the 20th of December 2006. I was wondering what comes after ratings, a C&P or increase in my current 40% disability for spine injuries? Thanks, TB

Bi Lateral Claim Calculations?
The form used for calculating my benefit percentage was very useful except it lacked a way to calculate for Bi Lateral conditions. I currently have 20 /10 /10 and was just informed that it will be changed to 20 / 20 /10 (which is still being challanged under a letter of disagreement). However, I understand that there is a Bi Lateral adjustment the VA uses in their calculations (10 /20 for knees and 20 for my back). Does anyone happen to know what it is so I can properly calculate my disability percentage. Just wondering if I now went from 40% to 50%. Thank you for your assistance.

Ring Around The Va
B) I was drafted with back problems which the VA doesn't deny. I openned my first claim in 1985. Was flat denied said Adolescent Epiphystis with back pain is not a disability by law. Doesn't state what Law ? Not knowing were to turn I dropped the claim. Now years latter I try reopening the claim running into road blocks. I findly got the claim openned and Its with the DRO had a C&P on Aug 3 06 The doctor said this was a no brainer and it was s/c. I verified by getting a copy of his report. I have submitted 2 doctors opinions, buddy statements etc. This should be a easy claim. I should never have been drafted. Anyways on Nov 14 I called the 800# was told that my…

Deshotel Knocked Down
http://vawatchdog.org/nfDEC06/nf122406-4.htm "The basis for the Fed. Cir.'s decision in Deshotel was that the statute required only that VA provide notice, an explanation of the denial and right to appeal notification with regard to each decision VA issues, and not as to each claim filed by the veteran. Thus, the Fed. Cir. held, if the veteran simultaneously filed 5 claims, for example, and VA denied one of those claims, the other four would be "deemed denied," and the veteran would never be notified of those denials. Hb And Other Benefits
Does anyone believe it is getting easier to get SMC type benefits or compensation in geneneral? Every once in a while it does seem that the VA lets the gate down for a brief period to let some more people get on the merry-go-round. I don't kown if this is one of those times but if it is I want to get on.
