Anyone Have Info On These
I cant find a thing-the AL web site doesn't mentiont this at all- In November the CAVC published UNITED STATES COURT OF APPEALS FOR VETERANS CLAIMS No. 06-2762 The American Legion and Nicholas Ribaudo, Petitioners, v. R. James Nicholson, And had given the American Legion a few weeks to file a brief under Amicus Curiae and apparently to clarify that this is a Writ of Mandamus under the ALL Writs Act. Although my old Mandamus writ is still public at the CAVC -as far as the docket goes- I can't find anything else on Ribaudo there- so maybe he never filed a writ in he past and the AL is supporting his new recent writ reque…

Varo Withdraws Claim Without Concent
Greetings, I received a letter from my VARO and it inofrmed me that one of my appeals had been withdrawn and it was because (they said) I wrote a letter requesting it. I contcated the 800 number and spoke to a rep and informed him that I in no way would have withdrew this appeal. The VA Just sent me in for a C&P 3 months ago. I contacted the VARO last week and they informed me that a decision had been made on my 2 appeals and claim for AA. NOw they are telling me that it is now back with the developement team. I faxed the VARO and sent a letter of protest. How could the VARO made such a terrible mistake?I have been waiting since Last May when iy went to …

http://www.vawatchdog.com/nfDEC06/nf120206-9.htm Sorry if this was already posted by someone else- this information does not seem to account for the stats on Remands- In any event - CAVC is whipping out decisions at a very fast pace-and yet the BVA is forced to Remand claims back to the VARO for numerous reasons, to be re-done at that level, and as this article shows, the VA has hired new people and is training them-yet veterans still wait and wait. I saw a recent claim at the CAVC where the veteran had died and then his widow-as the CAVC Plaintiff-died too.

Copy Of C&p
I'm so ill. C&P doc stated my carpal tunnel was less than as not caused by my cervcial neck problems or the arthritis in my wrist (stating arthritis is minimal). In one part he states mild neuropathy and right under it states symptoms of rt elbow most likely due to tendonitis not ulnar neuropathy??????? I have never seen anyone try so hard to disprove the obivious!!!!!! But he did put cervical radiculopathy of bilateral upper extremities is as least as likely as not. Also the cervical radiculopathy would result from cervical DDD whick already SC. Will they rate the radiculpathy or come back and say its already been rated under DDD??? I am so mad at th…

Iam becoming more concerned as I read of all the decisions gone bad here on hadit. I am also 50% ptsd, I appealed this for 70% along with this IMO from one of the best Board certified Psy chiatrist in West Virginia. I was granted 30% without a c&p when we appealed for 50% I had a c&p. The board certified Psychiatrist that did the c&p exam told me he could only help me so much if I wasn't willing to talk in some detail about Nam. At the time I just couldn't do it. Update On
Regional Counsel still has all the RO files regarding my claims. I called today to see exactly why they are there- It is due to the FTCA I filed against the VA, naming 3 VA employees, in regards to the "destruction of my property" (3 IMos and mailing fees at cost and value of $4,500.) The RG took this seriously. They never had a claim like this before under FTCA. This kind of baffles me that- if the IMOs were in the files- this is the VA's defense and all they have to do is acknowledge them, accept them as evidence to support the claim or just send me some VA BS that I can fight with another IMO. I already talked to the RG about this .I would rescind the FTCA…

diabetes How Should I File For Dic
I have been looking over my husbands medical records and I'm not sure how I should file for DIC. My husband has been on a diabetic diet for probably 2 years and it is even in his medical records that he is on a diabetic diet. He never filed for diabetes because I thought his A1C had to be 7 or higher. His highest one was 6.4. But he was on a diabetic diet so wouldn't this make his A1C lower. His Glucose was 144 right before he died and he hadn't had anything to eat in over 24 hours. It is also in his medical records that he has diabetic feet and that he is a diet controlled diabetic. U.s. Court Of Appeals
I was just wondering if anyone has dealth with the U.S. Court of Appeals for Veterans Claims, as I am thinking of appealing a BVA claim, as even they didn't look at all the evidence, according at least to their denial of a claim from 1971, long story, won't go into it here. I notice you can fill out a harship paper, so that you don't have to pay them 50.00, but what do they consider a finacial hardship, and do they send you papers to fill out to report all your income, or do they just take your word for it.
