Denial Of Dental Services
When I was on active duty I used the VA dental clinic. One of the procedures was the removal of a tooth and the placement of the "screw" for an implant. When it was time to fit the prosthetic tooth, it was discovered that the "screw" was placed at an angle and was not properly lined up. At this time I had retired and this was considered work in progress. aproximately a year later the "screw" was removed and the hole was filled with a bone graft. Aproximately six months later the surgeon was prepared to place another "screw" in the same site and complete the procedure. When I returned for the procedure I was told "I was not entitled to anything and I should just move on". …

hypertension Earlier Effective Date And Cue Question
This question is presented for the fine people at Hadit. Claim filed for Migraine Headaches and Hypertension in 1994. Claim denied for no SMR was available, C@P was provided minus the SMR. ( Hypertension was again diagnosed to compensable level) Asked to re-open in 1998 after VA had sent statement of case for another claim stating SMR was available. Re-open request was denied because no new and material Evidence was received. It stated that the service medical was negative for any treatment, complaints or diagnosis of Migraine Ha and HTN. I tried to reopen again in 03. I had a C@P exam last year and got a copy of the record. I went directly to the summary pages f…

Effective Date Of Claim
Last week I got the initial retro check. I assumed that the effective date was the date I originally filed my claim. My VSO was surprised by this and immediatly had me sign a form requesting disability payment for one year PRIOR to the affective date. She showed me a ruling that provided for this (sorry, I forgot the chapter and verse) I will get it from her next week and post it here. Apparently, the VA is authorized to make retoactively one year PRIOR to the normal effective date date IF the condition(s) verified by the VA were noted previously. In my case 1987. I will not get retro $ back to 1987, ( I filed in Dec. 05), but the VSO stated she had been successful…

Bring The Spouse
For any of you vets with significant others or spouses I would suggest bringing them when you go to the VA for appointments. Mine helped me get an MRI on my leg which I had forgot to ask about. Also having the spouse with you backs up statements you make about not being able to drive etc. The VA notes if you got to the appointment by yourself or not. They note if you were accompanied and if you are ambulatory. All these things can be used to support a request for A&A I think at some point. My wife also told the doctor about my poor sleep. The VA uses every little detail to portray the vet as being better off than the vet may claim. I hate to say it but any hel…
