Inferred Claim
On page 357 of the VBM it states the following: " Where medical records in the veterans claims folder indicate he has lost the use of a creative organ, the veteran has raised an inferred claim for special monthly compensation". The VBM goes on to say the VA is obligated to adjudicate the inferred rating. I believe it would be a cold day in hell before the VA in my region would do this without the vet filing a claim himself. This could be a CUE claim according to the VBM. I am just using the loss of creative organ as an example. This should be true of any notation in medical records of a disability. hypertension Cue Or Not
In Feb 2004 I had a claim pending for increases in ratings of back, DMII and hypertension. In Jan 05 I suffered a stroke. In responding to a 15 Feb 05 VA request for information in March 05 I included in my letter that I wanted to open a new claim for the stroke that had occured in Jan 05. In my request for a new claim I asked that the stroke be rated as 100 percent for six months as required by rating code 8008 and then rate the residuals according to their degree of disability. Help! Forum Posting Are Backwards! How Do I Change?
Hello everybody, I heard about this place at another vet site and have been visiting /lurking here for about 2 weeks. I know that this is going to sound stupid but for those 2 weeks I was finding it very hard to read the posts because they are not in chronological order. For example, post #1 on a thread is actually the last post in the thread and so forth. Also the last page in the forum (currently page 75, I believe) is actually the latest page and by my reckoning should be page #1 but page #1 is actually the oldest page in the system. For me everything is out of whack and I have been trying to put everything into proper order but cannot find the controls to do so. Help!

Really Frustrated Now
B) I'm not sure of any of you remember my post back a couple weeks ago but just to recap: Turned in claim Nov 05. Saw a QTC Dr. for 1 of my 5 "complaints" in April. Then I find out they requested an appointment for anxiety/depression in beginning in June. Well person handling this never followed through so VA Clinic or QTC never received ANYTHING about me and the person handeling my case has been out sick ever since then, beginning of June so my file has just been sitting there. Actually spoke to someone down there (Houston)that said they were going to talk to that persons supervisor and he would call me back but that was Friday and still nothing. I called and left a mess…

tdiu Gerd And Insomnia
How would I prove that GERD and Insomnia are service-connected? I take drugs that I know are partially responsible for these problems. I take Etodolac and opiods and these drugs do irritate my gut and also the opiates keep me awake at night. When I file for ED I might as well file for the other conditions as well since the VA is billing my insurance for the drugs to treat the conditions. Just because I have other insurance the VA bills my insurance for just about everything even though I am 80% and TDIU. The VA even billed for my C&P exams for DMII. This pisses me off. I also should have been given a rating for the bilateral factor since I have polyneuropathy …

ptsd Deferred Claim?
What happens when VA says that a part of your claim was deferred? Here's the email I received today from my State VA rep: I located your folder and it appears that you were granted 40% service connection. A letter was mailed to you yesterday. The PTSD claim was deferred. Based on your records, you were paid $XX,XXX separation pay for your first enlistment and $XX,XXX disability severance pay for your 2nd enlistment. You will not receive any payment from VA until both payments are recouped. Also, could some tell me where I can find information on severance/separation pay recoupment. Discharged For Panic Disorder
First off I want to say hello and that it is a relief to have found such a great website. I just got involuntarily separated from the Navy after serving 8 years for panic disorder w/ agoraphobia. No ship would take me cause I was on meds so they adsep'd me out. I sent my claim to VA and was wondering if anyone has any idea what I can expect for a disability rating if anything at all for this condition? Establishing Claim
Hi everyone again, As you know in the topic Options I explained about my husband's 1958 claim for an EED. Well in looking over their denial under Evidence they states the following: Your letter of August 17, 2005, establishing your claim for an earlier effective date for your service connected left knee disability. Well it turns out that his August 17, 2005 letter was to the Appeals Management Center in Washington, DC requesting that a complete copy of his claims folder be sent to him by August 29, 2005 for his September 5th appeal. ptsd Another Brown Envelope Story
Tears of joy and relief.....The brown envelope arrived yesterday. Retro check in 15 days. I went for everything I thought would affect my claim, including a few that were kinda "iffy". They denied the "iffy" ones (only one will I NOD), but everything else was approved, CVA 60%, DMII 40%, PTSD 30%, eight others at 0%-10%. Ended up at VA math of 96%, added TDIU, 100% P&T. ptsd Ptsd Re-eval
I think I mentioned this friend of mine- He has AO cancer, 100% Sec 1151, PTSD at 50% and GSW to leg- 40% and SMC. They sent him a re-evaluation notice- I got him the 100% in May 1995- the most recent % is PTSD from his vet reps help- He has been emailing me and called me today as he cannot relax at all over this- He found out today that they are looking at his AO cancer and also his PTSD for a re-evaluation He has NHL so maybe that would make sense as this can go into remission and he has done well with it. Confussed On What To Do About Nexus
John goes to DR. Primary (IMO) this afternoon. I have written down all of John's medical Problems and asked his opinion if he feels or presumed that some would be service aggravated ( Especially his back because of Spina Bifida Occulta ). I have done a lot a research on this. Only one person has won their case, But that was because he complained about pain from day one that he was in service. John never complained , even after falling off the Choppers twice, so we now this will most likely be denied.
