Va Rating Disabilities Electronically
I should probably have explained this better. According to our state VARO, that office is computing ratings "electronically." My first question is who approved the software and its use, and how do we know for sure how closely the formulas contained in this software program mimic the actual Combined Ratings Table in 38 CFR, Part 4, Subsection 4.25? Secondly, the statute clearly states the Table is to be used to compute ratings, there is no option to use any other standard of measurement. Finally, there's no mention in the statute of computing these ratings electronically, or what happens if the software produces a different rating than the actual Table. In our case, the…

Va Vs. Va
Here is what has cleared up a lot for me. I've found that the VA medical facilities and their medical decisions are independent of the VA administrative and legal aspect. They fight with each other. When you get a medical opinion in your favor the Administrative section sets out to disprove it. Simple as that.... It should not be that way but it is. When the administrative section of the VA can't disprove your medical opinion then they try to bury it in deceptive wording. It is completely up to you at that point to be as clear as you can and stay on point about what they continue to try to cover up until they cant cover it up any more and it's as clear as a bell. Just …

ptsd Help With Tdiu
I posted on the "Success Form" and maybe was the wrong one. So now I post here. As of last year VA rated me 80% based om 70% hearing lose, 30%PTSD, 0% wounds. I was told recently that I should apply for the Total Disability based on unemployability. I had never heard of this until then and have since found out more about it. My question is this: I am a 58 year old wounded vet from Viet Nam war. I am also retired as of last year. Would I qualify for this benefit since I draw a retirement check from my old job. If I do qualify what do I need to do. Any help greatly appreciated. Thanks.

Hepatitis
I am working on several health issues for a veteran friend of mine and I am hoping someone can answer something for me. She had hepatitis when she was 12, she served 6 years and in her 5th year of service she began to have liver problems. developed jaundice once and several tests came back showing abnormal liver functions. This was back in the 70's she is now having big time problems with her liver. MY question is since the army accepted her knowing she had had hepatitis as a child and had no problems for the first 5 years of service would it even get off the ground if I filed for the liver for her? Also her records show that for some reason she began loosing all t…

hypertension Too Soon Old, To Late ....
After all these years, I was told about applying for C&P in Nov. 2005. Placed on SSDI last year, now I am just beginning to start the C&P process. An MI in 1987 landed me in the VAMC, then also informed of DMII, Hypertension, CAD, among others. In 1993, the VA dr. said I was no longer eligible for ongoing care for DMII and related neuro syptoms. Like a "good little soldier", I said ok, and no longer went to VAMC for care. I re-entered to VA system after being declared disabled by my IMO and then later by SSDI, hoping I might be able to get care and the rather large load of prescriptions. Of course, even though put in Catagory 5, I am paying copays for every…

Hogan got some shocking news in the mail last month. He'd been dead for months, according to the U.S. Department of Veterans Affairs. The department wrote to the Vietnam veteran's "estate" seeking a return of the $23,231 in veteran benefits issued to Hogan since his "death." "Based on that amount, I figure I must've died sometime around Jul…

Letter From My U.s. Senator About Rating Error
At the risk of beating a dead horse, I'm writing regarding my husband's ratings and the fact that he is rated at 100% using the Combined Rating Table in 38 CFR, Part 4, Subsection 4.25, however is is being paid at 90% and cannot get all of his concurrent receipt, despite the fact that we have copies of his rating decisions that prove otherwise. The senator I wrote to asking for her help forwarded me the VA's response, part of which follows: "It should be noted that the overall or combined rating is not determined by simply adding the individual percentages of each condition. Rather, it is determined by the use of a combined rating table that considers the effect from…

Over-active Thyroid
Dave got out of the hospital a week ago. His doctor put him in because of High Blood Pressure. Anyway, while there, they did some tests and found that he has an over-active thyroid and severe colitis. He has a nodule in his thyroid and they were supposed to do a test to see if it was cancerous. The radiology department canceled the doctor's order for that test (according to the doctor) an jumped ahead to do a cat scan test on his abdomin and pelvis...that required iodine. We kept waiting for the thyroid test and finally learned that because the cat scan was given "out of order," they can't give him the thyroid test (to see if it is "hot") because it requires io…
