De Novo Review/dro Help Needed!
I have read the DRO Info from Carlie, I just can't understand it. As you know I was granted service connection for the cause of the veteran's death and entitlement to educational benefits,by the BVA, on June 21, 2004. On August 11, 2004, a letter was received from the RO, stating "We made a decision of your claim for DIC". The RO Pittsburgh, granted DIC effective May 12, 1993 and Dependents' effective December 3, 1981. I read 38 U.S.C.A. 5113 (a). Mental Health Issues
I am not very sure how the VA gets around to rating mental health issues. I have read through the rating of schedules but so far it isnt making too much sense. I may need to take a break read, digest, and study to fully understand. In the meantime I was hoping some of you may be of some help. Also while in service I was treated for Social Anxiety disorder. During the VA C&P the doctor diagnosed Agorophobia with panic attacks, which the VA service connected at 10% which is being NOD'd. Why did they rate the Agor w/panic vice what was already in my record for Social Anxiety. Under the DSM4 they are seperate conditions, although closely related. Also I have…

Alcoholism /abuse As A Secondary
Anyone heard anything of alcoholism or alcohol abuse as a secondary to depression? If one had this diagnosis, can health problems caused by alcohol abuse also be secondary (IE liver, etc)?

C & P For Dm11 & Neuropthy
I had a couple C & P's yesterday. For residuals of lung cancer they are going to set me up with a PFT, which should have been done then. For the DM11 related neuropthy he did nothing. I have in both feet and hands. He did not have me take off my shoes or socks, did not use the tuning fork, or give me a pin prick sensation test. How can he rate this without these test?

tinnitus Need Some Pro Guidance On This
At a C&P in 1978 on a special ear examination, the VA C&P doc listed on my C&P report -- Diagnosis 1 ) Tinnitus alledged. I was not granted Tinnitus until about 3 years ago. With the C&P doc listing that on my C&P -- would that stand up as an informal claim for EED ? It IS in writing, expressing a desire to be compensated for an alledged disability ? ? ? Service Connection, When Does It Start?
This sibject has bugged me for some time when discussing Severance of Service Connection and not Service connected. When does Service Connection (SC) begin? Does it begin the day of discharge, by reason of a Medical Evaluation Board (MEB), or only when the VA decides the matter after discharge? Case in point, two service men/women are both discharged by the same MEB, both with same diagnosis. One decides to opt for a disability check from the service, the other desides to opt instead to apply for a VA compensation check, (I won't go into details, like the second one was told the VA pays more for the same disability, or that they wouldn't have to wait to be dischar…

Rating Codes
I trying to find out if there is a Regulation or guide that explains what symptoms have to be present for each rating code. I had knee surgery while in the Navy. I rated under code 5260, Limitation of motion. They removed Cartlage which is code 5259 and found arthritis which is code 5003 or 5010. The VA says 5259 is covered under 5260, limitation of motion. I want to know if 5259 pertains to limitation of motion. I know I should have received a rating for arthritis but I need to know about 5259 before I request my rating percentages be changed. Monitoring
This site provides fantastic information for those working on claims, however does anyone worry about the government monitoring this site. I started thinking about this when all the hype was going around about citizens being monitored without warrants. Guess I'm just a pessemist. Jim Lane :P

tinnitus 100% Combined Rating Today!- Now What?
In 2004 after 24YOS, I was medically retired for Major Depression- I have not worked since and was turned down for Voch Rehab I was originally rated at 90% from the VA as follows Depression- 70% Sleep Apnea w/CPAC- 50% Glaucoma suspect-20% Bilateral Plantar Facilities- 10% Tinnitus- 10% Migraines- 10% and 7 different areas at 0% In Aug 2005 I filed for an increase in migraines- got the letter today- went from 10%-50%. Overall total is now 100%.
