Asbestos Related Lung Disease, Denied!
My diagnosis was for asbestos related lung desease; emphysema. Maybe I went wrong using the word "asbestosis". Who knows? The damage is located in the upper lobes vs lower. This is what the RO emphasized. Quote from my Rep: For VA purposes any post drug predicted FEV1 reading above 80% are considered normal, your's was 108%, this is one of the reasons the VA Dr says your breathing problrems are un related to asbestos, he also says you have dammage to the upper lobes of the lungs and asbestos always effects the lower lobes first, so if you have asbestos exposure related lung disease and show effects to the upper lobe, you should also see it in the lower lobes, again …

2001 Vamc Primary Phy "advised To Go To Dav & File Claim" Is That An Informal Claim
Jan 2006 my husband was just rated 10% for Stomach/bowel/colon problems ....We sent NOD - (feel it should be much higher) But atleast he was granted S/C & rated..... *He had formally filed 3/05. I just got his VAMC records & found that in 2001 his primary physician at VAMC "advised him to go to DAV & put in a claim for stomach & colon problems." He didn't at that time - he just wanted to get "fixed" . He realized that wasn't going to happen & put in the claim 3/05. Was that an informal claim in 2001? Does it establish a retro payment date? Can we request retro payments to the date she made this note, since he was S/C & rated? It is …

Special Cases: Treatment, Exam, Or Hospitalization--effective Date.
The date claim is received is not always the correct effective date. Think back on your claims; could yours be earlier? Usually, a worsened condition, a new diagnosis from a doctor, or a hospital visit makes one think of a new claim. Veterans could be missing up to a year retro. I think this regulation is lost in the shuffle a lot. Should I Do A De Novo?
I just received this letter from the VA stating they got my NOD. They want me to fill out some form to do a de novo by the DRO. I just wanted them to review the evidence I gave them. What should I do? Will it just be a records review, or do I get a new physical as well? Yipes, and I thought this would be easy!!! Sean

Ime For 1151 & Tort Claims
Greetings, has anyone ever heard of Dr. William Sniger, M.D.? I was refered to him by NVOA for a medication evalution for my 1151 and TORT claims. My local doctor outside the VA is not willing to write another one that might cause waves with the VA even though he is a civillian specialist. Anyone heard antyhing about this guy?? Thank you and God bless you all. I know of Doctor Bash I have an IME from him.

Mri
I'm going for a follow up visit at the VA for an MRI of my C-spine. Since that MRI is was granted 10% for DDD of the Lumbar spine. I have never had an MRI of the lumbar spine. If I ask for an MRI of the lumbar spine do you think they will do it. I know I have some serious problems due to the lower back and leg pain. I just don't know how they will react to my asking, I've always hated to ask for anything. MRI's are expensive and I don't want to pay my civilian doctor for it. Thanks

Surgery At Va
Next week I have a "procedure" at the VA. With everything said and done on the forum here I was wondering what all of you thought on the subject. I have a stricture in my throat, I belive it is from the acid reflux, that is to be basically ripped by the passing of a batton in the area of the stricture. FUN ehh:) Wonder seeing as this is the 2nd time in 18 mths this is being done if I could apply for an increase in my 10% rating for GERD? hahahahaha ROTF LMAO:)

Ssdi And Dependents
My family has always received the Family max for SSDI. When my wife started getting her own SSDI, the SSA readjusted her monies from the 'Mother' check to some in her name and some as the Mother of a young child. So.. we got 4 checks, mine, mine for the child(ren), hers and hers for being the mother. Now that the youngest is 16, the Mother check stopped, but we are still under the family max. I asked the SSA if the dependent child could be paid for 1/2 of mine and 1/2 of his mother's since we would still be under the family max. I was told no, the child could only be the dependent of 1 parent. My wife's SSDI is only $282 for herself. Why couldn't my 16 y/o get an addi…

Comrades, I just received another SSOC. It says that since I submitted no new and material evidence my claims cannot be reopened. Since my claims have NEVER been closed and our last letter advised the RO of that small fact, I think it's time to punt. sledge
