ptsd Reopen, Reconsideration, Nod, Dro Review, Etc.
I need specifics on the differences and the pro/cons of each. DRO review DRO review; reconsideration Reopen Reconsideration Notice of Disagreement This is still too confusing; I apologize for still nto getting it!! Something has to be done on all of the claim; not parts; and if you do not choose the correct terminology of the above you could lose your right to the EED. Sounds like from another recent post that you should not send a CUE in until the DRO is final and if not found in Veteran's favor, then send the CUE in to VARO? Then ask for Form 9 to send to BVA? It sounds...like he has a CUE; a reopen on several, reconsideration on a reconsiderati…

New Regulations For Vamc's Billing Department
I just received an Explanation of Benefits from my private Blue Cross Insurance. There were MANY prescriptions listed as having been paid to the VAMC. I called Blue Cross and every one of them were for service-connected medications. This has NOT happened in the past. I called the VAMC Billing Department and they told me it was now the VA's Policy to bill ALL medications to private insurance and they were to pay. I told the VAMC guy that was not VA regulations and he told me he could NOT discuss it on the phone, I would have to write a personal letter to them with my concerns. Has anyone heard of Congress changing the Regulations or of the President signing an Executive Or…

tdiu Another Tdiu Question
I was recently increased from 60% to 70% disability compensation. 60% for DMII includes secondary conditions. I know that that is the criteria for application for TDIU. My DAV SO has sent in the form 21-4138 SSOC to request TDIU. I'm not sure if we did the right thing. I haven't had a real job for two years but I do have income from the position I hold in our local Township government. It pays $1,000.00 per month. I have been elected to this position for ten years. No one else wants the job, it's very stressfull. I would like to quit but the money it pays keeps me and the wife in our house. Poverty threshold as near as I can figure is $860.00 per month so I am $140.00 too…

Severance Pay
Having received Severance Pay for my Acute Schizophrenic episode from the Navy, how does this effect a Veterans SC disability? Can the VA then come back after discharge and say the Navy Medical Board was wrong, that the diagnosis was in error. Wouldn't it be required to have more than just an opinion from a single Dr. to rebutt the prior diagnosis, that was based on three months hospitalization, written exams, physical exams, and personal observations over this same three month period? Doesn't the fact that one was paid Severance Pay, Set in stone the presumption of service condition, that if secondary disabilities are found, those too, should be found service connec…

What Can You Attach To A Cue?
I just sent in my CUE but I included medical explanations from sites online. Will that information be considered NEW? It only explains the medial jargon used in my records. I didn't include any new exams or anything like that. I also included some BVA decisions that also explained the medical jargon. Will they even look at those? Angela

tdiu Cavc Stay On Chap 35 Case
Does anyone have any info on the Stay proceedings order by the CAVC on July 19,2005 re: Friedsam V Nicjolson? Basically this widow took the VA to task on the unfairness of Chap 35- I suggest that when you are declared P & T by VA -have your kids apply for Chap 35 immediately even if they are still minors! Chap 35 regs are a crock!!!!! As a widow my Chap 35 were ten years limiting- I received the Chap 35 award letter in late 1997 and felt I had until late 2007 to complete my education. But widows are limited to 10 years after death- so in my case or in the case of Ms Friedman above (who the VA took NINE years to grant her DIC) the veteran's dependent child…
