Claims Format,
No one ever sees the claim as it is written and leads to a winning claim. We always get bits and pieces letting us know of the win and that is about it. I'm wondering if their is some form or steps or something that allows one to put in writing a well thought out claim that even the VARO would have a hard time finding flaws, in which to deny the claim. Example, Not to be used; A. Disability for which Compensation and/or Pension is sought. 1. Records that support incurrance in service or one year from discharge a. Chronological list of addition records supporting disability B. Treatment showing continuety a. List of effects on self and …

Fee Basis Card?
I have been a patient at the New Orleans Va off and on since 1972.However with the recent disater there is a chance that medical center will never reopen due to the excessive flooding. I had my meds renewed by a out of town dr. to the Jackson ,Ms. Va.I telephoned that Va this morning asking for a fee basis card to a local Dr. The lady incharge said she was sending me a package to apply for same. My question, she said I must take it to a local Dr for them to fill out,is it hard to find someone who wants to deal with the beauracrats? If approved does this also include private hospital care should that become a factor? I appreciate any advise on this matter from the bee…

Benefit Of The Doubt 38 U.s.c. 3007 (b) (1988)
I found a COVA claim with similarities to mine and I wonder how the VA was able to get away with out consideration being made to benefit of the doubt. My diagnosis was made by a conforance of Navy Dr's at my Medical Board, after reviewing my complete record up till that time, which included my military records and medical records and 24/7 observation and treatment for three months, while hospitalized for same. The VA C&P exam couldn't have been longer than 30-45 minutes in duration and in that time, he not only determined that I had a different diagnosis, but had no residuals from a fractured nasal bone and concusion and couldn't support the diagnosis for which…

Vbm Info On "special Treatment" Regarding Certain Claims
I just received the New VBM- they are again highlighting a point under 12.2.4 which they made in the old VBM. Due to the Veterans Benefits Act of 2003 (Pub L.No 108-183) during the one year period from Dec 16 2003 to Dec 16 2004 "certains claimants who were previously denied benefits can force the VA to redecide the claim even though the denial has already become final." Thi is not a CUE situation. If these conditions hold- a NEW decision can obtained by requesting the VA readjudicate pursuant to Section 701 of the VBA of 2003: 1.the prior claim was filed after or pending on Nov 9,2000. 2.The VA sent the claimant a letter asking for more evidenece (after N…
