I am about to be found unemployable by L&I and should get a state retirement through them. Since my original L&I claim was for a SC injury would that be good evidence to sumit for TDIU on my VA claim? Thank you as always.

ptsd Tdiu That I Did Not File!?
Hello I'm looking for a few questions in regards to TDIU. First of I am already rated at 60%. 50% PTSD with Major Depressive Disorder, 10% Irritable Bowel syndrome, 10% Tinnitus and 10% for Degenerative Arthritis Lumbar Spine. I also work for the VA, not a Regional Office but I do work in Release of Information and know a great deal in regards to claims as part of my job is assisting fellow Veterans in getting their records and fullfilling requests from Regional Offices for records wnen a Disability Claim is filed. With that being said I have had a lot of issues since my return from Iraq the second time when I was near the Balad Burn Pit for a year. I was diagnosed w…

diabetes Anyone More Familiar With This Section Related To Tdiu?
Can someone please help me decipher what a section in CFR 38 (4.16) refers to in a more clear sense than what I am reading? In 4.16 section, it states: "...It is provided further that the existence or degree of nonservice-connected disabilities or previous unemployability status will be disregarded where the percentages referred to in this paragraph for the service-connected disability or disabilities are met and in the judgement of the rating agency such service-connected disabilites render the veteran unemployable..." This entire TDIU opinion by a doc has complicated my claim and VARO looks at nothing else but an opinion given. Is a C&P examiner's word the final…

Chances Of Approval?
I was awarded a combined rating of 70% in 2008. I sent in a claim for IU permanent and total in Jan. 2011. My claim is still sitting in the gathering of evidence phase, I know have patience. What I am wondering is that I am rated at 50% for migraines which is the maximum and part of the criteria of that rating is that it causes sever economic impact on your ability to work, I am also rated at 30% for bipolar disorder and my VA Psychiatrist who I have been seeing for over 5 years has written a letter which I sent to St. Pete RO which stated that he considers be permanently and totally disabled but when I went for my C & P the "girl" who examined me for psych said I …

tdiu Should I Be Worried
My husband filed a claim for Tdiu, which was denied in October. The reason for his denial was because he was in school. They stated that since he was in school, then he can obtain a job. The problem is that he has not been in school for over a year and when he was he struggled. We appealed the decision. Then yesterday, I got a call from a regional office rep who stated that he had questions for me about my husband’s claim that was deferred ( he did not have any deferred claims). I asked which claim and he stated that it was the unemployability claim and he stated that the rater asked him to look into it and look at more notes on a vet center my husband went to once. Is th…

Tried to keep this brief, but filled with info to avoid "ping-pong" back & forth. I have spent considerable time reviewing many of the Posts on the Forums to avoid duplicating my questions. hypertension New Guy With A Question About Tdiu Claim
Hello. This my first post, so please excuse me if I goof this up. I am a Vietnam vet currently rated at 90% disabled. 60% CAD, 40% lumbar back, 20% DMII, 10% left knee, 10% right knee, 10% hypertension, 10% hearing, and 10% tinnitus. My back has been getting increasingly worse, and on March 22nd while at work I got spasms of pain that sent me to my knees. I went to the VAMC here in Minneapolis and they took x-rays, gave me a shot for pain, and said no prolonged sitting or standing, no standing on concrete. The next day, the firm I was working with immediately let me go, and the temp agency I worked thru laid me off. The VA has since done an MRI and an EMG and ha…
