  1. Some vets with PTSD gamble with their lives. The first few years I was back I must have had ten car wrecks. I did risk my life and I did not know why.
  2. The CUE concept of being an "Undebatale" error is really tricky. Also the concept of "reasonable minds" means the VA minds. What exactly does "undebatable mean to the VA? I think it means whatever they want it to mean. What might be undebatable and reasonable to the vet is in no way the same thing to the VA. You got to really have your ducks in a row to succeed in many CUE claims. I lost a CUE that was so plain I thought an idiot could see it. I was wrong because idiots protecting their money bags did not see it.
  3. Berta was a real expert with CUE's. She did many over the death of her husband. If you are really good at it you could probably make a living doing them for others. CUE's to me are like SMC law where it is so tricky most VA reps don't even understand them. I don't think most lawyers understand them either. My lawyer did not really understand my CUE. He was using legal standards like for SSA. The VA fooled him with "Reasonable Minds" and all that hogwash.
  4. If I was still getting TDIU I would not think about working any job where I get a W-2 or 1099. If you can find something in the underground economy where you don't leave a trace for IRS, SSA or the VA then that might be ok. Before I got 100% I used to buy and sell collectables. I had a lot of fun going to actions and sales. Everything was on a cash basis. If you get all the benefits of TDIU and being P&T I would try everything else first before working at all. I don't advocate breaking the law but nobody says you have to dumb about it. Now I make most of my money from passive income which does not count towards TDIU or SSA.
  5. Florida where I live is overrun with quacks. Even most of the physical therapist are shady. You go to the real doctor and he shunts you off to a therapist who has 20 other patients all getting PT at the same time.
  6. I had one of these "docs" who claimed he could heal cancer by manipulating my spine. Fortunately I did not have cancer. I was seeing him for back pain and neck pain. What he would do is really give you a brutal massage and then when it got better he would claim success.
  7. One session with my local chiropractor and he about broke my back. Never again would I let one of those guys touch me.
  8. I don't know if I would really be up to fighting a long CUE these days unless I could just hand it off to a lawyer. I waited 6 years for final denial on my CUE. I was asking for 30 years of retro at 100% level. You can imagine how that went over with the VA.
  9. Berta was really good with survivors and with using VA tools to sue the VA for malpractice etc. VA killed her late husband so she was mad as hell. They paid her beyond the DIC she was entitled to get. Berta knew her regulations like the back of her hand.
  10. I remember hearing that homeless vets had to prove they were homeless for 180 days or something like that. How do you prove something like that? Get all the drunks and tramps in your area to say " yeah, he sleeps in the park with us"? VA suspects every vet is trying to scam them. Instead of the helping hand you get the kick in the ass.
  11. Is the kidney disease the result of DMII? Are you a Vietnam vet? DMII has so many secondary conditions.
  12. Chief How are your eyes and kidneys? DMII can really affect those organs. Did the VA give you a scooter? When your feet go numb you can fall very easily. I fear falling in the shower. How much do you get for DMII. I get just 20%. DMII can also affect your heart. I get 60% for heart problems.
  13. My ratings were much higher than I thought. I was really filling on my DMII because I have to take insulin. A lot of exams for PN are based on a doctor asking you if your feet feel numb and just tapping your elbow. This is all very subjective. I had just ten percent on my hands and feet and the VA raised it to 40% on all limbs. That got me over 100% from 90%.
  14. The errors for CUE claims usually have to be as big as a bill board on the interstate. There cannot be any need of judgement or thought involved. The errors must be so obvious that any idiot (besides VA) can understand it.
  15. The easiest TDIU is for mental stuff. If you have serious physical problems then you probably have some degree of depression. I got TDIU 20 years ago for physical and depressive symptoms. Your doctor just has to say you are unemployable solely due to your SC conditions. With SSDI it is harder but basically the same drill.
  16. If you are going to get an implant they usually do a bone graft. I don't know about a major bone graft for other reasons. I doubt the VA would do that.
  17. You know a lot of DX for PN is subjective. I got some high ratings for PN just based on an exam and me answering questions. I got 40% for hands and feet.
  18. Federal workers compensation will pay you up to 70% of your lost wages. They also pay for injuries to certain body parts. I got what they call a schedule award for my feet, wrist and my shoulder from WC. I got about 30K for my ruined shoulder and about 20K and 15K for the rest. I also got a monthly check for 70% of lost wages while I was out of work. I changed over to VA compensation because I had to choose between them. VA compensation is usually better than WC because the WC people are always trying to get you back to work.
  19. That caregiver thing is a hoax and a racket. It is really a fraud done by the VA to be seeming to help us. I am sure the big wigs at the VA go to congress and brag about their Caregiver system. What lying dogs.
  20. Sgt. I agree. It depends on the patient and the doctor. The pendulum has swinged the other way from handing them out like candy to being so stingy that vets and others suffer needlessly. It is easy to get hooked on pills if you have chronic pain like I do. VA comes up with alternative treatments but nothing works like narcotics to treat pain. It is too bad because if you use narcotics you have to increase the dose over time and doctors won't do that often. If you take the same dose more than a few weeks you will need more to get the same relief.
  21. Sgt. When I first started using the VA for pain management they were handing out dope like candy. I got oxycodone and morphine which was really too much for me. The morphine was awful since it turned my bowels into concrete. Now they attempt to cut down my small dose of oxycodone every time I see them. They go from one extreme to another.
  22. I had shoulder surgery about 20 years ago. It did not help and made my shoulder much worse. I had it done under Worker's Compensation. That was a mistake! Unless you have a serious tare in your RT Cuff I would not risk it. Try PT from a good therapist. Mine really helped me!
  23. I have been told by my VA doc. that I must be evaluated by a certain dept. I will see about it.
