HAD MY BVA HEARING WITH VLJ VIA VIDEO YESTERDAY,THEY ACCEPTED MY IMO AND SHE DID NOT ASK TO MANY QUESTIONS.SHE LET MY LAWYER ASK ME QUESTIONS AND NEAR END ASK ME ABOUT SOME TREATMENTS AFTER GETTING OUT OF MILITARY AS FAR AS RECORDS ,WHICH ONE HOSPITAL ER I WENT AND THEN AFTERWARD HAD TO GO TO TREATMENT FOR 30 DAYS EVERYDAY,WHICH WE HAD LETTER FROM THE STATE GOVERNMENT STATING THOSE RECORDS WERE DESTROYED BUT ACCEPTED MY LETTER FROM SUPERVISOR AT MY JOB WHO STATED THAT I DID GO TO TREATMENT FOR 30 DAY 4 YEARS AFTER BEING DISCHARGED.THE VLJ THEN MADE A POINT TO MENTION TO BEFORE I LEFT THAT SHE WOULD TAKE INTO CONSIDERATION ALL MENTAL DX OTHER THAN PTSD AND DEPRESSION THEN CLOSED THE HEARING.I THINK IT WENT WELL AND I WAS WONDERING HOW LONG BEFORE A DECISION IS COMING,DOES IT MAKES A DIFFERENCE THATI CONTACTED MS HICKEY AND EVERYTHING MOVED FAST AS FAR AS ME GETTING AND APPPEAL HEARING AFTER FILING I9JULY OF THIS YEAR.

look up MD Brett Valette he does IME-IMO for vets.He does great job.

I have the same thing and I have an appeal at BVA this week,for ptsd and depression with no SC disabilities approved yet.What gives?

I was dx depression in military and the VA examiner stated that there was dx of depression in military and also now,the denial was that the private examiner had an M.A and VA examiner had an PHD so the probative went to VA examiner,even though also was DX with PTSD and Depression while partial hospitalize in private hospital ,i also don't like your comment about paying money to get another evaluation.If you got an DX that you felt was wrong would you not seek another opinion.It amaze me how some come on hear and give opinion that if I did not no better I would swear you work for VA. I put the IMO in my document so it could me read and understood not degraded.

THE MD LOOK AT THE C FILE AND OTHER MEDICAL NOTES AND EVEN STATED THAT THE VA CP EXAMINER SHOULD HAVE ASK THESE PROBING QUESTIONS AND AT SOME POINT COMPLETED PTSD DBQ.HE ALSO STATES THAT THE VA EXAMINER FAIL TO IMPLY 38 CFR 4. THE DX OF PTSD WAS SUPPLIED BY TREATING MD DOING PARTIAL HOSPITALIZATION FOR 10 WEEKS AT LOCAL MENTAL HEALTH FACILITY. DX OF DEPRESSION ALSO WAS WHILE IN MILITARY RELATED TO ASSAULT THAT WAS WITNESSED AND THAT THE IMO OPINIONED IN HIS REPORT.

IS THIS GOOD ENOUGH ON IMO:PTSD MOST LIKELY CAUSED BY OR A RESULT OF MILITARY ASSAULT. ALSO IN IMO -IT IS MY OPINION TO AT LEAST 90% LEVEL OF PROBABILITY THAT HIS CURRENT PTSD AND DEPRESSION ARE DUE TO HIS EXPERIENCES /TRAUMA(THE INSERVICE ASSAULT) THAT PATIENT HAD DURING MILITARY SERVICE. WHAT YOU THINK?

My mental health records destroyed from 1984 and I called the state health department that keep those records and they stated they were destroyed but they also decided to send me letter stating this fact and that I called their office requesting these records.I also have a statement from employee that was employed at the Telephone company when I had to go everyday to these treatments for a month.My question is that if the VA can give benefit of doubt to vets who lost records in the fire on VA facility years ago will I be given this same benefit of doubt at my VLJ hearing.

What is automatic of agency of original jurisdiction review of new evidenced , does this mean any new evidence will be accepted at be a hearing that day of hearing and not remanded.

How much he cost ? I just need IMO to back up my license masters psychologist , who VA said gave no rationale. My MD that refuse was private.

IME MD refuse to filled out paper,he read the private masters psychologist report and like it but he said would be better have someone more legally adverse.In other words he was not going to do it,I explain the VA denials because of rationale and because he was just masters psychologist . Now what?

I have IME schedule next week what format or form do I take,If anyone have a sample letter I would appreciate if download on site so I can make sure its filled out right.I have psych evaluation scheduled. My claim acquired mental while in service.

Did they give you a price,how long did take schedule appt.

Is that counting after dropping hearing,I had dropped in October 2014,i9 appeal 07/13/2015,today 08/11/2015 received letter stating hearing with video 7th front of judge September 23,2015,how much longer,2 more years.

Received email from Allison Hickey office saying form 8 completed.Today received letter stating VBA appeals hearing at RO schedule for September 23.This is video hearing with my lawyer,trying to get IME before hearing?

Thanks for info,but the independent medical exam would be because the denial of the claim I am appealing not for new claim.So if I get the independent exam do I send to RO if not received by bva when completed.

My lawyer mailed I 9 appeal form in to VA and sent me a copy,I later 10 days was checking my claim on benefits and it said if no further evidence click to have claim process instead of waiting,I think it was 5103 form.Does this affect my appeal and can I still send an Ime that I'm planning to get for acquired mental.Claim shows eligibility determination.

My claim shows something after denial of drop and then emailed Allison Hickey they showed new claim in progress eligibility requirements claim with no time estimated for finish,this popped up with the date of claim the same day I email Allison.

I have same thing,from denied and then called or emailed Allison Hickey and now they show open claim 6/24/2015 the same day that I emailed her as open claim listed as eligibility requirement gathering evidence with no time limit to when will be finish.I have no clue what ebenefits is doing.
