  1. Im no expert, but i don't homestly think the VA can Remove your Service Connection unless its been because of Fraud. Service Connection pretty much means, in my opinion, "hey, we broke you, sorry bout that". It's affirmation that your disability was caused or aggravated by your military service, a lowly c&p exam by one person isn't going to change the fact. Once again, all my own opinion, but i honestly wouldn't worry about losing it.

    Its all up to the rater.  In the end though, I think he's looking at at least 80%...

    Hey, Congradulations! If you are looking to see if you are Permanent you should be able to see a Commisary Letter in your EBenefits Letter Generator. Its a letter that gives you acess to Armed Forces Bases. It should say towards the bottom of the Letter

    "This total disability is considered permanent. You are not scheduled for future examinations."

  4. Ms. Bird, this website has helped me since the start, i may have been triggered a time or two, but really i've had more good experiences here than i have with the VA. I'm done with my personal fight, but i don't think i'll be leaving any time soon, too many others still fighting.

  5. Getting closer on my TDIU Claim! Hopefully wont be much longer now!

    Date of completion is between February 15th and March 21st. Getting past the Gathering of Evidence stage i feel is the best step. The end stages tend to go faster i've noticed since i started this whole process with the VA back in June of 2014

  6. General rule of thumb, if you are Schedular 100% work is fine, but one of the big things on getting 100% for PTSD is inability to maintain a job.

    100% Total Disability Individual Unemployability then no you can't work and earn above poverty line. 100% TDIU is for people who don't have 100% schedular but can not maintain Substantially Gainful Employment.

    Was this a re-opened claim? Did they say they had made a CUE in the denied decision?

    Ms. Berta,

    When i first started fighting the VA it was June if 2014, i filed for PTSD with Depression and Anger issues. They denied me in October of 2014, but my Disabilities shows i do have PTSD for Personal Trauma, just not Service Connected. 

    Then, i submitted a new Claim in May of 2015, for Adjustment Disorder with Depressed Mood, which is what i had been Dx with by a Psychologist at the Ft. Benning Base Hospital. The VSO also asked for a Reconsideration of my PTSD Denial.  I received a C&P Exam September 8th, was awarded 50% Service Connection September 9th.

    I posted my C&P Reults here around that time, some people agreed with my 50% Rating, others had thought i had been lowballed and deserved 70%. I believed i deserved a 70% Schedular Rating as well, got a Lawyer and in July of 2016 we appealed to have an increase to 70% plus TDIU since i have had over 20 jobs in the 15 years i had been out of the Service. I have only made above the Poverty line 2 years of those 15. 

    When i finally received my increase, my SOC said they were Service connecting my second Claim, from May of 2015 all the way back to June of 2014. I was suprised, but i thought it made sense since i HAD filed the initial Claim for PTSD with Depression and Anger Issues. I never heard from my Lawyer about it, im.sure he was just happy to get his 20% from that initial finding.

    They deferred my TDIU Claim and a little time after that i got SSDI, so they sent my Award Letter in as well. 10 months later in October of 2017 they finally started working on my TDIU claim again, i went to a C&P Exam, and then in November i actually had this pop up in Ebennefits. It showed that my Claim was Pending Decision Approval. But then, it got sent back to Gathering of Evidence. It appears they want my Medical Records from my Scial Security Decision, which is great, because i have my SSDI based on PTSD, Major Depressive Disorder and ADD.

    SSDI, Filed in February 2017, Was deemed Disabled from May of 2015, recieved Retro for 12 months in May of 2017. 

    My VA Claim is currently waiting for my Medical Records from SSA, which they sent out December 22nd. 

    Striving for TDIU and P&T....hopefully can update Hadit soon when i win
