I would caution to check on the attorneys stats and game plans. Some will give up on you if your claims are too complex. Not knocking attorneys, however, they run businesses, essentially they are a business and well if it's too much work, they will drop the claim in mid stream. Just, I just caution for folks to be aware of this fact. Make sure you and your attorney are on the same page with the same goals. JMO

For sure for sure, but the simple fact that they even bothered to have you sign your name on the dotted line means you may in fact have a LEGAL basis for your Claim. There ARE bad VA Lawyers out there, i've done my homework though. I've also heard horror storys of Lawyers rolling 1 or 2 good&easy claims in with a bunch of duds just to jack up their 20% fee. Just saying personally, i've felt more confidence with a Lawyer who has a Stake in my Claim than a shoddy VSO who's collecting a State check cruising to retirement, or worse, an incompetent ill informed volunteer.

I already gave the DAV a long year to give it a try, and all that happened was denials everywhere, and no help from them.

They are the WORST. the staff is incompetent beyond belief. When i got my SC last year i joined them like a idiot thinking it would help me see someone more knowledgeable, i was sadly mistaken. Not even a month after i started paying them they started sending me junk mail begging for money to "help" us Vets, wtf??? Seriously? I NEEDED YOUR HELP ASSHOLES, lol. Oh well, Lawyer is tge way to go in my opinion, they have a stake in it too

Thank you. You have been a source of encouragement for me, ever since I joined this group.  And so have many others, too.

This was the easy one, a clear cut slam dunk.  The next appeals will not be as easy, that's why I'm trying to enlist the services of a NOVA lawyer.

    Semper Fi,

Robert A. Friedman and Assts out of Everett WA, they will represent if you have a Legal entitlement and they think you can Win. Send me a PM if you want some more info

you might need to get your self  some help with your problems to start with

then get a claim started. If you think the government gives a crap, keep thinking

and living in the world help your self by getting the info to win a claim and stay

out of the appeals process. That's what kill a claim you get the evidence first than file

So I am trying to get my FDC together and have a few questions. I have my stressor letter, dd-214, combat action badge, and vet center records that will be included with the claim. I do not have a VA diagnosis (will wait for C&P exam), so should I include my c-file, complete va records, etc as attachments? Or will they have access to all that without me uploading it all for PTSD? If I forgot anything else let me know as well. Thanks. My local VSO are not much help so hopefully I can get what worked for you guys in the past. Thanks.

VA doesn't accept any non-VA DX for P.T.S.D. Even if you have PTSD(like myself) the fact that it wasDX'd by a Counselor(no PhD) made it doo doo. I didn't even get a C&P. I got a cursory 3 month review and rejection for service connected. So yeah, woopdie doo, its on my list of disablilities, but i got my depression SC'd so fast and lowballed i have a Lawyer now. Get something SC'd, unless you already have acess to VA Healthcare, if you DO, go in and ask to see a Psychologist, if one is NOT available, get on a waiting list. Don't settle for ANYTHING besides a VA PhD Psychologist. I mean it. If they demand to know why you wont see a Psychiatrist or Counselor you tell them you know 100% for a fact that only a PhD Psychologist is specifically Educated and Trained to make Mental Health DX. This is just all opinion based off of my own personal experience with the VA. I say, phUk worrying about your FDC, it is better to go in prepared and win the first time, then to rush headlong into a immediate game of Appeal and Delay played by the VA. Don't fall for their lame ass attempts of diverting you from a WIN(with a hollow promise of FAST bennies)

    Good Luck

  6. I see a 70% for Schedular also. What's your work  and education history? Are you working? TDIU is not that hard to get on an Inferred basis from the date your claim was started if you weren't working. Sorry our Opinions are so shoddy, but we only can make judgements based on the info you give us. If it is for just this one disability and thats all you have in then yeah, 70% Service Comnected Schedular is what i see.

  7. I wouldnt wipey assy with any VA info, the bitter tears of too many of our fallen Shield-Siblings, and their Widows lamentations stains my every Perception of the VA, im in it for the Kill. xxxx VSO's, xxxx Charity, xxxx treating a VA official with deferrence. I am OWED these Benefits, i refuse to ask anymore. I sat on my denial letter for 9 months before i even called a Lawyer, the Bait was already fat and juicy with $$. Tge trap was sprung, after he got my actual med rex, and copys of other important work, they jumped all over my shit. Now it's a waiting game.i see it as my money in a Savings acct i just can't access yet.

  8. If you were Schedular 100% you could be P&T and still work without any adverse VA action. You are not gonna get it. Facts is Facts, why would they lock in 70% Sch. for life when youz obviously working....you could still be "cured" at a future date.P&T is only available by law to those with a 100% rating, whether sched or TDIU.It removes the Sword of Damocles from over our heads who are worse off than you, but share your same Sched.%. Mean's you are so phUked up Schedularly that they know you would never improve based on your SC disabilitys and secondarys. P&T for me will be approved because I literally cant work, or educate myself, or generally be in Society. So, TDIU for my Appeal.my work history, SS Income Statement, Credit Reports, education and many many other things are going to be factored into my DRO Appeal. You can work, pay your bills, you won't break 70%scheduler unless you also have physical disabilitys. They only rate MH as the symptoms, not the etimology of the damage itself. People with multiple MH disorders like us be phUkt in that way.

    Hope that helps

  9. iMHO

70% Scheduler. Can't get TDIU and be working. VA doesnt rate based on different mental illnesses, only the symptoms. You're looking like you should get 70, but don't be horrified if you get Lowballed at 50% or even 30%. don't get yourself worked up over something that isn't a negative towards your claim. Service Connection and not pissing off the wrong VA Piss Ant is just as important as Knowing you're Owed.

Keep your Shield up, dig in, and realize that Truth is on your side, but unfortunately Time is on the VA's.

    Good Luck

    Hello Andyman73,

If someone has 4 out of the 7 symptoms for 100% PTSD, is it possible that the VA can STILL low ball? Even if the veteran has a nexus or in-service connection.

Lowballing is pretty much SOP for a jackass ratings officer. They are easy to train and replace, why do you think so many of us are fighting it out in the trenches still? If you alone can look at the findings in your Letter, and KNOW you have the criteria met, take your letter to a VA accredited Lawyer.

Well, all 4 of my C&Ps were done outside of the VA. ?

I didnt know the option to choose was even possible.

I'll be checking E-bene today hoping for an update.

Well, any appointment you have upcoming on your Ebennies site you can call and discover the details if you haven't received your letter at that time. I dont ever remember someone from the VA on the phone telling me no they can't accomodate my requests. Talk to people, you would be suprised how many are actually trying to help.

  12. Andyman is correct, i ALWAYS ask that all my issues are taken care of through the VA. I refuse to even accept the Choice program even though it is available to me. My C&P was done by a VA psychologist, i was literally approved the day after. For those of us who are not yet P&T 100%, it is wise to always use the VA's system, Rating Officers really don't listen to the opinions outside of the VA anyways. Make your case stronger by always using their system to get what is Owed

  13. went to college after i got out, dropped out within spittin distance of only a few months for 3rd semester to be done. And then, 7 years later, got medicated, went back to college. only made it 2 semesters and 3 weeks of classes........notice a pattern? some of us just can't be around other people. it's physically and emotionally exhausting to be on Red Alert all day. good luck to you, educating yourself i always believed was a process of continual growth, why is a "degree" necessary when you're thinking about your own business. do what fulfills you as a person, let it flow. we only live once

I DID submit an original claim for back pain when I first left AD in 1999 and that was denied due to not enough evidence (I didn't know enough about the process to pursue a NOD/appeal) - I wonder if they referred back to that instead of the new claim of connecting it to my SC left knee since they didn't reference it in their denial?

you answered your own question, any weakness you provide the VA they will use to their advantage to deny you for as long as possible, the way they figure, they "might" have to Retro Pay you someday......or, because we ARE disabled, we may actually, you know, phukin DIE.

Get your Cfile, get all your Health/MentalHealth/Behavioral Health records and learn your shit. Hadit.com can literally change your outlook and your chances at a honest rating from the VA

  15. without looking at your C&P notes, or knowing what you may or may not get at Service Connected, i still want to say something. If your C&P Doc put all this information down and it's all verified, then i say you have a case for 100% TDIU and P&T. no matter your scheduler %. if you get lowballed(i did and it's kinda standard for the dicks), or flat out denied, take all your information to a VA Accredited Lawyer, if they are willing to take your case let them.
