  1. Marie,i read your profile and you don't list your self as a veteran.If you are a veteran,there is no time limits to file a claim with the va. mobie
  2. spike since you seem to be gainful employed last year,you probably would been denied unemployability .On ptsd you probably should have filed a NOD if your psy said that your ptsd symptom had gotton worse. mobie

  5. janqrin that is very good information.I got a letter from va about my daughter chapter 35 benefits and a propose letter of a over payment,she miss a semester because of an accident and i know that it was reported to va,evidently it got lost somewhere and that information you posted is just what i needed.Thanks mobie

Tammy I went back and read your earler post and my speculation was wrong about initial claim filed in 2003.I really don't understand this one.If you keep appeals timely and va just decided to granted him service connection in 2003 and not go back to 1979 when claim was filed,something is mighty wrong.Like i said on my post below get your private Doctor to give you a statement.you really need a good vso on this.Don't give up. mobie

Difference in DRO and BVA is DRO can change decision and give you a rating if not,send to BVA that mean,you get two looks.If DRO granted claim it go to the post determination team and you should have money in hand in about three weeks.Whenever BVA grant claim if they do Bva have to send claim back to your regional office and it take about four months before you get money and that all depends how backlog office that handle your claim is. mobie

Tammy, i read your post several times and i thank i understand what you are saying.My guess is that ,you file a claim in 2003 for his back.If this is true,no matter when he broke his back va will only paid him back to the original date that initial claim was filed.When a veteran is getting total unemployability and va thank that a disability can get better,va can order a C&P and if you put in another claim ,they can order a C&P.If i was you, this is what i would do,i would get an appointment with a private doctor or your family doctor as soon as possible and try to get she/he to write a statement that your husband is total disable and more than likely will be total disable in the future for his back.Raters act on information submitted by C&P examiners,thats the reason you need a outside opinion someone who see you on regular basis. mobie

  14. John6012,when you file a claim with va no matter when the injury occur if you get service connection granted ,it is the date you file claim,so the correct date is ???? 1985. mobie

Rocky,i am pulling for you to get a IU rating,but take your time and don't get to overjoyed.The rating board is where you want your claim to be,remember the rater could need more information and send your claim back to the pre-determination team.Like Larry said give them a call next week.Good luck. mobie

Total disability ratings for compensation may be assigned, where the schedular rating is less than total, when the disabled person is, in the judgment of the rating agency, unable to secure or follow a substantially gainful occupation as a result of service- connected disabilities: Provided That, if there is only one such disability, this disability shall be ratable at 60 percent or more, and that, if there are two or more disabilities, there shall be at least one disability ratable at 40 percent or more, and sufficient additional disability to bring the combined rating to 70 percent or more. For the above purpose of one 60 percent disability, or one 40 percent disability in combination, the following will be considered as one disability: (1) Disabilities of one or both upper extremities, or of one or both lower extremities, including the bilateral factor, if applicable, (2) disabilities resulting from common etiology or a single accident, (3) disabilities affecting a single body system, Rocky i hope this helps mobie

  19. 3. CUE Motion. The law was amended in 1997 to provide one more way to challenge a Board decision. A Board decision can be reversed or revised if you are able to show that the decision contained “clear and unmistakable error” (CUE). Your written request for the Board to review its decision for CUE is called a “motion.” CUE motions should be filed directly with the Board, and not with your local VA office. Because CUE is a very complicated area of law, we urge you to seek help from your representative if you decide to file a CUE motion. A motion for CUE review of a prior Board decision must meet some very specific requirements, described in the Board’s Rules of Practice. If the motion is denied you can’t ask for another CUE review of the way the Board decided the issues you raised in your first CUE motion, so it is very important that the motion be prepared properly the first time out. Not many CUE motions are successful, because CUE is a very rare kind of error, the kind that compels a conclusion that the Board would have decided your case differently but for the error. A difference of opinion is not enough. When you file your CUE motion, you must tell the Board clearly and specifically, in writing, exactly what the “clear and unmistakable” error, or errors, were. You can file a motion to review a Board decision for CUE at any time, but if you file your CUE motion after filing a timely Notice of Appeal with the Court, the Board will not be able to rule on your CUE motion.
