  1. Ironfaux As to applying for P/T you can file a request to stop having anymore exams. I dont know if this is the right way to do it as I dont think that there is an official way to really apply for P/T. But, this will/should accomplish the question of the rater at least making the decision for no new exams. If that is the case then it would essentially do what you are looking for as it relates to P/T. Also try and get your Psychiatrist or clini Psychologists to state that your PTSD is permanent in nature and will not get any better.Va don't base everything on a Gaf,but with a gaf of 28,thats very serious.I hopes this helps Mobie 16r 100% P/T PTSD

Yoggie, This is what it takes to get service connected for PTSD Service connection for PTSD requires medical evidence diagnosing the condition in accordance with VA regulations; a link, established by medical evidence, between current symptoms and an in-service stressor; and credible supporting evidence that the claimed in-service stressor occurred. If the evidence establishes that the veteran engaged in combat with the enemy and the claimed stressor is related to that combat, in the absence of clear and convincing evidence to the contrary, and provided that the claimed stressor is consistent with the circumstances, conditions, or hardships of the veteran's service, the veteran's lay testimony alone may establish the occurrence of the claimed in-service stressor. 38 C.F.R. § 3.304(f) (2005). mobie
  3. yoggie, I see you been diagnose with combat Post-traumatic stress disorder,i thank the problem is that va can't verify your in-service stressor.what you need to do is go back and search your unit histroy and find out what happen doing the time you was with the unit.SUCH AS: Names of anyone killed of injure,or getting mortar by the enemy of killing the enemy anything that caused your trauma.You need to get dates of as close as possible of these event,remember the stressor that you submit have to be the reason you have PTSD.If you have adobe reader pdf file downloaded on your computer,you can go to the Department of Veterans Affairs web-site and download form 21-0781,This form is:Statement in support of claim for service connection for PTSD.Fill out this form with your in-service stressor,dates,places, unit you was in when event occur.Submit it to your regional office by ceritified mail.I hope this helps Mobie16r 100% PTSD

Ruff Remember,you can only be service connected for one mental condition and depression come under PTSD which you are service connected for.If you feel suicidal tell the examiner,you are only being honest and tell he/she how depress you are also go to vamc and make you an appointment to try and get you some counseling,the vamc is there to help you and this will also help on your claim mobie

Bozac, A DD form 215 is issue when you have your military records corrected such as medals that you recieved and was not recorded on your DD form 214.ITs is a extension of a DD214 and if you want to have it recorded at the court house where you reside at its ok,because if you need one in a hurry,you can just go to the courthouse and get it in the same day. mobie

Will,if what you say is true, about the many jobs you have had definite makes you unemployable.What you need to do is get a private psychiatrist or clinic psychologist and let he/she review your medical records and tell he/she everything you wrote on this forum about your life problems,he/she should be able to tell that you are unemployable and probably would write a letter in your favor that you are unable to sustain gainful employment now and in the future.Get all of this evidence together and download va form 21-4138 (Statement in support of claim)from va web-site,ask for a RECONSIDERATION of IU and write on form how your depression affects your life and submit evidence to your RO.The reason i am telling you to ask for a reconsideration is because you have one year from the date of denier of claim to ask for a NOD reconderation and just a plain reconsideration is a lot faster and it will be look at by the person that denied it,and if he/she still denieds it,you can still file a NOD.On the reconsideration you have to have new evidence.Also call, of go to vamc and ask for an appointment with a va PSY and tell them that you need help and would like to get get in some kind of counseling program for depression.Going to a private psy is expensive if you don't have insurance but believe me it is worth every dime.Good luck mobie

If you are talking about a ID card,this is what you have to do.Go to your regional va office and have them to write you a commissary letter stating that you are being pay at the 100% rate and that you are permanent,and when you get letter,take it to any military base where they make IDs along with your marrige license,birth certificate,DD Form 214 and take your wife with you so can get it all done at the same time.If there is a military base close by go there. mobie

Thanks-2-u,first of all, congratulation on your success with the varo,this is what i will do like mountain tyme said,file for reconsideration but,you have to have new evidence so i would get me an appointment with a private psychiaitrist of clinic psychologist asap, and let he/she review your ssdi file showing that you are not gainful employable, because of your ptsd, and use the information you get from the psy as new evidence.If you are unemployable because your ptsd symptoms,you should be rated 100%.A reconsideration is faster than a nod,but you have to have new evidence,your claim will go back to same person that gave you a 50% rating.Va is a little slow at giving a 100% your jirst go round even though va know that if post-traumatic stress dis-order cause you to be unable work.

  16. Evidently,your service officer thank you are asking for copy's of your c-file,that file have to come from your varo,your C&P come from fhe hospital Steve is right,just a computer printout. On your vccaa response letter ,if you check the box where it say you have more evidence,you have one year to submitt it. mobie

  19. Instead of asking for a reconsideration,i thank i will get all of the old evidence and the new together and file a NOD and ask for a reconsideration but DE NOVA "DRO".It will take longer but,i thank this is the best way to go.Suggestion ANYONE? mobie

Josephine,i thank i see what you are talking about.All of the positive things that the C&P examiner's said, and gave you a gaf of 40.I don't understand either and since a gaf is not the only thing that the raters go by, he/she (the rater)might look at the positive things that was recorder on your C&P notes.If i was you i would try to get another opinion from your private psychriatist ASAP and submitt it before you get a rating. mobie
  21. Thanks,Berta That is exactly what i am going to do,file a reconsideration,he we to a private clinic psychologist Tuesday and i gave him copys of his desicion for the psychologist to look over,so he will have new material to submitt for reconsideration. mobie
  22. This is his service connection decision. DECISION Service connection for post traumatic stress disorder is granted with an evaluation of 50 percent effective August 17,2004. EVIDENCE • Notice of Disagreement received March 9, 2006 • VA Form 21-0781, Statement in Support of Claim for Service Connection for Post Traumatic Stress Disorder, received March 29,2007 • Response received from U.S. Armed Services Center for Unit Records Research (CURR) for stressor verification • Review of your claims file REASONS FOR DECISION Service connection for post traumatic stress disorder. Review of your service records show you served in the Army for the period of February 28,1969 through October 2,1970. You were stationed in Vietnam for the period of July 26,1969 through October 1,1970. Personnel records show you were awarded the Vietnam Service Medal and Vietnam Campaign Medal. You reported your traumatic events to include after arriving at Pleiku you were part of a recovering party when a C-7 Caribou crashed. You reported the plane was still burning when the recovery party arrived. This incident has been verified. Outpatient treatment record dated February 7,2005 shows you reported waking up several times during the night with nightmares. Your mood was noted to be depressed and your thought content was without any delusions or suicidal ideas or intent or plans. Treatment record dated November 18,2005 shows you reported having nightmares and flashbacks about Vietnam. You also reported that you easily get startled with big noises. Treatment record dated August 2,2006 show you continue to have nightmares about the war and that medication had not helped. You denied suicidal and homicidal ideations, auditory and visual hallucinations. Your mood was noted to be depressed and your insight and judgment was noted to be adequate. At your VA examination dated November 30,2004 you reported being depressed and having a foreshortened perspective of your future. You reported having anxiety and being worried about everything. You reported having difficulties both falling asleep and staying asleep. You reported having flashbacks about the war at least two times aweek. You also reported being irritable, short tempered and having problems with anger. The examiner provided a diagnosis of post traumatic stress disorder which was chronic. Service connection for post traumatic stress disorder has been established as directly related to military service. An evaluation of 50 percent is assigned from August 17,2004, the date of claim that resulted in your appeal. An evaluation of 50 percent is assigned for occupational and social impairment with reduced reliability and productivity due to such symptoms as: flattened affect; circumstantial, circumlocutory, or stereotyped speech; panic attacks more than once a week; difficulty in understanding complex commands; impairment of short- and long-term memory (e.g., retention of only highly learned material, forgetting to complete tasks); impaired judgment; impaired abstract thinking; disturbances of motivation and mood; difficulty in establishing and maintaining effective work and social relationships. A higher evaluation of 70 percent is not warranted unless there are deficiencies inmost areas, such as work, school, family relations, judgment, thinking, or mood, due to such symptoms as: suicidal ideation; obsessional rituals which interfere with routine activities; speech intermittently illogical, obscure, or irrelevant; near-continuous panic or depression affecting the ability to function independently, appropriately and effectively; impaired impulse control (such as unprovoked irritability with periods of violence); spatial disorientation; neglect of personal appearance and hygiene; difficulty in adapting to stressful circumstances (including work or a worklike setting); inability to establish and maintain effective relationships.
