  1. His present level of symptom reporting would keep him from being able to function effectively in gainful employment. Ruffcreek in my opinion,it looks pretty good,the examiner is saying that you cannot function effectively while working,and gave you a gaf of 50 which is very serious,now it is how the rated see it. The C&P examiners can take up to thirty days to send C&P notes to the regional office for a rating,but usaually, it take about Two to Three weeks to get it out.When you finish your C&P you can go by Release of Information and fillout form 10-5345 and they will mail you a copy of C&P when they send one to the regional office. mobie

Look at it this way,if your transmission in your car go bad,you would take it to a transmission specialty,if you have post-truamatic stress disorder (ptsd)you just click on the ptsd forum and everything would be about ptsd. Some veterans only have but one service connected disability and with the war still going on in Iraq,there is going to be a lot of more veterans with ptsd and with the ptsd forum seperate it will be more convenient,same thing about a NOD,everything would be about notice of disagreement. mobie

Brian,when the examiner ask you was you having problems with your heart,you told her you wasn't, when you took your medication,so the examiner, and the rated figure, if you keep taking your medication, your heart would be alright.If you been diagnose with ptsd and you submit a vertifable inservice stressor and the stressor the reason you have the ptsd symptom and its ongoing,you shouldn't have a problem getting a rating.Remember one thing,never give the VA ammunition to use against you. mobie

Brian,i think you do get special compensation for ED and i believe the pay is 91 dollars a month.maybe you should call the 1-800 number and ask to get a status update on your PTSD claim.Anxiety and depression wil come under Post-truamatic stress disorder (PTSD)Va, will only give service connection for one Mental disorder. mobie

(1)OK Larry,first of all, you don't apply for compensation.You apply for a disability that occur during your military service, of was aggravated by your military service,up to one year after your discharge.If you are granted that disability,you will be paid a service connected disability which will be COMPENSATION, rated under the 38 code of federal regulation for ratings disability. (2)Question: If you apply for chapter 35 benefits and not for compensation,would that be considerate a informal claim for compensation:Answer:NO;First chapter 35 is SURIVORS AND DEPENDENTS "EDUCATION ASSISTANCE,IN other words chapter 35 is not a disability for the veteran.The veteran have to be rated 100%TP of 100% IU and TP to be eligible for chapter 35 benefits. (3)A informal claim is when you submit form 21-4138 (STATEMENT IN SUPPORT OF CLAIM)of write on a blank piece of paper and submit to the Regional office that you are filing a claim for disability. (4)Formal claim is when you file 21-526. When i had my C&P for PTSD i took a copy of statement that my private psychologist wrote for me and gave it to the examiner so he would know that i already been diagnose with the ptsd symptom.I don't thing he liked it but there was nothing he could do about.I also submitted a copy to the regional office and all of the other evidence i had. mobie

  17. 71M10,you said, you file a NOD August 2007.I wouldn't worry about the form 9 now,because a decision have not been made on your NOD.I would wait until decision is made on NOD,if your claim is denied of va give you a partial rating.Just like Betty said va will send you a SOC with a form 9 attached.If you don"t like the denier, of the partial rating,you will have 60 days to submitt form 9.Remember you can submitt new evidence with your form 9 and va could give you the rating that you want of send it to the BVA.Good Luck mobie16r

Jack,i take it you have a purple heart and a combat action ribbon if so, that is your in-service stressor,you been diagnose with ptsd at c&p and you are attending meetings for ptsd symptom,if all the above is true and this evidence was in front of the rater and he/she denied your claim,i believe you have grounds to submitt a claim for clear and unmistakable error,but remember your ptsd symptom got to be about your combat experience.(1) You have to be diagnose with ptsd by a psychiatrist of a clinic psychologist,(2)You have to have a in-service stressor (purple heart,car).(3)and in your case,being in combat cause your ptsd. Service connection for post traumatic stress disorder requires medical evidence establishing a clear diagnosis of the disorder, credible supporting evidence that the claimed in service stressor(s) actually occurred, and a link, established by medical evidence, between current symptomatology and the claimed in service stressor. 38 C.F.R. § 3.304(f) (1995). Quint7,this is what i would do, go by the vamc (release of information office)and get your records where you was diagnose with ptsd and take them to your C&P and give them to the examiner, so he will know that you already been diagnose with ptsd,since you have CAR, that is your inservice stressor,and your medical notes will let he/she know that you are suffering from ptsd,and the c&p evaluation will determine that it is ongoing.Remember to get a ptsd rating you have to have three things going. (1) You have to be diagnose by a pyschiartist of a clinic psychologist,(2)You have to have the symptom/ (3) You have to have a inservice stressor (combat action ribbon).Believe me this will save you a lot of time. Rentalguy1 You didn't see below my post that i was 100% permanent and total for post-traumatic stress disorder (PTSD).My clinic psychologist stated in my medical notes that i was not gainful employable and in the future i would not be gainful employable.I see you are only 20%,his psy might not state that, but it don't hurt to try,Just trying to be helpful.
