He served in the Army from February 28, ! 969 to October 2, 1970. DECISION Entitlement to a nonservice connected permanent and total evaluation is granted, effective November 15, 2002, date of receipt of claim . EVIDENCE "reatment Reports, VAMC Tuskegee, dated January 29, 2003 REASONS FOR DECISION Entitlement to nonservice-connected pension. Treatment records from Tuskegee VAMC shows complaints of vegetative depression, poor sleep, disorganization, forgetfulness, nightmares^ nightsweats, flashbacks and depression. This condition has been exacerbated due to the veteran's inability to work. He reports auditory hallucinations. He reports irritable mood with problems with his family. Diagnosis given as posttraumatic stress disorder with GAP of 50. The veteran is unable to secure and follow a substantially gainful occupation due to disability. The veteran is 55 years old, has a level of education reported as 12th grade, and last worked in November 200. The evidence shows the veteran to be disabled due to his disability, of posttraumatic stress disorder REFERENCES: Title 38 of the Code of Federal Regulations, Pensions, Bonuses and Veterans' Relief contains the regulations of the Department of Veterans Affairs which govern entitlement to all veteran benefits.   3. What are Aid and Attendance and Housebound benefits? Aid and Attendance (A&A) is a benefit paid in addition to monthly pension. This benefit may not be paid without eligibility to pension. A veteran may be eligible for A&A when: The veteran requires the aid of another person in order to perform personal functions required in everyday living, such as bathing, feeding, dressing, attending to the wants of nature, adjusting prosthetic devices, or protecting himself/herself from the hazards of his/her daily environment, OR, The veteran is bedridden, in that his/her disability or disabilities requires that he/she remain in bed apart from any prescribed course of convalescence or treatment, OR, The veteran is a patient in a nursing home due to mental or physical incapacity, OR, The veteran is blind, or so nearly blind as to have corrected visual acuity of 5/200 or less, in both eyes, or concentric contraction of the visual field to 5 degrees or less. Housebound is paid in addition to monthly pension. Like A&A, Housebound benefits may not be paid without eligibility to pension. A veteran may be eligible for Housebound benefits when: The veteran has a single permanent disability evaluated as 100-percent disabling AND, due to such disability, he/she is permanently and substantially confined to his/her immediate premises, OR, The veteran has a single permanent disability evaluated as 100-percent disabling AND, another disability, or disabilities, evaluated as 60 percent or more disabling. A veteran cannot receive both Aid and Attendance and Housebound benefits at the same time. mobie
  4. mymissie,before your friend cash his check go to the department of veterans affairs website and click on compensation and pension and than click on the pension page and read the information on countable income. You can't get A&A unless you are getting pension,but just check that web site out because i wouldn't want what happen to my friend happen to him. mobie

Carlie and Berta i am helping this veteran that was granted a pension by the va in 2002 for PTSD and he was also drawing social security disability,his veteran service officer submitted the claim for pension and he was not suppose to be receiving pension and when va found out he was drawing social security disabilitiy, va stop paying va pension and garnish his social security check.He came to me for help in May of 2005 and i asked him had he ever filed a claim for PTSD and he said that he had never filed for PTSD.I went ahead and filed a claim for ptsd and i find out in March of 2006 that his VSO had filed a claim for service connection PTSD in August 2004 and his claim was denied in March of 2005 because he did not have a in-service stressor, his claim had Two weeks left before it would have been closed-out and he would have had to reopen it.I filed a nod and asked for a DRO and in the mean time i did some research in the units that he was attached to in vietnam and i found him a in-service stressor,it took over Two years,but he was service connected 50% in September and the Two years that he draw Pension for PTSD va deducted the remanier which was about fourteen grand.I thank va was wrong for that because again va was paying him pension from 2002 up to 2004 for PTSD.I thank both of you for your response. mobie

Remember now Christopher,a Division Review Officer (DRO)is located in your regional office who can give you a higher rating, and if you are not satisfy, you can go the traditional route,which is the Board of veterans appeals (BVA) located in Washington D.C. Now that i said that! You asked for your claim to be review by the DRO,evidently IRIS response was quicker than the DRO election letter and, If you resubmitt the DRO form thats ok.The DRO will handle your claim,but this is done on a claim dated basic.which means there could be quite a few claims ahead of yours and if i was you i would not request c-file,because it could delay rating of your claim.I hope this helps. mobie
  7. If a veteran is granted a NSC for ptsd by va and two years later file a claim for service connection compensation ptsd, and get it granted.Can it be retroactive from the date that va granted NSC? Thanks mobie
  8. mrsvet28,I am sorry about how things have been going for you and your husband.Although IU is a seperate claim and more than likely IU becomes moot if your husband is ungainful employable because of his post-traumatic stress disorder(PTSD).Just to make this simple.If he been diagnose with PTSD and have a vertify in-service stresssor and can't work because of PTSD va is suppose to go ahead and rate him 100% service connection.   9. (1) Diagnose with post-traumatic stress (PTSD) by a psychiatrist or a clinic psychologist. (2)Inservice-stressor: Examples: Medical records of incident, Records showing that you filed a claim,and Letter from your roomate that stressor ocurred (3)One and Two corroborate I hopes this helps. mobie16r 100% PTSD

Johnny,i see you was given a 0% service connection for ptsd and i also see at one time your gaf was 55.This is what i would do,I would file a nod and ask for a reconsideration of my claim.You already have the service connection,you just have to show that it have worsen to get a higher rating,but i would make sure i submitted evidence where i was given a gaf of 55 before, and if you have anymore evidence that you have been seeing, a psychiatrist of a clinic psychologist i would submitt with my nod.All the medical evidence that was not submitted,you need to submit because on a reconsideration va review the evidence again that was used to rate you 0%,but will review the new evidence.When filing a nod and asking for a increase in rating, va made just considerate the date that the the nod was filed,But when asking for reconsideration,your claim will be considerate from the original date it was filed.   13. Gary I am not Berta,but this is my advice to you go ahead and send in evidence because Bva will have to look at it.Make sure you write your claim number at the top of first page and send it certified mail with return receipt ASAP. mobie
  14. Bound, He is 71 years old,his 100% probably is PT,so he wantn't have to worry about another examination.I don't know anything about Mexican banks,but if he can get direct deposit there and thats what he want RO shouldn't have a problem with that because it his money. mobie

Josephine, you have a good private psychologist she corroborate everything in your medical records from your time in-service, private treatments and vamc treatments.She was very thoroughness with everything.The IME stated that your medical condition frist manifested in april of 1971 and he/she also said that it was as least as likely as not that the condition did not ocur in service.That is the reason to have a private psychologist or psychiatrist,because she/he know more about your medical condition.Congratulation on a great win! mobie16r

  17. chief,If you would have filed a nod and ask that your claim be reconsider from initial date may of 1966,your effective date would have been May of 1966 but i see you filed for increase sept 6 1966, this might be your effective date.I hope that va taken in consideration that your ptsd symptom was condsider unemployable by your private doctor June 1966 and make that your effective date.Congratulation on your award and i wish you GOOD LUCK on effective date. mobie

  19. I am trying to help this veteran.He is 50% service connected for PTSD.On his progress notes from the Va which was sign by a Psychiatrist. Axis I:1.PTSD 2.Obstructive sleep apnea(on CPAP) 3.Dysthymia Axis II Blank I have Two Question (1)Can he file a claim for sleep apnea seperate or secondary to ptsd? I am helping this vietnam veteran that is 50% service connected for PTSD.This veteran fell while he was in vietnam and sprain his Right ankle and right knee and he have medical records that he was treated for pain on his ankle and knee six of seven times while he was still in the military and also records since he been out.He had surgery done on his right knee and also a left hip replacement.Is it possible that his problem with his right ankle and right knee cause him to have problems with his left hip.I am trying to get him to file a claim for his knee and ankle and secondary claim for his hip.Like i said before he have a lot of medical evidence and i am not a medical doctor,but i beleive that by having to put weight on his left side from right knee and ankle injury cause problems with his left hip after so many years.i beleive he can get a Imo.This is a great board for helping veterans and i am sure someone can give there opionion and what he need to do to get connected for knee and hip. Hello,Josephine This is what i thank that happen according to what you typed .The va Denied your claim in March 2004 on what evidence they already had but, they received new evidence in April 2004 from the National Personnel Records and that evidence was enough for your claim to be reopened.Now that i said that i don,t thank the va had any evidence before that you had been treated for an anxiety during your Military service now, that they have, they will consider all of your private psy record.You cannot get a service connection pension because you are already making more than va allows.Compensation is better than getting pension,more money and no tax taken out.Va probably will give you a C&P because of new evidence.Hang in there and good things will happen. mobie
