  2. Hello All, Wow this is a subject that comes up alot. I would like to bring up some really critical points. 1. Are you in good enough health to wait a long period of time? Some of us are failing fast in the health area and cannot afford to wait on a VSO or the VA and their timetable so you will have to be the judge in how much time can you afford in the process of adjudicating your claim. 2. Do you have a complicated claim with multiple health claims with the VA? This sometimes can mean a longer period of waiting decision with more time to adjudicate your claim and of course, more time to have to have to wait for appeals and decisions. I agree with Pete that there are folks here that can help you in meeting your timelines. You do not want to let them slip by you. Jbasser, John999 and Carlie are very , VERY , well versed on the CFRs and have been around the block with the VA and can understand what the VA does and does not do. Carlie has said that she personally would not use a lawyer and I believe she could single handed whip any of their DROs on the VA law and how to make them cry uncle. She has already been thru it and has successfully whipped up on them. I wish I had her tenacity and perservance but not all of us have Carlies knowledge and fortitude. I tend to agree with Jbasser and John on getting a lawyer to help you because of my last statement. I have a lawyer only because my claim is very intense , complicated, and HUGE. I also do not have my health in order to fight with them at this point. Yes, a lawyer by law can only collect 20 percent of the retro when you get paid or 25 percent if it goes to court. As Jbasser pointed out , it was not too long ago that Lawyers were allowed to represent Veterans in their claims. (Claims decided after June 21, 2007 when the law changed). This is a huge benefit to the Veteran as far as fair representaion early on in the claims process. The law used to be that the Veteran could not have a lawyer until they reached CAVA. I would not under any circumstance , allow a VSO to represent me. Been there and done that. DAV and Vietnam Veterans of America is who I had early on. I had 4 Service officers with DAV and only one was competent. I had one with the VVA that was good but then he got too sick to even take care of himself. Boxer , you still are fighting with the VA after 13 yrs and have not gotten to 100 percent. I do not know your service officer and he may be a good one but going to lunch with the VA is not what I want my service officer doing. You do get what you pay for and so did I. I wasted alot of time and the DAV single handedly screwed my claim up because they did not know me or my claims personally. Nor did I have the knowledge that I do now to have helped them bringing the claims forth properly. These Service Organizations are all understaffed to take care of the numbers of Veterans applying for benefits. Noone takes better care of the Veterans records and their claim than the Veteran does. It takes years of work to learn the CFRs even to a degree of having a very simple working understanding. Their really is noone that knows it all . It is a continual process of learning even when the VA law is changing yearly. Now I want to bring up a very important fact . The VA is using the Dept of Justice lawyers and they will pound the best VSO rep into the ground. We cannot expect a VSO to have the education and skills of a lawyer , but thats what the Veteran is up against. If someone does not believe me , then look up the BVA decisions and the representation of the Veteran. American Legion, Vietnam Veterans of America, Disabled American Veterans, AmVets, and so on. It is sad as to the number of denials. If you read these decisions and I have read at least 500 plus or more then you will see that the claims were very poorly put together and poorly represented. This does not mean the Veteran did not have a legitimate claim. It points more to the fact that the claim was lacking in Medical Evidence, Scientific Evidence , and Service Records and the bringing forth of those records/evidence in such a way as to tilt the Benefit of a Doubt rule scale to the Veterans advantage. I will take a lawyer over a VSO anytime........I just would never bring a knife to a gunfight.....Lets have guns verses guns ...and that what you are dealing with when you are up against the BVA and the Dept of Justice. Your hired gun against theirs. Also remember that the VSOs are all paid for by the VA or out of the DOD budget so there is a conflict right off the bat. They get paid ,,,even when the Veteran looses. If we were to take a poll on how many veterans here started out with VSOs and had to get lawyers to win their claims, it would probably be horrifying. I know alot of us have already been there and done that. I would much more trust our folks at Hadit to do the job for the Veteran than any VSO group period. We have some brilliant minds here and they have already proven their knowledge and track record with the many veterans they have helped. It is so good to read our success story topics and how the victories just keep coming in. I wish I would have known about Hadit early on and not got my claim so screwed up , but this is a learning curve and experience is what teaches all of us, and eventually what will win in our claims efforts. As Jbasser said, if you could get Bergman and Moore to help you ,,,,, I feel you have pretty much gone to the top of the food chain. They are proven and know the VA law. I have a very fine lawyer and she told me that 5 yrs ago she was getting 225,000 inquires from Veterans and their families or widows to seek representation. She could only handle 25 a yr. That is how hard it was to find a good attorney and trying to get one to represent you. The only reason she took my claim and that means I am one of the 25 of 225,000 , is because of my very strong evidence and medical records. She now handles 100 per year with the help of an assistant and secretary. That is still hard to realize how great the need is. There are more and more lawyers coming into the certification process to practice VA law, so this will help our Veterans Lawyers numbers grow , but it is still way behind. When you have a lawyer , you have equaled the playing field and then the VA has to fight fair or the law will be called into play in favor of the Veteran. If you research the BVA decisions that show a Lawyer represented the Veteran then the number of denials does go down and rightfully it should. Yes it may show remands , but also alot more claims granted too. I am like Jbasser ,,,, I don't have the time and certainly not 13 years or more and I am not going to play Russian Roulette. Sooner or later your chamber comes up and the gun goes off on you. And it takes way too much time to go back and fix it. I have a claim that is going to be precedent setting and it is very indepth .I am also involved in a Malpractice lawsuit/FTCA/TORT and a Section 1151. John999 brings up another point. You want to perfect your claim as early as possible and it would be nice to not need a lawyer until or unless you get to CAVA ,,,,,then you better have one for sure as you will get slaughtered. It is all about the VA trying to outlast the Veteran until the Veteran dies. If the Veteran is not dealing with lifethreatening diseases or injuries, then maybe the Veteran can hang in there for 15 or 20 years and just use any VSO the Veteran wants. It is all about the Veteran winning their claim and within their lifetime. If the Veteran dies and they are still at 50, or 60 or 70 percent then the Veterans widow is in for a real fight for her DIC pension and benefits. Dolphin you need to get a decision and then when that is done try to stay on your timelines. C and P exams for the most part are a joke. QTC will not use your whole record , only what the VARO sends them. ( Read your appointment letter and "Do I need to bring my medical records")This automatically makes the majority of their decisions faulty. In almost every instance it will require a time consuming appeal and then your IMOs which I hope you have, which will shoot their Medical opinions down.These will be necessary for you to win. Most of us here have been through the C and P route, and have had to bring forth IMOs and evidence that was "overlooked" or even ignored , to properly appeal the VARO decision and keep the claim moving forward. As Pete said stay on your timelines. If your claim is not too complicated and fairly easy then one of our folks can help you and you may not need a lawyer. If your claim involves alot of retro backpay then you may want to consider a lawyer. I want to win my claim and not allow the VA to run over me anymore. Above all Dolphin please remember to not get discouraged, that you are among a great bunch of folks and as a team you will win and especially and importantly.......NEVER GIVE UP. God Bless, C.C.

  4. Hello Wings .... it is bad at the Va and the amount of time to get anything done now. I thought the form said "as part of the Paperless Reduction Act"...... It is suppose to help you not have as many problems and to expedite the task that the Veteran is facing. Instead its like ....add to the mountain by each stone you pile up and when it gets to a certain level we will think about its height . But that will take another letter or bill also. The reports are now archived here so we can pull them up and thats what is good for the Veteran. Too bad the VA doesn't learn from Hadit how to manage its affairs.   6. I hope this story will get to our vets by the link I posted. This is HUGE.....many of us have already had problems with the VA and the fee basis problems. It will especially be huge to the heart attack/stroke veterans who have to get to the nearest medical center and cannot bear the cost of emergency room fees.   8. Hello Chuck, You bring up a great point. Its like I said in an earlier post. Its all up to what side of the fence you are on. The VA does not want to take the severity of the veterans health. Though this chemical exposure issue to be archived is for ALL chemicals, we know that a great number of veterans and their families are Vietnam Era so we deal mostly with Agent Orange sites. However it is a tremendous problem when you have to literally prove you were exposed when the chemical was there. James Cripps and Kurt Priessman won their awards outside of Vietnam and they have the diseases to prove it but many of you here do not know the hard evidence they had to come up with to bring the 38 CFR 3.102 Benefit of a Doubt Rule into play. I personally believe that this law is highly abused by the BVA and the courts and it is more than the equal equipoise and 50/50 scale. The VA does not care about the Vets and the way the regs are written puts up huge task for the Veterans and their families. If we look at our Hadit members and the battles we have faced we will see that nothing is easy with the VA. I personally have becomed very challenged in my battle and I really cannot do what I want to do because of my lawyers request. My personal goal is to help every Veteran I can and to be as big a problem to the VA as possible. That is why posting all the contaminated sites we can will hopefully help our Veterans and one day it may open the door for the next group. Please remember that the Agent Orange of the 1960's and the 1970's is the "Gulf War Syndrome" of this decade and its Vets. This group of Gulf War Vets and Afganistan Vets will face their own Giants with Chemical exposures and their fights are going to be monumental. This is why the fight has to start now and with all of us trying to pitch in. Thanks again for all of your input and efforts......... It is for all of our Veterans and their families. NEVER GIVE UP.   9. Hello Mike and Boomer, Thank you for your imput and these sites. Alvin Young's work is not a stranger to this site and his studies and reports have been posted here in the past and have helped to add to the growing list of sites. As more and more sites are added and updated we will hopefully see more Vets that can use this to their claims. Unfortunately the VA wants documented exposure because of direct exposure claimants. This can be used as casual because the VA has already admitted to casual exposures may be harmful to a Vet. Yet they like to use this wording to deny , but when appealed with proper medical nexus , we see a number of these are ruled against in appeals process.   10. Hello Walt, From what you have posted I believe that your C and P exam may not allow you to bring anything to it. If your dealing with QTC then the VARO will supply only what they want the examiner to have. This is not fair as they typically will leave out much of the record and will not be a complete use of your records. So the end decision from QTC will usually result in a faulty decision. One that you must appeal to proceed further. If you look at your letter ordering your C and P exam you will probably notice under.. "Can I bring or Should I bring any medical records" and they say No. The VA will supply all of the records for the examiner. YEA RIGHT..... Been there done that. On my first C and P exam , I brought an important one page report that should rate me at 100 percent P and T. Now fortunately , I already knew the QTC doctor and though he had only what the VA sent him , I did show him the report and he was very curious as to when and where this report was. Though I am still waiting on the results from the C and P , I am hoping that he was able to comment on it. It is in my Cfile also. That is something you should make sure of . That all of your reports are in your C file and of record. Now the 2nd C and P examiner was totally different and I knew that no report would be accepted by him as he totally changed all of my previous records of evidence and not in a good way. I did not waste my time commenting to him once I saw his direction and being a clown in a doctors costume. That C and P result will be best be ready for appeal at the next level and then its my turn to shoot his opinion down. If it was me and you can get Dr. Bash to write you a favorable report then by all means do it. If you can get it in the C and P exam , good for you. Though I feel that it probably won't fly at that level. However I feel that you must get this to the next level of appeal and get your evidence into the record and as soon as you get a decision. I would not do it until they make some decision ,,, good or bad. You really don't want any more holdups but now a decision , so you can move forward. If you cause them to maybe pull your file, it can add months or even years to your claim. Its in their court and let them serve you the next volley so you can get in writing their decision and what they are asking for next and then formulate an effective appeal with your evidence and your IMO's firing at them. All of your evidence should be put into the record and noted as such but I would make sure that you do it in a way that will not result into alot of delaying tactics by the VA.   13. Hello Carlie,,,,, I remember when James won his claim. It was really something and his story of how it all unfolded to fall into place to win under the direct issue was almost like a mystery novel in itself. Now that we have irrefutable evidence with the DOD list of Agent Orange bases and the Training seminar posted with the breakdown of locations in the United States and in Alaska we should see more and more claims granted as evidence now is more readily available and the claims are meeting the requirements to award a claim. It is just getting too hard for the VA to defend when the Scientific and the Medical Evidence are just too overpowering . Its a shame though that so many decades have passed and countless Veterans also who were not able to get their hands on this evidence. Carlie, can you remember the people that still ask all the time ,,,,,,oh you were exposed to Agent Orange.......when were you in Vietnam? I hear it all the time. The government sure pulled the wool over the publics eyes for many years but now its starting to fall on the veterans side,,,,,,,just too little, too late. I think I remember when you also hosted a show with our own Thailand Veteran and it was not too long ago that Kurt Preissman won his Thailand award thru just pure tenacity on his part. The more these sites become tested positive for Agent Orange and the Medical opinions are moving favorablely toward the Veteran then the more the Agent Orange site list will grow. If we look at the list now, it is astounding just at the number of places in the United States that have Agent Orange on them. The public just does not know or have a clue.   16. Hello all Members of Team Hadit.com I have an important team work project for all HADIT MEMBERS. HADIT IS GOING TO TRY AND STORE ALL KNOWN SPRAYING RECORDS anywhere they showed up and "We" thats "us"are going to try and archive all information here. Actually there is a lot already stored here in the Archives of Hadit. However it will be free and no more FOIAs to our members to use the chemical library that we will have and those here applying for claims related to chemical exposures. This one will require all of to find the spraying records for not just AGENT ORANGE but all other chemcial thruout the planet EARTH. Our parameters are set forth and consist of time , date, place and amount sprayed . So I have post the DOD required reports form numbers so now we have to get them with data filled out. Each one of us has pretty much said at one time or another , "we heard it was sprayed "......... or "it was stored here"....or we heard it was used there. Sorry this one is not talk or heresay but the real deal. I think we all have Hadit with trying get those records from the government and then after years of trying we fail. WE NEED THOSE REPORTS from the bases I listed for this library to grow. The Herbicide Training Seminar number with the break down of the bases is a start. So now we need these reports from ALL areas to get this library going. Someone had to post the Installation Assessment Report for Gerstle River Test Site and the Materials Application Training Seminar. If we can get a few more people to post these other reports then it will be stored in our Archives. Ok, now lets start our test reports and start our very own MASSIVE LIBRARY which will be used by all Veterans and will be archived here at HADIT. To win our claims and those of others. Once it gets big enough then we could possible be a "friendly" repository of sprayed and applied Herbicides and chemicals reports compiled data which can then be used by ALL veterans , service organizations and lawyers to tap into. So I will go first listing the : DA FORM 2785 or 2785-R DD 1532 Evidencually there will be websites we will have onboard to divide up the sites. It will not be easy but lets see what happens and our library should grow and be a welcomed site to all veterans and their family trying to find records on spraying and chemical exposure sites with the DOD forms to back it up. http://www.gulfwarve...ely/greely.html The Fort Greely Installation and Accssment Report for Oct 25, 1998 of the Gerstle River Test Sight. Open this site and you will see the acutal gallons sprayed and the relationship of the spraying records to gallons applied to the site location listed. This report shows the correlation to the chemical used and list them even listing the same form numbers. USING THE REPORTS DD 1532 and the other one is the DA FORM 2785 or 2785-R. These reports are for any site and worldwide...... So now Hadit detectives , get our own library to win those claims.   18. Hello All, I have copied and pasted this information so it will appear in the correct topic under Agent Orange and to have it Archived for all Veterans to be able to use. The topic appeared in the General discussion topics but due to the fact that I carefully listed the Materials Training Seminar in 1973 which is located in the Archives here and now have broken down the actual location which will give more information rather than the list that appears with the corresponding number, the person sent to training , and the name of the post. Most times these locations on the list does not specifically list the actual location, but only the depot name. Now it is broken down to show WHERE these locations are. It will take research to put the connection between the location , the state environmental agencies or Federal agencies that will be monitoring these sites. You may also try ATSDR, EPA, Corps of Engineers Reports, BRAC or even private Engineering companies that were used to help remediate and clean up these contaminated sites. PLEASE REMEMBER these sites had personnel assigned to the roster that are on the list for training in Colorado Springs Colorado in 1973 to properly, store , mix and apply chemicals , herbicides and Agent Orange to these locations. This topic will hopefully open the door for other Veterans to research to possible link any Agent Orange diseases which may fall under the Direct exposures issues criteria for a claim to be filed under VA guidelines and 38 CFRs. I also am including the parts of the Perpheral Neuropathy links to the BVA decision awards granted that DO NOT INCLUDE Diabetes II Mellitus awards. These are very unusual decisions but proving that PN can be awarded with the Diabetes II diagnosis as listed in the 38 CFRs for Presumptives list. These decisions can be used in the Veterans claim to site precedence case for PN with Diabetes II. AGENT ORANGE CONTINTENTAL UNITED STATES LIST FOR TRAINING SEMINAR BREAKDOWN LOCATIONS First thank you all for your research and study to bring documents to the attention of our Veterans and their families. As many of you know my battle with AGENT ORANGE outside of Vietnam is proving quite interesting. Both Jerrel Cook and I were stationed at the infamous Fort Greely. And both of us are suffering from nearly identical same list of diseases . To name a few, AO IHD, CAD, ATHERSOSCELROSIS, PERIPHERAL NEUROPATHY, RESTRICTED LUNG DISEASE/COPD, PULMONARY HYPERTENSION, INFLAMMATORY BOWEL DISEASE , DRY EYES, AND some others that I will leave off for now. 2 of our members have already passed away last year. One from this site and the radio show. Mr. Carlos Hope . I am going to first say that James Cripps is the first award inside the CONUS for agent orange and DIRECT exposure issue not presumptive. This is the only sure way to make it work. Berta has posted another from Alabama . James was at Ft. Gordon Georgia which is on the list of known AO bases. I have posted the list a couple of years ago here in the AO section of Hadit and now thru an all day search of the names that showed up on the Materials Training Seminar Conference from Sept 1973 . If you read the list with the names on it you will see only the location with no specifics. So that means you have to look up the location to find a more accurate description. What I have done is simply made it more accessible to at least know where each place is in the Unitied States. I would use wikipedia to fine tune all there is to know about the location. OK ,,,so if you go to the list and see the number to the left you will see the name of the person to attend and the installation he is from . What I have done to make it alittle easier is put location to the number linking the person and location for to help. It took nearly 5 hours just for this part. It is also helpful because you may know some of these folks whose name is listed by the number. I knew Harold Teiken from Fort Greely and worked with him. Maybe this can reach some whose names are here to help them with any health related military exposure issue. I will point out that the Fort Greely reservation and all EPA records are now joined into the Fort Wainwright , Alaska records. So the link that Boomer posted will not show that broken down that far . This happened in 1995 when the US Army Strategic Missile Defense Command was titled and assigned to Fort Greely. A brand new agency and if you look at Fort Wainwright under the EPA superfund list in Boomers link you will see how the acreage jumped to nearly 900,000 acres. This is because when Fort Greely was given to Fort Wainwright's jurisdiction and it added 657,000 acres from Fort Greely. The Missile Defence command at Fort Greely was assigned about 1700-2200 acres for its agency and the resultive Interceptor Missile Program .....aka ......STARWARS.... So it will not be easy to find alot of the old contamination problems there at Fort Greely like before. However I would like to point out that you can still use the Alaska Dept. of Environmental Conservation records stored at the Fort Greely Restoration and Advisory board and other ADEC records listed all the Agent Orange site and storage with METHOD I II or III cleanup , remediation efforts and their controls on each site. This is very important. Irrefutable evidence. I would also look at the new report I posted last month....the one that was taken down by ????? outside of Hadit and then mysteriously put back up. The 49th Missle Defense Command and the 2007 Environmental baseline report which shows the Agent Orange sensitive contaminated areas as well as the storage bldgs use.Including Asbestos contamination bldgs, and SM1A Nuclear Reactor site with many OTHER contaminated sites of COC. Very good close up shots and aerial/satellite photos with areas highlighted for areas of concern are also found in this report I would also like to point out that the presumptive list for most of the AO awards are for Vietnam boots on the ground with Neimers and BWN starting to gain some momentum. James Cripps won his AO CONUS award at Fort Gordon , Georgia and I have his award . He won on DIRECT exposure and that is what I am following. I also have some of his evidence in my claim with letters from Dr. Arnold Shectter (SP) who is a leading researcher on Agent Orange and the University of Texas Health Science Dept in Houston, Texas. I am thouroughly convinced as well as my fellow Fort Greely soldier , and SVR Host, Jerrel Cook that the Dept. of Defense will aggressively fight any EXPOSURE ISSUE from Fort Greely because of the sensitive nature of what Fort Greely is. It is , has been the most secret military installation in the world..... since the 1960s and nothing has changed. They (DOD) will not let out all the test that have happened , including Project 112, the Nuclear Project regarding the SM1A reactor , now entombed????, and the Missile defense Work,,,,,, and of course the HAARP project and whatever else may arise. That is why there is now 900000 acres of land there to test without risk of harming large populations , unless you are a moose or caribou. So for people like Jerrel and I who are still alive it is going to be a battle. Even with my strong IMO's, phyiscal evidence , SMR, and even VA medical opinions. If it was anyplace but Fort Greely ,,,,, there would be a chance. Hopefully because of how much time has gone by and we have lost a couple of Hadit Members who were stationed there , Jerrel and I hold on for proper decisions. That is if we can live longer than they make us wait. Also there is an award posted on an Agent Orange claim for direct exposure and it is stored here on our site under the Haynes pipeline information. It is the only one I know about at present. There are several more CONUS awards because of James Cripps efforts and we will see more BVA writeups with specifics , soon I hope. So.... what I believe has been discussed in the years past. Berta and I have posted alot on this subject. I would not try any presumptive exposure effort outside of Vietnam or now Thailand. I would go with direct exposure. You can use the research I aleady have shown here in Hadit library showing BVA WILL award Peripheral Neuropathy WITHOUT DIABETES II DIAGNOSIS. (See Dr. Durham and Dr. Yeng for 2 awards at BVA both DIRECT exposure) Notice key word, phrase, "remain latent for up to decades" taking out the acute and subacute ruling and using the chronic award. You will and may find it important to make sure you use these 2 awards for quoting in your individual case as they are precendent setting only if the Veteran brings it up to the court or VARO. Do not count on the VA to bring it up to you as precendent setting as it is not requirred in VA law. This part of the law needs to be changed. I may post some of those here to help others if I feel better later. You can look them up under the AO issues and my content. I wish all of our few surviving Agent Orange Veterans well and to please study and do your research before we all are gone and no one left to fight for . Thank you all for such great dedication to this wonderful place we Veterans have as a sanctuary. Your help and hard work is what makes this all possible and a place where we can gather , glean, share reports , knowledge to propel our claims in a faster , more accurate , and sensible method to achieve the elusive goal of Service Connected and the bounty of the FAIR award.   19. Hello Mike.... It is so important for all of us to make sure things like this are posted and archived here. Though I have the Fort Greely DEC and I think it is archived here , I would like to point thislink to this site down near the bottom of the page you posted to the Fort Greely Restoration and Advisory board. It has historical data stored there and can be researched with lots of information there for use. I would like to caution that sometimes data from this site gets remediated and the site could end up closed and the information then may not be publically available. I would copy any report on any site and then print it off. It was only last month that the report on the 49th Missile Defense Command Environmental Baseline Report 2007 went into HYPERSPACE when it appeared on this site when I got it posted. It mysteriously reappeared about 6 hours later. I have not read the original report to compare with the new one that reappeared yet but plan on. I have had this happen before with some sensitive data and some has been lost forever due to me not printing it immediately. DOD does monitor sites and can easily take down and then mysteriously its gone. The Restoration and Advisory Board material is changing due to the 5 yr review on sites and the change of Method 1, 2, or 3 levels of remediation. Once a site is thru with on going inspections and passes a clean bill of health , it is removed to an inactive site status as you can see if you research some of the sites. The problems with Fort Greely are huge and as one can see , if there was not a problem or a lot of problems there would not be a need to have a Fort Greely Restoration and Advisory Board.   20. Hello CCC,,,, I understand perfectly where you are and know what you have on your mind. To put it simply ......it is overwhelming. I know that I have loaded your dinner table with much information but it does take research and work. This is where I was 5 years ago also. Every veteran on hadit.com and its elders and moderators had to start just like you and I did. But with the help of ALL of us pulling for each other , there is strength in numbers and in being able to help each other . Each member having some great strengths to add to your need. Alittle here from one , alittle here from another and above all time to grow and to sort thru this. Please remember that you will find that one day you will be trying to help another brother or sister out that is trying to fight this huge Giant we all know as the VA. I have found one thing to be very tragic,,,,, that is researching the VA and the court and BVA decisions that result in so many denials. Mainly because of poor representation and or poorly administered claims put forth. OR BOTH. We are so fortunate to have such a great battalion of seasoned warriors, each armed with specialties. Not one of us that knows it all but all working together.... GUNG HO, as we see the many success stories because of the teamwork and the spirit here at Hadit.com. Each one of us having our special gift that goes with another. It is truly amazing. Just try and pull up the archives and look closely at the reports in the library here and then try to understand the process and what wins claims from the success stories from all of us here. I too am looking forward to my day when I can post my own success story and to thank all the folks here who offered me help and encouragement when I was overwhelmed and nearly defeated , not just by the VA but by these diseases and the hospitals and recovery periods. Try and think about your getting your claim organized with your evidence which you get thru your research , the presenting to your doctor to help them connect the dots and then your IMO's which can make your claim turn into an award. We all here at hadit can tell our stories of messing up something early in the claims process, that we wished we had not done , but that is part of what you would advise a veteran not to do with his or her claim later. Each one carrying the torch for justice. I just hope that the research and archives will help you in your efforts and don't be afraid to think outside the box of these different places and getting with these other agencies to get reports that could be beneficial to you and your claims process.   21. Hello Mike, I tried to open the link but could not. Please try and post it again but where it will be able to open from the post here on Hadit. It is most likely that I have all of the Alaska Dept. of Environmental Conservation (DEC) , including Fort Greely Restoration and Advisory Board information. I probably have the largest library on Fort Greely. It is incredible what all is available. I probably fished at the same locations. Bolio , Twin, Big Lake,,,, and ran around Blueberry , Black Rapids , Trident Glacier, Molybedium Ridge, Delta Range, Texas Range, Gerstle , Little Delta Creek, Washington Range, Oklahoma Range ,,,just for a few. Why it would not surprise me that our foot prints might be in yours and yours in mine as we trudged thru those wilderness trails. Quite contaminated I might add alo. I have posted quite a bit on the site about this place called Fort Greely and concerning the other agencies reports. Again if you can repost your link directly where it will open on the page it may help and I can tell you if I have it or not.   22. Hello Papa, This sounds like me too...... I also had multiple issues and wish I could have just zeroed in on the biggies and left the others alone. Yes , I would agree that simple claims with less material to go over usually can be processed faster to some degree , not always. It is still a process and if you have one claim or 20 it is still as Carlie put it a PROCESS. It takes time. No , I do not think they are picking on you for multiple issues. If that was the case, I would be the most picked on veteran in the claims process and just down right abused. I personally would leave it alone and let the VA do its work and get to the next part of the process. LOL at what John said. Yes they screw up even the simpliest of claims so just hang in there and be patient. NEVER GIVE UP. God Bless, C.C.
  23. Hello John,,, you are exactly correct and that is why Vietnam veterans have been excluded because of the PRESUMPTIVE exposure issue verses the direct exposure issue. It took along time for Congress to initiate the Agent Orange Act and to allow this into the VA as Presumptive. It effected hundreds of thousands of people that were able to "prove" the incredible harm that Agent Orange caused. Unfortunately , Mr. Lane Evans was not reelected and his efforts died out with only a partial list now on the accepted bases. Our own Kurt Priessman won his Thailand award and was responsible for getting the evidence brought forth to succeed. Now we see others from Thailand and Korea, and Fort Gordon , Ga that are also following. It is so shallow for the VA and the DOD to use the accepted and not yet accepted list for Agent Orange. Its like saying if you are on this side of the fence then we (VA) will accept responibility but if you are on the other side of the fence ......well sorry about that....just your bad luck that you were not in my pasture. Is there any doubt at all that Agent Orange was used in the places I listed and broke down from the report I posted on archive now at Hadit on the Spraying Seminar in 1973? The report speaks for itself. Is there any doubt as to the use of Agent Orange at Fort Greely , Alaska. The evidence again is overwhelming yet the accepted list shows it did not show up on it. This will not allow a Presumptive claim to proceed and as almost all Veterans outside of Vietnam must show , a direct exposure issue with lots of evidence and hardened IMOs' that will trigger the 38 CFR. 3.102. Benefit of a Doubt, to even think about succeeding. You make a good statement John and that is why the DOD and VA are not going to help. Even though we know the spraying records DO exist. They are not going to release them . Even with FOIA and congressmen and senators. It will take a whistleblower who has access to these records to leak them out. This is not a case of national security but a case of deception to keep our service men and women and their dependents from getting the benefits they earned and deserved. Its not fair but then again what is fair when you are dealing with the VA. Personally ...... the VA needs to be dismantled and start over. We have too much at stake and so do our loved ones.   24. Hello ,CCC, Mike, BigRed, Boomer, I would like to bring up my earlier post to this and maybe add some other information. When Congressman Lane Evans put forth his initial work to get post and bases , areas, not listed on the Agent Orange list from DOD , he simply ran out of time. Hence all we have is what you see posted on the VA sites of Herbicidal useage. There are still many sites inlcuding Fort Greely which did not make it to the site. James Cripps being at Fort Gordon and the needed information of showing documentation that Agent Orange was in fact there made his claim more winable in court. It was still a huge task for him and he did not win under PRESUMPTIVE , but under DIRECT exposure. I would also like to bring up that in this threads early posting the 2 forms that the DOD and the Army have to use to apply any herbicides or dangerous chemicals to any military base or installation. These are mandatory forms. NOW HERE IS THE PROBLEM..... You can FOIA the information you want and specifically list these reports and the dates you are searching for. However the DOD is NOT going to allow release of these forms. If you succeed in this FOIA , it will be a first and as far as I know of not one instance where someone has gotten their hands on these reports from any location period has succeeded. I have posted here at Hadit and it is in this thread. the Heribicide Training seminar from 1973 showing EXAMPLES of how the report is to be filled out and even the persons that had to attend the mandatory training in that year from the depots , bases located in the United States. This form is archived in Hadit.com and I even just recently broke down the location by numbers according to the report to help others with their search. Now this is certainly enough evidence to use to help in your claim and I would use it but the actual records are still not going to be released. You will have to use other avenues and dept., agencies to show useage or contamination of those areas in question. The Backdoor approach. Much like I did with researching the Corps of Engineers reports, The Alaska Dept. of Environmental Conservation, BRAC, ATSDR, EPA, different contract Engineering groups, and several agencies that supplied irrefutable information that showed Agent Orange was at Fort Greely and used extensively until it was banned in 1975. I have even posted the Installation and Assessment Report of Gerstle River Test Site , Dec 1976, showing the number of gallons sprayed and what was sprayed , as well as VX and Sarin gas testing. It will take you many , many hours of researching , and documentation to close the loop. You must show the chemicals were there. That you were exposed to them, and then the connecting of the chemicals and your disease or diseases with a solid IMO if not 2 of them linking them to your disease. It must be in the proper wording to trigger the CFR 38.102 Benefit of a Doubt rule. We can talk about this person said he saw someone spraying it and this person , and this person remembers he saw barrels on the tarmack and so forth , but it will not do you any good at all unless you have reports from the agencies I have listed showing the contamination. You just about have to use the backdoor approach and find out like I did that many agencies are trying to monitor the contamination and cleanup or remediate those sites. This is the hard evidence needed to prove it was there. Linking that to your exposure is what has to be done and your doctor IMO will be the only way to win in court. I am going out on a limb and say that almost every single claim for exposure to Agent Orange in a Direct exposure issue WILL NOT BE DECIDED IN A REGIONAL OFFICE. It will have to be awarded at a BVA or even higher court. James Cripps and I have talked at great lengths about this issue and he will agree with my statement. I would also like to point you to the fact that Agent Orange can remain latent for many , many years. So this is a mute point that you have to be their while it was sprayed. You can research this and find much on this subject, including Dr. Arnold Schectters research on it. He also helped James with his claim and I too have used this research. I would like to add that though I have 5 different doctors that have opined on my illnesses and the resultive Nexuses that have included Agent Orange, I still believe that I will have a tough battle winning it because of DODs stance on herbicide exposure. Please understand that I got sick in 1997, started seeing the VA in 2001 , was finally diagnosed after several misdiagnoses. It was in 2005 with the correct diagnosis and that I had enough research to start and follow thru, culminating in initial claims being filed in 2007.Then with denials on everything and led to me starting the appeals process in 2009. I am still waiting for a decision, good or bad so that we can get it to the BVA. That is why I always close all of my post with NEVER GIVE UP...... It is going to take strength , help from others ,ESPECIALLY HERE AT HADIT, God's grace and either a very good lawyer or a superb VSO to make it fly. I could not have done any of this with the help here with my brothers and sisters at Hadit.com Chemical Exposures are wicked , and deadly , but so is the DOD and the VA when it comes to adjudicating a claim with them. If you can perform the research and have the medical to back you up then you have , I feel better than a 50/50 chance of succeeding .   25. Hello All, We have seemed to run into a subject thread and I feel posting the FOIA information will help all of us to understand it and the vehicle and mechanism on how it works.... The National Archives and Records is the big one to search records so let her fly. I am going to post some of my actual FOIAs from many departments and their responses so that our veteran community can see how hard it is to get your hands on some records. Jbasser and Jerrel Cook and I have come to the same conclusions thru many denials of FOIA. If the veteran is getting a request that is sensitive to national security , especially opening records that will cause harm to the DOD and government and possibly having evidence overturning some huge court decisions then you will not get that information. Only time and letting everyone die off may open some of it. This should be an interesting learning curve for all Veterans here at HADIT . So let the fireworks begin. NEVER GIVE UP.
