After finding the decisions I was wrong about the RO change the decision if was BVA WHO CHANGE ITI got a decision in April granting 2003 eed date and another one in MAY 17. The Board vacates the April decision citing 3.400.. TDIU GRANT cannot be earlier than the effective date of the service connection grant for the disability upon which the TDIU IS BASED. So they got me on that because my service connection began in 2004 but the SSDI began in 2003. It best to reread your decisions at a later date because I bet you will miss some information. I don't see no way out it sound about right what yall think

I have a question and I ask for opinions good or bad. Its about one year of retro. BVA granted me a decision on 2003 effective date of the claim. then the RO Change the effective date to 2004 cutting 1 year off. I had a year of rehab or bed rest. If I file the claim in 2004 is it possible for them to grant the claim back too 2003 because that my SSDI effective date also. I don't want to waste years in appeal for nothing. Attorneys think I have a chance but I guess its not enough retro for them. Anybody

Looks like to me you have a winner. I guess you appealed the 2010 decision & if so they granted you 70 prior to2013 for ptsd and you should be at the 100% rate because of the TDIU grant .They should send you a break-down of your back pay because this doesn't say much.

I would think that if you are still at VARO OR BVA and your power of attorney is a VSO than you will have to change POA when you get to CAVC. ?? Why sign an attorney before a decision is made by VARO OR BVA??

You don't have long the judge will grant the claim or denied or remand it. The judge will make a decision very soon. IT could take a while to get the decision in mail but not long for the judge too decide it. jmho

If you send medicals records to the Board then you need a waiver for the board to decide the evidence. It best to build your own claim and get the records in. Attorney will get it in but a VSO he might. jmho

I get great relieve from it I don't take pain pills from nobody and VA wont cut your pay its like john999 says you cant get both . Every time I go to my appointments they ask are you still smoking , yes sir everyday. You doing good. But that's just me everyone has a different approach . Less side effects than pills. jmho

If you have an attorney you best to take his advice, because most attorney wont go to a hearing ,because they work on the evidence & and your attorney doesn't have your c-file how can he prove anything????

I am well aware of when and how eaja are paid and for what ,what I don't understand is how and attorney get 18k or even your 6k for and argument that's on 2 sheets of paper I had my attorney at BVA & CAVC AND I had him 6-7 years and his EAJA fees from CAVC WAS ONLY $1600.00 Buck I GUESS YOU CANT SEE TO WELL ITS NOT $160.000 BUT he did win me $175,000 and CAVC cost was $1600.00 18K AND 6K FOR CLAIMS THAT NOT WORTH THAT MUCH is what I don't understand. it doesn't make a difference when you hire an attorney but CAVC NOR VA will pay the attorney more than the veteran claim is worth and if so find another attorney..Why would CAVC pay an attorney more than a claim is worth???
