  1. Welcome Bill!

    I was assigned to an MLRS unit for Operation Desert Storm out of the 1st Infantry Division, Fort Riley! Bravo Battery 6th FA~ It was quite a show in Desert Storm when launchers from Fort Sill and my unit lined up and shot over 1500 hundred rockets at the Iraqis! Poor Bastards never had a chance!

  2. I had the same thing happen to me last month (Nov 10).......we called the bank and found out that I had a big ASS deposit in my bank! We called the bank and was told it was from SSA!

    POOF........just like that! I was given a FULLY FAVORABLE on the record decision w/o stepping into a court room! MEDICAL EVIDENCE IS KEY!

    I even had to call my attorney and notify them that I was awarded SSDI........they had no clue it was coming! Great NEWS STILLHERE!

    HAVE A MERRY CHRISTMAS! I KNOW I WILL~

  3. Again Congrats! IMHO......I would have the bank number on speed dial........to me sounds like your going to have a great christmas! Those funds will hit LONG before you get your decision letter from VA! But once you get your award notice, ensure that it states no future examinations for P&T! Best of Luck!

  4. I don't know if this is the step at which a C&P might be requested or if they're ready to make a ruling (when they get to my stack of paper).

    Yes. This is when "they" (VA) will schedule the C&P exam because they see that one was not given for the claim. The VA wants to have their doctors look at your claim before they render a decision!

  5. IMHO........The statement from the Voc Rehab Counselor would put you over the top in getting granted TDIU.

    I was in a similar situation I had a VRC come to my house for an ILS assessment and wrote a letter stating that I was not feasible for employment! The next week I was approved for TDIU!

  6. Labguy.......have you went to your Release of Information office and requested a copy of the C&P exams? You may or may not be able to get the C&P results for PTSD exam!

    Waiting times for the VA to process claims are extremely long, in most cases. For those other issues that you are claiming, once the rater see that you are claiming xxxx, and see that no C&P was performed, they will schedule the C&P for you. This has happened to me a few times in the past year!

  7. If YOU apply for 100% disability due to you being Totally Disabled due to Individual Unemployability (TDIU) and are granted this rating, then you told the VA that you COULDN'T work, so you best NOT work.

    But, if you can't work due to a single rating that the VA GRANTED to you due to your disability(s) and you did NOT request the TDIU but you were awarded the 100% anyway, or if a combination of SEVERAL disabilitys leads up to you being awarded 100% disabled without you having requested the TDIU rating...............................then you have NOT told the VA that you COULDN'T work, but, were, instead, granted your 100% BY THE VA due to the seriousness of your COMBINED disability picture..............then there is nothing to preclude you FROM working.

    I do not know John McCain's percentage of disability, but I dare say that if his total disability picture were to be taken into consideration (his physical and his mental and his POW status) that he would be awarded 100%, even if he DID NOT request a Total Disability due to Individual Unemployability rating. So, if he did NOT request TDIU and yet the VA DID rate him as 100% disabled (and I am sure that they would) then there would be nothing stopping him from working. However, IF he did say that he couldn't work due to his disability(s) and he requested TDIU, then he has already told the VA that he couldn't work, and it would be considered FRAUD for him TO work.

    That is why the VA REQUIRES that the veteran file a form 21-8940 (I believe that's the form number, but I haven't had my coffee yet this morning) thereby requesting the TDIU. Hence, the VETERAN has flatly stated that he/she CANNOT work, pretty much boxing the veteran into a corner that makes it very hard to get out of, if they, in turn, should be caught working, if granted the TDIU.

Looking for criteria on ptsd, I've been through the foum and havn't found this answer, can an event (mulitple attempted suisides) by a family member during my time in service be used in my claim for ptsd. I have military evedence also. This led to a hardship discharge and one inpatient stay while in service. If this can be used I can produce 15 year medical history. And I have dealt with the anxiety through hard manual labor, which makes me feel better than the medicine I'm on, is this a positive or a negitive?

    IMHO.......this is why there is a backlog of claims! Geeeze, when will the madness stop!

  9. Ebenefits does not work for many Veterans and signing up at Hospital is not all that important. I signed and have myhealthevet login and still could not get ebenefits to work. It took them over 3 months to respond to a simple email and than did not get a helpful answer.

    I'm in the same boat as Pete! I've been trying for months to use Ebenefits with no success. I've basically given up on using it at this point!

  10. I now understand the let-down of not facing those (SSA) that said that I WASN'T disabled from SSA! Although, I'm TOTALLY relieved that I was found Fully Favorable......I wanted my day in Court! Now, I'm just a name on a piece of paper with no face.....with no feelings, no nothing.........I WANTED MY DAY IN COURT! Sorry to ramble, but I'm still having an emotional let-down.........but I perk right back up when I call my bank account!

    Now.....I finally know what "they" were talking about!

  12. I was awarded SSDI on November 5th! The way we found out was my wife call the bank to check our account balance! Well the balance was HUGE thus I call my attorney to ask if I had been approved! The deposit was from SSA.......I rec'd the deposit before I rec'd the award notice! Anyways, its a GOOD DAY!

    I was awarded SSDI without going to the ALJ........I was getting scheduled for a hearing but I rec'd an ON THE RECORD Decision! My EVIDENCE was iron-clad! WOOOHOOOO!

    For those still fighting..........don't give up! That's what they want you to do!
