John you know you can't order the narcotics online I have to call every month and talk to a call senter person and I do it 7 days ahead and they show up the day after the refill date on my current bottle they send me 28 days at a time so I have to remember to check the dates I don't think they will ever change the narcotics policy they are to afraid we are selling them

    That's funny, because I order my Hydrocodone 10's (180) every month from via myhealthevet! They come straight to my mailbox!

    Yes, you can be TDIU and not P&T. When you receive your award letter, it should state no future exams, in order to be P&T! If it states future exams, then no, your not P&T!

  3. Did my C&P for a bunch of stuff but have not heard back yet. Do have some questions.

    During the ENT part the Doc's found a polyp on my Vocal Cord and have since removed it. The C&P was for sinusitist,

    Do I have to make a seperate claim for that or will it get included in the C&P results they send in to be rated.

    Also was told I have degenerative Disc disease. Had put in for Back Pain. How does that play into things. Was already diagnoist with type II Diabetied during a VA physical and claimed that. (Agent Orange) Also was told my sleep study folks that I have restrictive breathing (not apnia) and restless leg syndrom. How are those clasified. So last question is, I was relased from Active duty in June and just returned from Iraq, are the first Claims presumtive SC even if I do not have anything in my medical records. I belive the Diabetes is for Agent orange.

    Now just to clear the air. I am 63 years old and yes I got to play in Vietnam twice and once in Iraq as a retiree recall.

    Just too dumb to quit I guess. blink.gif

    I just left Louisiana and had the best VSO in Louisiana, St. Tammany Paish! His name is ROLF K. If you need an excellent VSO, I would advise you get with him in Slidell!

    EDIT:

    The VARO in New Orleans is the WORST in the country, consider yourself very lucky to get what you got from that VARO!

  4. I would recommend that you contact your local VR&E and get an appointment to see a counselor. Once the counselor see that you are physically UNABLE to work.......they will put that into a report. Then you can go down a few days later, to the ROI office (release of Information) and get what he/she wrote a in the VR&E report and use that as evidence for TDIU!

    None of what you mentioned has been done. However, the Varo requested a diabetes C&P exam and I failed a physical stress test because of the PN. It was documented in the record that I am a poor candidate for exercise due to the neuropathies. Lasted 1 minute 59 seconds onthe treadmill before my legs buckled. (On another note, the examiner gave the VARO hell in her report for not supplying my c-file although it was requested twice.)

    Yes.Upper and lower extremities were rated on separate claims and bilateral factor was used.

    I think your chances would be pretty good once the VARO seen that you performed poorly on the Physical Limitation test.

    I think it would be a great piece of evidence to help you get granted TDIU! JMHO!

  6. I posted this for someone else but it may apply to you as well:

    You need to be assess by an Occupational Therapist supporting your physical limitations. Have your PCP give you a referral to see an Occupational Therapist, they will conduct a Physical Limitation test (push, pull, walk, etc) to support that you are PHYSICALLY unable to work. Once that is done, you will be referred to VR&E which will contact you for a ILS assessment (well this happened in my case). Usually this person is a VR&E counselor, so they can write a letter stating that you are unable to gain suitable employment. Once this is done, POOF, you will have medical evidence to support being awarded TDIU.

  7. I can't say there was any bias, other than the fact that he picked and chose parts of treatment records to support his decision, and ignored the bad things.

    It says that filing a complaint will delay any appeal currently in process, and I would hate to be moved to the top of the pile. With the additional information we have submitted, weakening some of the ALJ's reasoning and eliminating other parts of his decision, I am hopeful for something to come out of my appeal to the Social Security Appeals Council.

    However, it is good to know there is an agency to file a complaint about an ALJ with.

    Is your condition PTSD? Just wondering!

    Don't give up........that's what they want you to do!

  8. Sorry - but NO - NO - NO - in this case that will not work AT ALL in helping RSG get IU.

    He is ONLY SC'd FOR MH Disability.

    His physical conditions are NON SC'd, so just bringing that up will help VBA to continue a denial,by providing even more evidence

    that his NON-SC'd disabilities are the reason for his inability to hold employment.

    Great point.......I totally realized it after I wrote it. I actually realized it not more than 10 minutes ago, after remembering he has MH problems versas physical limitations!

    So I came back to make a correction and see that I've been corrected! Awesome! Thanks Carlie, I was missing the boat on this one!!

    The statement above is EXACTLY what I did. Then a week later I was granted IU! PERIOD!
